I didn't see anything in the article that said why they decided to search this area. Did I miss it?

Not only that, but the ATF are the ones who filed for the search warrant? Kyle's dad won't say why and a Federal judge sealed the documents.

Eyewitness News source revealed they arrived after a judge approved a search warrant filed by the ATF to allow agents to take cadaver dogs to the area.

    And

The missing man's father, Dick Fleischmann, has said he believes his son was a crime victim and he and his wife need information to get closure. Eyewitness News contacted him for comment on the search, and he said although he’s glad investigators are on the case, he can’t comment because the federal government is now handling the investigation. He would not say why the federal government is now involved.

Up until now, the case had been a Charlotte-Mecklenburg Police Department missing person’s case. A federal judge has sealed documents that could explain why federal agents took over the case.

Does anyone here that's familiar with the legal system know the reason why federal investigators might take over a case? Maybe if we have a list of reasons we might be able to figure out why.

I'm not sure that this will help, but it's a page listing the types of crime that federal investigators take.

    Thanks Lizzybeth!

I went through the list and the one that fits with ATF is violent gangs. A good year or so ago a (Senator) from Minnesota threw a fit about local LE not taking seriously all the young men Kyle's age disappearing and the FBI did promise to take a closer look. That was the Smiley face killer case. Once the Feds said they'd take a look, all went quiet. The MS-13 gang was one of the gangs theorized that were behind this as an initiation type thing. Violent gangs deal with gun trafficking, so that would involve the ATF.

Another curious thing to note is since the Smiley Face Killer story broke and went public, these types of deaths and disappearances slowed down to a trickle. We'll see how it goes when the weather warms up in the next few months. Although many of the previous cases happened in the dead of winter when people avoid the water.

    From the FBI website:

    http://www.fbi.gov/hq/cid/ngic/violent_gangs.htm

About 20,000 violent street gangs, motorcycle gangs, and prison gangs with approximately 1 million members are criminally active in the U.S. today. Many are sophisticated and well organized; all use violence to control neighborhoods and boost their illegal money-making activities, which include drug trafficking, robbery, theft, fraud, extortion, prostitution rings, and gun trafficking. Here, you'll find more on the threats posed by gangs, on how you can help spot and prevent gang activity, and on how we're redoubling our efforts to disrupt and dismantle them through intelligence-driven investigations and new initiatives and partnerships.

"In Charlotte, North Carolina, membership is estimated to be 200+. Police have implicated MS-13 in at least 11 murders in the Charlotte area in 2000 alone. In northern Virginia and southern Maryland, around the Washington DC area, local authorities estimate MS-13 membership to be between 5,000 and 6,000 members - by far the largest gang in the area. "

"A federal grand jury in Charlotte, N.C., charged 26 members of the violent gang known as MS-13 with federal racketeering and related crimes "

Scary statistics you dug up there. Five to Six thousand members in one region?!!! I hope the fact the Feds are involved means some answers will be coming soon.

Search based on tip. Local LE at search only as a guest.

    http://www.msnbc.msn.com/id/29550491/

    (snip)
Tight-lipped investigators with the ATF and U.S. Attorney's Office would not comment on the search. NewsChannel 36 learned investigators came to the site based on a tip and a federally sealed search warrant.
Charlotte-Mecklenburg Police Department's lead detective in the Fleischmann case told NewsChannel 36 he was just there as a guest.

OKay I heard today that A possible person turned states evidence in a drug case. I guess that is why ATF would be involved? Do anyone know how true this may be?

It could be. Especially if it's a multi agency task force type of investigation. The ATF is usually only involved in Alcohol, Tobacco, Firearms and Explosive related crimes.
