Hapoened today, Landmark Death Penalty Verdict in Gary Sampson Murder case...Particularly heinous murderer Sampson killed three people up here and NH ....One was a great kid...college student...who was helping him out giving him a lift., killed him to steal his car.... some called him the "Good Samaritan Killer"...It was very sad when they found the boy tied to a tree in the woods, Everyone had searched for him....This guy will get whats coming to him...

A federal judge determined that incorrect answers of jurors during voire dire was sufficient to grant Mr. Sampson a new DP trial.

Specifically, he cited this juror:
"Wolf found that one of the jurors had intentionally and repeatedly answered questions dishonestly in an attempt to avoid talking about subjects that were painful to her. She never disclosed, for example, that her husband had a rifle and had threatened to shoot her, that she had ended her marriage because of her husband's substance abuse and that her daughter had served time in prison because of a drug problem.

Wolf said in his ruling that if the woman had disclosed those things during the jury selection process, the court would have found that there was a "high risk" that after listening to the evidence at Sampson's trial, her decision on whether to sentence Sampson to death could have been influenced by her life experiences. Wolf said the woman likely would have been excused from serving on the jury."

This guy was sentenced to death in 2003 and just now the district is deciding his appeal/request for retrial? Are you kidding me? This is federal court. That means there are very few appeal options. Trial, appeal to 1st circuit, Supreme Court. How is it that a request for new trial sat around for 9 years?

Wolf ordered Sampson defense lawyer Danalyn Recer to explain why she should not face sanctions for violating a previous court order in the high-profile case, which involves the possibility of the death penalty...

On June 30, the judge barred defense lawyers and prosecutors from having any contact with a Bureau of Prisons medical examiner who was conducting a mental health evaluation of Sampson to determine whether he is fit to stand trial. The judge has raised concerns that Sampson suffers from a mental health disorder, and the order was meant to prevent both sides from influencing the evaluation.

Recer disclosed she communicated with the examiner and raised concerns his evaluation went beyond the narrow focus Wolf requested. Wolf said he could consider sanctions, such as revoking Recer’s right to practice in Massachusetts and removing her from the case.

A federal appeals court appeared Wednesday to rebuff an emergency plea by convicted serial killer Gary Lee Sampson to have evidence excluded from his upcoming death-penalty trial.

Sampson, a drifter from Abington who admitted to killing three people during a carjacking spree in 2001, was sentenced to death in 2003. A federal judge later overturned that decision, finding juror wrongdoing. A new sentencing trial is slated for Sept. 14.

Sampson, 56, asked the US Court of Appeals for the First Circuit on Wednesday to exclude certain evidence introduced in his 2003 sentencing trial, saying the jury’s verdict shows that jurors — even though he was sentenced to death — had rejected some of the prosecutors’ arguments related to that evidence.

Gary Lee Sampson's lawyers say he is so sick that he will likely die soon from natural causes, but that hasn’t stopped federal prosecutors from launching a mammoth effort to secure the convicted spree killer’s execution before then.

Prosecutors on Tuesday filed a list of more than 70 witnesses they plan to call over the course of Sampson’s second penalty-phase trial, scheduled to start Sept. 14. Sampson, a former Abington drifter convicted of killing two men on the South Shore and a third in New Hampshire, has already been sentenced to death once, but the sentence was thrown out after the judge in the trial found that a juror had lied about her background.

They are pieces of evidence the jurors didn’t get to see, the bloody, shredded shirts that Jonathan Rizzo and Philip McCloskey were wearing at the time they were stabbed to death in July 2001.

Thirteen years ago, US District Judge Mark L. Wolf refused to show them to jurors in the death penalty trial of Gary Lee Sampson, finding they were so graphic they would pose a “risk of unfair prejudice” toward the death penalty. Sampson, who had admitted to the murders, was sentenced to death anyway, but the jury’s verdict was overturned on appeal.

Now, in advance of Sampson’s new death penalty trial in September, US District Judge Leo T. Sorokin said Friday he wants to see the shirts himself, reconsidering prosecutors’ arguments that the shirts speak to the “heinous, cruel, and depraved” nature of his crime, making him deserving of death.

By all accounts, Gary Lee Sampson was quick to confess to five bank robberies, and carjacking and killing three people in 2001, including 19-year-old Jonathan Rizzo.

“He told us that killing that young kid was nothing but cold-blooded, premeditated murder,” Michael Crisp, a retired State Police major who investigated Rizzo’s death, told a federal jury in Boston Wednesday.



But on the first day of Sampson’s second sentencing trial, prosecutors and defense attorneys disagreed on the motive behind the confession, a distinction that could make the difference between life and death.

As Gary Lee Sampson fights for his life in his federal death penalty retrial, the government rested its case in chief Monday and the defense took over, presenting its first witness.

Retired Terre Haute federal penitentiary warden and defense team correctional consultant Mark Beezy testified about the conditions Sampson could face in prison if he is given a life sentence.

This video of Sampson allegedly attempting to assault a corrections officer with a broom handle sharpened into a shank was central to the testimony. The government arguing it shows how dangerous Sampson is while in custody, even in the Special Containment Unit on death row.
