NY - Gay Man Seeks Marital Privilege At Trial
A New York judge will have to decide if a state law protecting spouses from having to testify against each other also applies to same-sex partners.

Why is it that when a custodial parent fails to provide for a child it is called neglect and is a criminal matter. But when a non custodial parent fails to provide it is called failure to support and is a civil matter?

I'm not wild at all about the whole marital privilege - I want criminals caught and jailed, not let free because of some technicality. However, if it exists, I don't see any reason why it matters what gender the committed couple is.
