Hamad may be eligible for the death penalty.

"Joshua Haber, 19, died at the scene, and Josh Williams, 20, of Woodbine Avenue, died later at the hospital. Bryce Hendrickson, 20, of Dawson Drive in Howland, and John Shively, 17, survived, along with April Trent-Vokes, 42, who police say drove the four young males to Hamad’s home, including her son, Haber."

The affidavit says Hendrickson and Shively arrived at Hamad’s house later that day in a van with two other young males and Trent-Vokes. Shortly after the van pulled into Hamad’s driveway, a fist fight ensued between Hamad and Shively, the affidavit says, noting that the four other people “exited the van.” It adds: “The fight ended, and the five individuals from the van then returned to the van,” which was parked near the road.
That’s when Hamad went inside and retrieved a gun from his bedroom, the affidavit says.
“I just shot them,” Hamad told detectives. “I got tired of this [deleted], they been [deleted] with me for a long time, and they shouldn’t have come over.”
 
According to the article this guy even went back inside the house after emptying the first magazine to reload. An EMT had then pulled in, thinking it was a car wreck, and Hamad continued shooting into the minivan in front of the EMT, and also shot after the two guys who fled into traffic. And traffic there is busy. He could easily have hit people in cars driving by. I don't condone going to someone's house to fight them, but this was way more than self defense IMO.

It is awful. The part where Hamad said "I'll show you what happened" when the EMT asked what had happened, and then proceeded to empty another magazine, killing Haber who was yelling at him "you shot my mom", sent a chill down my spine though. It sounds so cold-blooded.

This is a terrible situation all around, but I want to point out this is an example of the risk that our first-responders take every day. They never know what they are going to roll up on.

I'm very thankful none of them were hurt or killed.

Right! Most ppl even if they went this far in a rage would snap out of it at that point!

I'm curious to see how this case will go. I'm surprised so many people think Hamad was completely justified. If I had been driving on route 46 while he sent bullets after fleeing people, I'd be pretty mad, tbh. [/FONT]
 
honestly, these ppl had prob been effin with him for awhile. but he took it way too far.

Police received more than 400 calls during the shooting. Tells you something about how busy the area is. Very very lucky that no bystanders/passers-by were hurt or killed.
 
Horrible crime, hope the guy gets put away for life.

The part I don't understand, though, is why a mom would drive her kids and their friends over to this guys house to start a fight with him. Not good judgment on her part.
 
Trial reset in Hamad’s capital murder case
The Howland man facing capital murder charges in the Feb. 25 killing of two people and wounding of three others at his home will be tried Sept. 18.

Nasser Hamad, 47, 1564 state Route 46, appeared before Trumbull County Common Pleas Court Judge Ronald J. Rice on Thursday afternoon and signed a waiver relinquishing his right to a speedy trial for 180 days. A scheduling conflict in Rice’s court wiped out Hamad’s original May 22 trial date, and lawyers for both sides stated they needed time to prepare for the case.
 
Venue change sought in murder case
Attorneys for the Howland man facing capital murder charges in the Feb. 25 killing of two people and wounding of three others at his home have filed a host of motions, including a request for change of trial venue, that may be addressed by a Trumbull County judge today.

A Trumbull County judge has ruled that the capital murder case against Nasser Hamad will continue with a possible death penalty.

Judge Ronald Rice issued rulings on nine separate motions on Wednesday, denying nearly all of them.

Judge Rice also rejected a motion asking that the trial be moved out of Trumbull County.

The trial is currently scheduled to begin on October 10th.

Judge Ronald Rice decided to save a ruling on the state’s motion to prohibit any expert psychological testimony regarding Hamad’s self-defense claim until an appropriate time during the trial.

Tuesday, Judge Rice also asked if any plea negotiations have been talked about.

Hamad’s attorneys said the defendant asked them not to pursue a plea option because, at this point, he would not accept one.

Hmm... they're really not wanting to talk... I don't think they fall under the gag order so they should be able to if they wanted. Hendrickson's death really could be as 'simple' as a drug overdose since those are rampant in the area, but I'm intrigued, to be honest.

Judge Rice explained the prospective jurors’ obligation to avoid any news coverage of the trial, to stay away from social media and to otherwise refrain from activities that could jeopardize their ability to serve impartially on the jury.

Because the death penalty is a possibility in this case, an especially large number of jurors were summoned for the case compared to most other murder trials. Jury selection, which will begin in earnest Thursday, is likely to take about a week.

Trial testimony, likely to begin next week, is expected to take about three weeks.
