    GA - Diane McIver, 63, fatally shot, Atlanta, 25 Sept 2016 *Arrest*

    (I am a new member so if this is in the wrong sub forum, let me know. Technically, it hasn't been ruled a "crime" at this point)

    Tex McIver’s attorney, Stephen Maples, has said the couple were being driven home to Buckhead from their other home in Putnam County on Sept. 25 when they pulled off I-85 onto Edgewood Avenue due to traffic. Tex McIver was sitting in the rear seat and his wife in the front passenger seat when they spotted some people milling about and pulled a gun from the center console of the SUV. Maples said homeless people have been known to hang out under the overpass there.

    BBM. You don't just get off on Edgewood because of traffic. The only people who do that are visitors to our fine city who don't know better. IMO.

    The most ridiculous aspect is Tex claims he was asleep then got his gun out because he was scared yet he was apparently back off to sleep when the gun "went off"

    True. One among MANY bizarre things about this case.

    Three business people and not a cell phone among them to call 911? (Of course, the 911 call would have been recorded as evidence).
    At first claimed he was frightened by Black Lives Matter, then recanted that. (That was the only part of his story that made sense to me, but now he denies it)
    How could he have been so scared as to be armed, but fall asleep?
    Very strange account of the driver: has gone from no one to a "chauffeur" to his wife's best friend.

    Even the title of this article is bizarre and ridiculous!

    He could have taken and failed 100 paid PRIVATE polygraph tests, and never even mention that he had failed even one. Not saying that he did, but that would be a tactic when one is guilty as hell.

    McIver has passed a polygraph test, during which he was asked if he intentionally or knowingly shot his wife

    McIver, 74, a well-known corporate attorney who is active in Georgia’s Republican political circles, has vehemently denied the notion that he intentionally shot his wife, describing the September 25 fatal incident as an 'accident' that ruined his life.

    Oh, and since her demise "...ruined his life..." --wouldn't he want to keep some of her possessions-- since that's all he has left , to remind him of Diane ?

    Seems somewhat hinky. Imo.
    I'm sensing a possible future episode of this on Dateline.
    But maybe he did just wake up, become startled, and his gun went off ??

    He may be telling the truth and it was a horrible accident.
    Things I find hinky:
    -Edgewood is a strange place to pull over because of traffic. I don't see a
    Professional driver doing that or someone familiar with Atlanta.
    - if you are nervous enough to take out your gun (and remove the safety?)
    are you likely to fall asleep?

    It has been reported the driver was a close family friend.
    Maples said Diane McIver's best friend of thirty years, whom he only identified as Dani Jo, was driving. The three were on their way back to Atlanta's Buckhead community from the McIver's farm in Putnam County.

    Also FWIW, I've lived in Atlanta 15 years and use Edgewood quite often. I use it to as a side route to Cabbagetown, Inman Park, and several other downtown neighborhoods. IMO, if they were heading to Buckhead and ran into traffic on the downtown connector it would not be uncommon for a driver to exit onto Edgewood Ave. From there, they could easily take Piedmont Ave. north toward Buckhead. That is a one way street until you get closer to Buckhead and it is often used as a route out of the downtown and midtown areas. JMO.

    I live near Edgewood and take that exit often. I have never felt unsafe there but I can see how someone of another generation or another walk of life could be nervous driving thru there. IMO feeling the need to pull your gun out and have it at the ready is extreme. In 20 years of driving in that area several times a week, I have never felt the need for a weapon. But, that is me..others may feel threatened and feel they need protection. I can understand that. I just don't understand how you could fall asleep shortly after feeling the need to pull out your gun.

    Atlanta Police have issued an arrest warrant for prominent Atlanta attorney Claude "Tex" McIver, who shot his wife inside an SUV near Piedmont Park in late September. McIver faces charges of reckless conduct and involuntary manslaughter in connection with the shooting death of his wife, Diane McIver.
