Without warning, judge calls mistrial in murder case

Defense attorneys dismissed, too; courtroom meeting scheduled Monday

The judge in the Anoka County murder trial of Joshua Allen Krueth declared a mistrial Friday morning and removed the defendant's two attorneys from the case, the county attorney's office said.

Judge Dan Kammeyer also granted a defense motion to seal the transcript of the private hearing in which the mistrial was discussed.

Officials refused to give further details about the reason for the mistrial.

...Krueth is charged with killing 60-year-old Lawrence Plessel of Ramsey in September 2004, two weeks before killing Suzanne Fischer in the same town — a murder to which Krueth pleaded guilty.

His attorneys had argued that although he was a convicted murderer, he was innocent in the Plessel case.

Mistrial Declared In Anoka County Murder Trial

"A new jury selection process and a retrial will be scheduled at a hearing Monday. William Ward, the chief public defender for the 10th Judicial District, will represent Krueth at that hearing, but is expected to find new counsel outside the district for Krueth."

Man Sentenced For Killing Sleeping Woman

(AP) Anoka, Minn. The 21-year-old man who was high on methamphetamine when he entered a Ramsey, Minn. home and shot a woman while she slept was sentenced Wednesday to life in prison.

Joshua A. Krueth won't be eligible for parole for at least 30 years, minus the year he has already served in jail.

"Thirty years ain't long enough," said Jerome Fischer, the victim's husband.

Murder Suspect Asks To Join SWAT Team

(AP) Anoka, Minn. A man accused in two fatal shootings in Ramsey will undergo a psychiatric evaluation, after asking an Anoka County prosecutor if he could join the SWAT team so he would have a "good reason to pull the trigger."

Joshua Krueth made the request in a note sent from prison to prosecutor Sean Gibbs.

"Can I please join the S.W.A.T. team?" said the note, which contained spelling and grammatical errors. "I'm here for one reason, to save life's. I need a good reason to pull the trigger and find licence to kill. Thank you good day."

Man Charged In Ramsey Murders

(AP) Minneapolis A Ramsey man has been charged with murder in the separate shooting deaths of a man and a woman in their homes, random crimes the county sheriff had called the work of a "serial killer."

Joshua Allen Krueth, 20, was charged Tuesday in Anoka County District Court with two counts of second-degree murder -- one each in the deaths of Suzanne Fischer, a hospital nurse, and retiree Lawrence Plessel. Both lived in Ramsey, not far from Krueth.

According to criminal complaints, Krueth told authorities he killed the pair but the court documents do not indicate whether he gave a reason for the violence. In public statements Monday, investigators said the victims were chosen at random.

:eek: I'm really confused...one article says that there was a mistrial and then another article says that he was sentenced. :eek:

I had to reread it to understand, too. He was convicted for both murders. He had plead guilty to both. The new trial is to overturn the verdict on the Plessel murder. Krueth's attorney is now claiming he is innocent of that crime.
For some reason, there is now a mistrial and Allen's defenders have been removed from the case. Rather interesting ...
 
It is interesting! Don't people usually just go right on to sentencing if they plead guilty? The only reason for a trial is if a person pleads not guilty...then the jury has to decide if they are guilty or not.
