This is the Babcock murder trial discussion thread.

A few general reminders about the trial:

Any testimony that might remain under Publication Ban, and/or any courtroom discussion that takes place when the jury is not present, is strictly off-limits.

Only testimony that is published through MSM reporting (newspaper articles, tweets, tv) is allowed. Provide a source link, and keep discussion focused on testimony as it becomes public knowledge.

The magnificent principle of “innocent until proven guilty” is for the court room … it is not required that the general public / Websleuths members adhere to that principle. Members are allowed to discuss, speculate, theorize, and judge according to opinions they develop from following the specifics of the case.

A few general reminders from Websleuths TOS aka The Rules.

At all times, remain VICTIM FRIENDLY. No bashing or passing judgment on the victim or family.

There is ZERO TOLERANCE for snarky or disrespectful posts. Don’t expect an explanation … you will find your post has simply disappeared, or that you can no longer post.

There is to be NO name calling or name variations, not even of the accused.

BICKERING between members is not allowed. If you disagree, that's fine, say so and move past the post. If a post is offensive, alert it and let the Mods review it. If you respond to the post, both the offensive post AND yours will be removed and may result in other consequences.

Alert on a post and move on without discussing it, and don't question the decisions of our Mods/Admin or Owner. Also do not expect personalized responses with explanations about a particular decision.

Do not abuse the WS Alert feature. Abuse includes, but is not limited to:
• Overuse of the alert system
• Repeatedly alerting on the same poster
• Demanding a specific outcome
• Alerting on the same post more than once

If you have any questions, use the Alert feature or send a PM and we will be happy to assist.

Accused killer admitted to burning a body, friend tells Laura Babcock murder trial
By Trevor Dunn, CBC News Posted: Oct 25, 2017

A friend of one of the two men accused of killing Laura Babcock has testified that he heard one of them admit to burning a woman's body and disposing of her cellphone in a lake.

The jury heard from Desi Liberatore, 21, on Wednesday at the first-degree murder trial of Dellen Millard, 32, of Toronto, and Mark Smich, 30, of Oakville, Ont. Liberatore, who grew up in Oakville, was friends with Smich.

Liberatore first provided information to police linking Smich to the Babcock case in September 2013, while he was in custody for another matter.

Babcock was 23 when she disappeared from Toronto in 2012. Her body was never found.

I wonder why the blog has not yet gone live...?

Thanks again, Coldpizza!

After a 30 minute delay, day 4 of the Laura Babcock murder trial is underway.

David Cronin, 22, is a friend of Mark Smich and is facing questioning now from Crown Jill Cameron.

Yesterday we heard from Desi Liberatore who was also part of Smich's inner circle. He told the jury about an encounter in Smich's mom's garage, where Smich pulled out an iPad and start performing a rap he wrote.

The Crown read the lyrics during opening statements:

The ***** started off all skin and bone/

now the ***** lay on some ashy stone/

last time I saw her's outside the home/

and if you go swimming you can find her phone.

Smich said it was more than just a rap. Cronin is now recounting the same tale.

Oct 26 2017 10:42 AMCronin says "honestly at the time I didn't believe it." He said Mark seemed like he just wanted to be "the big cool guy."

Oct 26 2017 10:46 AM
Yesterday Smich's lawyer Thomas Dungey tried to chip away at Liberatore's credibility and memory. Liberatore admitted to being a heavy drug user.

Cronin agrees they were passing around a joint, and there was some booze, but neither was his thing.

"My mind was very clear," Cronin tells the Crown.

He also adds the friends never confronted Smich about the rap or his confession.

Oct 26 2017 10:52 AM
Cronin says he reported the information about the alleged murder to police in May 2013. He alerted the vice principal at his school, who called Toronto Police.

He'd heard media reports about a missing girl.

This is unlike his friend Desi Liberatore, who actually only exchanged information with police after he was in custody for another matter in 2014.

DM must just be itching to give MS the stick eye every time that Rap video is mentioned, I wonder if he was forewarned it would not be tolerated whilst re reps himself?

Kudos to the latest witness, for getting his life together and going to police with this info on his own accord, once he realized it was actually a true story!

Delay in #Babcock murder trial today. Still waiting for courtroom to open. I will tweet the proceedings & recap 6pm @CHCHNews

Lisa Hepfner‏ @HefCHCHNews
First witness at #Babcock trial is David Cronin, just sworn in.

Lisa Hepfner‏ @HefCHCHNews
Cronin is 22, works in "custom home construction." Is going back to school this year, finished pre-law. Lives in #Oakville, "born & bred."

Lisa Hepfner‏ @HefCHCHNews
Cronin does not have a criminal record, but has had interactions with police. July 2014 arrested for stealing hockey cards. #Babcock

Lisa Hepfner‏ @HefCHCHNews
Nov 2016rand late had incidents where he slammed on his brakes and waved middle finger at police. "I was not in the right state of mind."

