The offer to James McCrae was stark and terrifying: Keep quiet, and you're $20,000 richer. Talk to the law, and you're dead.

McCrae, fearing for his life, told Brooklyn prosecutors in April that he believed the threat was from a man who months earlier had shot him in the face - but was free on $25,000 bail.

He sought protection from the district attorney's office. There are discrepancies between the word of authorities and that of McCrae's girlfriend on efforts to keep McCrae safe until he could testify against his alleged assailant.

But there is no question about what happened on Sept. 10.

About 1:45 a.m., McCrae, 36, a custodian, was shot in the mouth, arm and back after dropping off a male friend in Bushwick. Three hours later, he died at The Brookdale University Hospital and Medical Center.

In December 2004, James McCrae testified before a Kings County grand jury that he was shot in the face by Deion McCrae... In September 2005, James McCrae was fatally shot... After an investigation, the defendant was indicted, among other things, for murder in the first degree, murder in the second degree, and several weapons possession charges...

After a trial, the jury returned a partial verdict, convicting the defendant of attempted murder in the second degree and criminal possession of a weapon in the second degree for the December 2004 shooting. The trial court declared a mistrial with respect to the first-degree and second-degree murder charges and the related weapons possession charges filed in connection with the complainant's death in September of 2005.

After a retrial on those charges, the jury was unable to reach a verdict and the court declared a second mistrial. The defendant was not retried again.
