Homeowner arrested after fatally shooting intruder he found in his shower: Police

The homeowner said he arrived at the home, one of at least two that he owns in the Belfair, Washington, area, around 8 a.m. and noticed that a door had been kicked in, according to police.

The homeowner went inside and exchanged words with Rosa, who was in the shower at the time, police said. The homeowner left the premises without calling the police and returned with a firearm, police said.

"He returned home, retrieved a firearm, came back over to the residence and fired multiple rounds into the shower ... killing the intruder," Mason County Sheriff's Lt. Travis Adams told ABC affiliate KOMO.

Apparently there was an initial outcry against charging the man, but that was before full details had been made available.

The Mason County Sheriff's Office took to social media late Saturday afternoon, encouraging the public to await further information, rather than rush to judgment.

Sounds like murder to me. The alternative might have been to ask police to escort the unwanted visitor away.

Love to hear the rest of the story. You kick in the door of a strangers house to take a shower. Your confronted and have words with the homeowner. The homeowner leaves and you continue with your shower. WHAT

Assuming he was naked while showering, how did he pose any sort of threat to homeowner? He should be charged with murder. What else is it?

I wonder if the two men knew each other and had an argument while the victim was in the shower, so the homeowner left and got a gun and came back and killed him, and then he had to make up a story.

Maybe he caught his wife cheating

Yes, it is strange. Maybe the "more to the story" aspect is that the victim was renter with some kind of occupancy right until formally evicted?

well he deserves it, he was not in danger and left, did not call LE and returned and shot the person. its murder.

This reminds me of a case where 3 teenagers broke into a mans home where he was waiting in the basement ready to shoot them and he did, killing 2 of them. He wasnt charged with murder.

Often it depends on the state's self defense laws in these situations, especially whether they have the Castle Doctrine. However, with this homeowner leaving the location and then coming back the self defense laws may not really apply. Also, it wasn't too clear if he actually resided at the property but it didn't seem like it. That can effect the ability to claim some defenses as well. JMO, I don't practice criminal law or hold a WA law license and haven't researched the laws at play here specifically.

Bruce Fanning: 5 Fast Facts You Need to Know
Fanning said he went to his main place of residence next door, got a gun, went back to his place of business and shot Rosa while he was still in the shower, the sheriff’s office said. Rosa was naked, did not make any threats toward Fanning and there was no physical confrontation prior to the shooting.

“All the information that we have indicates that the guy was undressed, in the shower, taking a shower, Lieutenant Travis Adams told the New York Times. Fanning told police he thought Rosa was drunk.
...
Investigators are not sure why Rosa was in the home, but said it might have been a mistake. There are four homes in a row in the area where the shooting occurred, KOMO-TV reports.

Police said the screen door had been kicked in.

The sheriff’s office said Fanning should have called 911 after finding Rosa in the shower.
...
The shooting was not in self-defense, police said, because Fanning left the house. The sheriff’s office said the use of force by Fanning was not lawful.

“There’s no duty to retreat, but at this point, the owner did retreat. Then he came back and reintroduced himself to the situation and shot,” Chief Deputy Ryan Spurling told the New York Daily News. “Based on what he knew at the time and what he told us, it didn’t fit self-defense.”
...
According to Washington state law, second-degree murder is charged when a person “with intent to accuse death of another person but without premeditation … causes the death of such person or of a third person.” It is a class A felony. Fanning faces up to life in prison if found guilty.

From the news accounts, Bruce Fanning didn't live there, it was just his office. According to the sheriff, he had time to go get a gun and return to the other home to shoot the man. Sheriff also said Fanning didn't give any kind of warning to the victim that he had a gun.

Since the victim was visiting his mother nearby, you kind of wonder if he had met up with the homeowner and was in the "office" house by invitation. LE said there was other information about the case that they couldn't reveal right now. Perhaps some elements of the crime scene were stage or evidence removed.
