I don't know how we missed this one. Such a sad story and once again an example of the horrific failure of our child welfare system. Looks like there's been lots of attention to the case, vows of reforming the system and a new "Xctasy Law".

July 27, 2006 Slipping through the cracks

The little girl screamed and screamed, like she was dying. Her cries penetrated the walls of Reggie Belton's room at the Twins Motor Inn.
Two weeks later, the couple in Room 16 -- Delia Hernandez, 26, and her boyfriend, Jose Munoz, also 26 -- were charged with the attempted sale, torture and attempted murder of Hernandez's 4-year-old daughter, Xctasy Garcia. Xctasy's eyes were burned with bleach, her arm and shoulder fractured and her delicate body marred by cigarette burns and covered with bruises. (much more at link - comprehensive article)

July 28, 2006 Xctasy's agony

All of us should demand vigorous enforcement of a federal law that establishes a national registry so authorities in, say, Schenectady County, can know right away if people suspected of child abuse have engaged in it before. Coincidentally, President Bush signed such a bill into law on Thursday. What's required now is separate approval of the funding, about $1.2 billion, so the law is more than just words. That's a lot of money, but the price of not spending it is to turn a deaf ear to the harrowing screams of Xctasy and thousands of children like her.

Even more essential is a strengthening of a state law making it mandatory for all social service workers, like those in, again, Schenectady, who did nothing about reports of the abuse of Xctasy, to take all complaints of child abuse to a special hot line. Laws that are supervised at the state level but administered at the local level are troublesome. But reporting these allegations should be mandatory for everyone in government, and it should be a felony, not just a misdemeanor, when someone required to report evidence of child abuse fails to do so.

Something is inexcusably wrong when a county social worker doesn't do much more, as in this instance, than urge a motel manager to tell a witness to such child abuse to call the state hot line and the local police.

August 23, 2006 Custody weighed in Xctasy abuse case

A Family Court judge said he is considering giving custody of one of Xctasy Garcia's brothers to the boy's father.

Numerous family members, all from Massachusetts, are seeking custody of the 4-year-old victim of what has been called the county's worst child abuse case, and her brothers, Hennessy Velazquez, 8, and Damien Munoz, 7.

That makes me sick to my stomach! That is just horrible and may they rot in hell.

Michelle, I feel the same way. I mean, I really really really would LOVE to physically hurt these people and make them suffer badly. I would love to torment them.

I know that's bad, but I honestly feel that way. Some people would think that it makes me just as bad as them, but I don't think so. I would torment them and I wouldn't feel bad. And I don't care. They need to PAY. How dare they do those disgusting things to such an innocent little girl.

Edited to add: My post seems harsh, I just re-read what I wrote. Geez, julianne!!! But as*holes like this, I just have no sympathy for and nothing but ice cold hatred flowing through my veins. They may not get theirs in this lifetime, but they surely will when their life is done. I definately believe that.

I am right with you on this, I would love to get ahold of them! What we can do to them is not nearly as bad as what happened to that poor little girl.:furious:
 
I don't want to click the link.....did the little girl survive? If so, will she be okay?

Monsters like those, masquerading as part of the human race, deserve whatever they get in prison. I just wish they could be placed in the hands of people who believe in "an eye for an eye".

First of all, who names their child Xctasy??? :waitasec: :slap:
What a terrible name.
Second, how would thye like to get burned with cigarettes and their eyes washed out with bleach? :mad:
The punishment should fit the crime!
Yet, they have the nerve to deny abusing the kids??
What do they call it then, normal treatment??

Any parent naming their child Xcstacy raises big red flags for me....I know this is America and Freedom of blah blah blah but someone should have figured this one out. This poor girl's parents were not right in the head but sick and twisted.

PrayersforMaura....I can't read this......I already know that from scrolling up. So, I have to ask, like the person before me...Is the little girl ok? or did she die?.......
Family did this......parents.......? Whatever do we do with people who are so cruel.? There is nothing equal to hurting a child so badly........
It really would make me too sick to read it...... I hope she is OK...

and in the article, when it was reported that the mother tried to sell Xctasy, I wondered if they meant the drug or the poor little girl :(

It's a sad, sad world ....