Lisa Hepfner‏ @HefCHCHNews
Do you use drugs? Currently no. He had a drug problem in the past. Hasn't had any intoxicants for 2 years. Started marijuana at 14 yrs

Lisa Hepfner‏ @HefCHCHNews
Hard drugs at 17yrs. by the time he was 18 had a heroin addiction. Rehab, counselling, sober 2 years. "Congratulations," crown Jill Cameron

Lisa Hepfner‏ @HefCHCHNews
Conin knows accused Mark #Smich. Met when they were about 16 he thinks. Smich would buy he and his friends cigarettes. #Babcock

Lisa Hepfner‏ @HefCHCHNews
"After awhile of buying us cigarettes and chatting after... we were smoking marijuana and he offered to provide it," Cronin says of #Smich

Lisa Hepfner‏ @HefCHCHNews
Once they had #Smich number, the high school buddies saw him a few times a week. He lived minutes from their school. #Smich was early 20s

Lisa Hepfner‏ @HefCHCHNews
#Smich lived with his mother, Cronin says. #Smich's mother is in the courtroom. Chomping gum. Watching dispassionately

Lisa Hepfner‏ @HefCHCHNews
One night the friends were hanging out, smoking a joint and having a couple beers, Cronin says. He doesn't remember much until this:

Lisa Hepfner‏ @HefCHCHNews
At some point Mark says, Marlena could you leave? Mark got serious for a second and said to us you guys can't tell this to anyone....

Lisa Hepfner‏ @HefCHCHNews
"He killed a girl and burned her body and threw it in the lake," Cronin says #Smich then pulled out his rap song and played it.

Lisa Hepfner‏ @HefCHCHNews
Cronin: "At the time I didn't believe it. When you're a boy you want to be the big bad tough guy... I didn't take it very seriously." #Smich

Lisa Hepfner‏ @HefCHCHNews
It was just a cappella, Cronin says of the #Smich rap. No music. He remembers the iPad; an original model. Understood it to belong to #Smich

Lisa Hepfner‏ @HefCHCHNews
Cronin is describing where everyone was standing in the garage. There was a car under a blanket. #Smich #Millard #Babcock

Lisa Hepfner‏ @HefCHCHNews
Cronin never really liked marijuana so he didn't smoke much of it, or drink much. Those were not his vices. "My mind was very clear."

Lisa Hepfner‏ @HefCHCHNews
Cronin left with his two friends. They spoke about it vaguely; none believed #Smich was telling the truth about murder & incineration.

Lisa Hepfner‏ @HefCHCHNews
The friends would speak of the incident "in passing," Cronin says. Since then they've spoken about how #Smich's story "wasn't a lie."

Lisa Hepfner‏ @HefCHCHNews
Cronin is surprised his friend Desi Liberatore didn't call him last night after testifying.

Lisa Hepfner‏ @HefCHCHNews
"He told us he killed a girl, burned the body and threw it in the lake. Then he played the rap. The only part I remember is you can find..."

Lisa Hepfner‏ @HefCHCHNews
"...her phone in the lake," Cronin tells Justice Code, who asked for clarification. #Babcock.

Lisa Hepfner‏ @HefCHCHNews
Has Cronin met Dellen #Millard? "Vaguely," Cronin explains that means they have met in passing. #Millard was not in the garage for rap

Lisa Hepfner‏ @HefCHCHNews
Cronin has also met a guy named Ish, "I don't mean to stereotype but he looks like a gangster. He has lots of tattoos on his body and face

Lisa Hepfner‏ @HefCHCHNews
Cronin met Ish "coming out of a back shed" at #Smich's house. That happened two or three times in the summer of 2012. #Babcock

Lisa Hepfner‏ @HefCHCHNews
Cronin reported the incident to police in 2013 when he heard that a girl had gone missing the previous summer and nothing had turned up.

Lisa Hepfner‏ @HefCHCHNews
Cronin went to his school vice principal, who connected him to police. He made a statement that day. May 2013. #Babcock

Lisa Hepfner‏ @HefCHCHNews
Crown is going to play the #Smich rap song for Cronin now. There is back ground music. After song a joint, and a girl ID'd as Marlena yest.

Lisa Hepfner‏ @HefCHCHNews
Cronin is openly crying on the stand. Can barely talk. That was the rap he saw in the garage. #Babcock

Lisa Hepfner‏ @HefCHCHNews
"He killed a girl and burned her body and threw it in the lake," Cronin says #Smich then pulled out his rap song and played it.

Did they incinerate and then throw the ashes in the lake??

Lisa Hepfner‏ @HefCHCHNews
He says that is Marlena, the girl who appears with #Smich in the video. #Babcock

Lisa Hepfner‏ @HefCHCHNews
As Cronin wipes tears from his face, #Millard says he has no questions. Break while Dungey prepares his.

marianne boucher‏ @CityCourtsTO
Jury now watching video of Smich rap and Cronin breaks down , "It's a lot to deal with" he says as he wipes his eyes.
