This is the Babcock murder trial discussion thread.

A few general reminders about the trial:

Any testimony that might remain under Publication Ban, and/or any courtroom discussion that takes place when the jury is not present, is strictly off-limits.

Only testimony that is published through MSM reporting (newspaper articles, tweets, tv) is allowed. Provide a source link, and keep discussion focused on testimony as it becomes public knowledge.

The magnificent principle of “innocent until proven guilty” is for the court room … it is not required that the general public / Websleuths members adhere to that principle. Members are allowed to discuss, speculate, theorize, and judge according to opinions they develop from following the specifics of the case.

At all times, remain VICTIM FRIENDLY. No bashing or passing judgment on the victim or family.

A good guy emerges at grim trial into Laura Babcock’s murder

Liam Casey Shawn Lerner turned himself into an amateur sleuth after the disappearance of his ex-girlfriend Laura Babcock.

“You don’t like me, do you?”

It probably would not have required being under oath for Shawn Lerner to give an honest answer.

“No.”

Lawyers don’t give a fig whether witnesses under cross-examination like them or not. It’s an adversarial process.

But Dellen Millard, who is representing himself in court, is one of the two defendants on trial for first-degree murder in the death of Laura Babcock, whose remains have never been found.

The prosecution says Millard and Mark Smich killed her five years ago, then disposed of the young woman’s body in an incinerator.

“You find me sketchy.”

More a declaration than a question but Lerner responded. Yes, he does.

When Babcock went missing in early July, 2012, it was Lerner, her former boyfriend, who raised the alarm.

TORONTO – A banking specialist will continue testifying today at the trial of two men accused of killing a 23-year-old Toronto woman and disposing of her body in an incinerator.

The Crown alleges that Dellen Millard, 32, of Toronto, and Mark Smich, 30, of Oakville, Ont., murdered Laura Babcock because she was the odd woman out in a love triangle. Both have pleaded not guilty to first-degree murder.

Let's hope today is a good day for the trial and the noose tightens for DM and MS.....
 
Reading over yesterdays testimony and subsequent trial coverage I thought: DM is getting exactly what he wanted. This trial is all about him.

While yes, he is on trial and the trial is about him, the coverage has taken on a DM central slant rather than feeling like it's about justice for Laura. I don't recall feeling that way about the TB trial. Just an observation and jmo.
 
Can anyone recall the rough time period where DM was engaged to the unnamed woman who now lives abroad? She was the one in the engagement photos: http://www.annrbrocklehurst.com/2013/12/dellen-millards-engagement-photos.html

I'm trying to figure out where that timeline overlaps with the events around Laura Babcock. From the article, the engagement photos were taken in Spring 2011, however how long was the whole realationship?

Safe to assume DM MAY have had reasonable access (hopefully under VERY close watch) of the internet.. This may be another reason that he's decided to represent himself .. Which means he MAY have had access to sites like this one. I wish I was more optimistic that something like this COULDN'T happen.. but the guys got some $$ - might be a nice salary supplement for someone to turn a blind eye. Hopefully if he did have access to internet, it was closely monitored, and or blocking any sites other then the law libraries, or CANLII or the like..

Use of Electronic Devices in the Courtroom

Unless the presiding judge orders otherwise, the use of electronic devices in silent mode and in a discreet and unobtrusive manner is permitted in the courtroom by:
counsel;
paralegals who are licensed by the Law Society of Upper Canada;
law students and law clerks assisting counsel during the proceeding;
self-represented parties; and,
media or journalists

BBM, it is possible. I can imagine the need, especially access to a laptop with internet to look up precedent, etc. I'm not sure if he would have regular access outside of the courtroom but it's reasonable to believe that he has some access to review evidence (including all the electronic evidence) and prepare for the trial.

Another poster wondered if DM would have access to sites like this one. Honestly, the amount of work that he has behind him and ahead of him, I don't think he has the time for WS or any social media, even if he has the access.

Questioning Mr. Babcock and SL is small potatoes and almost "social", for the lack of a better term, for DM. I, honestly, question his ability to hack it and stick it out further in the trial when LE and data and forensic experts take the stand. This will be weeks/months of back to back witness after witness. He will get worn down and less prepared. Maybe is he counting on Dungey to ask the real questions while he focuses on his social witnesses.