She is ok... she's not blind, thank goodness. She was temporary blind from the bleached rag held to her face and rubbed in her eyes. Her eyes were swollen shut for a time.
Her bones are healing.
Custody of the children is now the biggest subject. All three have different fathers, and none of the parents seem fit to take the kids. A custodial rights lawyer thinks the three kids should stay together, wherever they go, because they need each other.
The other two are boys and they were abused also but not to this degree :(

Are we kidding.....a visit with the mother. 30 HOURS......the little girl was probably shaking to death. Why would the state say yes to that?
I can't look at the pictures PFM......I will take your word for them.
I would literally get sick to my stomach. Who ever let the visit happen needs a brain transplant. There can be nothing good in that......
 
Did you read the mother's comments about how she wasn't able to stop him from hurting the little girl, then complaining that social services did not step in when people called to report the abuse? What a sad excuse for a human being! All she had to do was cross the street to a church and ask for help-why didn't she do that the FIRST time that creep hurt her child?

I hope she never sees those children again.

My God, I do not know what even to say to that....were they were refering to the child or the drug? I'm sorry, PFM, I could not read the links. This story is so disturbing I want to rewrite the Bill of Rights....

She was trying to sell her daughter on the streets.
And the boyfriend triied to drown the little angel in the tub.

They are terrible, terrible people.

It justs make you scream. Is there anything we can do on a local level? To help prevent instead of waiting for this to happen. I know the FBI is hot on the trail of internet *advertiser censored* people in Atlanta but we have had our share of perverts that abuse children. There has to be a way of informing people.
 
I feel sorry for the people who called about her and thought their calls might have been directed to the right people-something is just so wrong with that picture.

The motel guest/resident neighbor who reported it to the manager probably thought he was doing the right thing. The manager of the place definitely called the right places and who the heck dropped the ball on that there-procedure really sucks if he was told to call her specific caseworker or they weren't alarmed that he called to talk about the "hernandaz family" after the first report of alleged abuse-you'd think the second call/voice mail would've raised some flag and at least sent out a surveillance caseworker or something.

I had neighbors when I was in college who my roommate and I were sure at least the dad was abusing the kids-and probably abusing the mom. Sweet little twin boys-kind of looked like Opie/Ron Howard from The Andy Griffith show. We called the police every single time there was anything above a peep for fear of those boys lives. The police showed up multiple times and took a lot of statements from us. We tried to talk to the mom in the hall once but she hurriedly excused herself and we figured out why when a couple of minutes later the guy walked up the stairs.

Finally when their boys ran away at the age of 5 (yes, FIVE) and were gone for almost 24 hours, located asleep under a picnic table on a neighbor's back porch several houses away the police tracked down some grandparents who stepped in pronto-they had lived out of state and were unaware of the problem. Grandma dropped by our place on the way out with her police escort and thanked us sweet college girls for "saving her grandbabies" as she put it.

The sad thing is it takes so many calls to get anything done for abused children or abused adults-and my word against yours isn't good enough in the eyes of the law, nor are just suspicious bruises. Statements from us about the dad calling those boys m-effing "losers" and "useless pieces of" excrement right in front of us helped a little bit and our statements that though we had not seen the abuse we definitely did hear the sounds of somebody being struck by another person and then some kid or the mom would say something like please don't hit me at least kept this family in the CPS radar.

I hope something good comes of this and am really thankful Xstacy is not another little statistic with a grave marker-broken bones and a broken spirit are bad enough :(
 
IN one of the articles it states that the mother prefers all the kids go to her sister because she is closest to her. Obviously the mother can't make good choices, I don't think she should have any say who those kids go to. So far, out of all the children's realtives the only decent candidate looks to be one of the boys' father. I really hope this mother never gets her kids back.

A lot of abused women usually try and take the abuse intended for their children...not this woman. If she gets them back...and hooks up with another loser...she'll let him hurt the kids again!!! I know it!

I think it's the luck of the draw when someone call CPS to report a problem. When I was a new tenant in an apartment building when my girls were young, my youngest daughter flew into a rage because I wouldn't tie her shoes the exact way she wanted (strong willed to this day). I tried over and over and it just wasn't good enough for her, so I sent her to her room to pick out another pair. That didn't go over so well and she screamed and hollered and was yelling and kicking the walll. One of the other tenant called the police and they showed up at my door. I escorted that officer right to her room and the look on her face was priceless. My point is, this was within minutes of her fit. Maybe people should be calling the police instead of CPS to report a problem immediately and then make a report to CPS?????
