13-year-old gets 2-year term in sexual assaults

A 13-year-old boy who committed two gunpoint sexual assaults on a city bike path near Allied Drive was sent to a state juvenile correctional center Friday for the maximum time allowed by law.

Because of the boy's age, that's two years.

"I was surprised to discover that it would appear that the Legislature may not have contemplated that a 13-year-old could commit crimes of this magnitude," said Dane County Circuit Judge John Albert, who presided at a hearing for the boy Friday.

Albert found the boy delinquent Friday after he pleaded no contest to the juvenile equivalents of six counts of first-degree sexual assault, two counts of armed robbery and two counts of robbery by force. The boy admitted his role in two assaults on the Southwest Bike Path in November and a unarmed robbery near West High School on Nov. 2.

He is a year shy of being eligible for the Serious Juvenile Offender Program, which could have kept him locked up for as long as five years, Assistant District Attorney Meryl Manhardt said.

She said, however, that before his release the state could seek to have him indefinitely committed to a mental health facility as a sexual predator, if he met certain criteria.
