GUILTY OH - Jessie Davis, 26, pregnant, murdered, Lake Township, 15 June 2007

One thing his mom said in the video linked above got me a little upset.

In response to the reporter asking "What about those people who just do not like Bobby Cutts?", she responds:

"They don't know Bobby. If they knew Bobby, they wouldn't say that. It's a terrible thing that happened, but it had to be something to make this happen."

WTHeck does that mean?

Jurors: Could have ended in hung jury

Shelia Douglas says, "We felt the state didn't present enough evidence to convict him of killing her on purpose. We didn't know if it was an accident, if he intended to do it when he got there. We don't know. We'll never know."

Shelia says jurors didn't feel they had a lot to go on until Cutts took the stand, saying, "Up until that point we only knew that he showed (law enforcement) where the body was. That's pretty much the only face we had. We didn't know who killed her. Nothing had been proved to us for sure." (more plus 3 juror pics at link)

Cutts Enters Prison System

Warden Bennie Kelly tells Fox 8 News that Cutts was immediately placed in protective control because he is a former police officer and his case is high profile.

Protective control keeps an inmate out of the general prison population.

"That individual is locked up into segregation 23 hours out of the day. He has the opportunity to come out for recreation one hour, five days a week." Kelly said, "Outside of that he's locked in a cell with limited contact with staff and no contact with inmates."

Jury Explains Sentence
Cutts hurt his case when he took the witness stand because most jurors didn't find him believable, Gillespie said. Most damaging was how Cutts' sobs abruptly stopped when the prosecution began its cross examination.

"It shocked me," Gillespie said. "Suddenly Mr. Cutts was no longer crying and it was a complete switch in demeanor."

Jury heard only part of Myisha's story

Ferrell was afraid her testimony would result in a death sentence for Cutts, Alexander said. She also didn't want to relive the traumatic events she witnessed.

and

Cutts was nervous as he drove, Ferrell said. He rubbed his face and bit the inside of his mouth. Something happened to his baby's mom, he said. She was in the back of the truck. He had used his arm.

From the way Cutts brought his arm to his neck, Ferrell said she understood that he choked Davis, according to the transcript. Her testimony in court was more vague. (more at link)

IMO, she should have had to tell ALL in order to get her plea agreement. What is wrong with this system?

A wonderful poster at cantonrep contributed this information about tracking BC through the system.

In fact, just read the entire thread of comments. GREAT info provided there:

Cutts Jury Foreman Speaks OutThe foreman of the Bobby Cutts Junior jury says chief criminal prosecutor Dennis Barr was able to affect Cutts when he testified.
He says he was first shocked when Barr asked Cutts if he had a cold, when it appeared the former Canton cop was crying. He says the Cutts' testimony did more harm than good.
The jury foreman says he doesn't think the outcome of the case would have been any different had jurors been able to consider the lesser charge of manslaughter.
He appeared on News/Talk 1480 WHBC's Ron Ponder program.

Thank you for the links Taximom. Today's Plain Dealer also covered Myisha's transcript. I will always wonder about "I'll leave".

Yeah, that's interesting to me too, bb. :waitasec:

Did you learn anything new reading her transcript?

O/T alert!
I saw your pics in the picture thread finally! Whoa, I will make sure I don't get on your bad side. (Not that you have one!) Your son is adorable. It looks like he owns that park!

Yeah I heard that too and I was like WHAT? Is she serious? No wonder Bobby was the way he was.... (i'm just sayin!)

I didn't like people badmouthing the jury initially but after hearing some of their comments, I wish they would STFU.

What's that saying? Better to keep quiet and have people think you a fool, than to open your mouth and remove all doubt.

Thank God our Charlie Brown is no blockhead.

I think she was trying to say it wasn't "planned" That's what I got out of it.

He may be appealing to Bubba in prison!

What a loser. He's lucky he didn't get the death penalty.

Who pays for the appeal?

Thanks for the info, Joe Jones.
