Uncle of killed girl was convicted in '93

While Michael Jacques continues to be the focal point of the investigation into the death of his niece Brooke Bennett, Vermont corrections officials are re-examining the decision to release Jacques from probation earlier than his 1993 conviction for kidnapping and raping a young female allowed.

In an interview yesterday, Vermont Commissioner of the Department of Corrections Rob Hofmann said that while the judge who approved Jacques's early release indicated in her ruling that a probation officer supported the decision, internal documents show the department was opposed to letting Jacques off probation. Hofmann said the department is investigating the discrepancy.

"We're still trying to understand that," said Hofmann, who became commissioner in 2005. "We have indications in the case file that the department would not support the release, because of the violent nature of the offense.

"It is clear to me the department didn't support (Jacques's release)," Hofmann said.

But Judge Amy Davenport apparently thought differently.

Prosecutors argued against the decision, but Jacques was released from probation in December 2006.

He Told Judge ‘Anger Issues' Were Linked to Sex Assaults

Chelsea -- Michael Jacques, the Randolph man charged with kidnapping his 12-year-old niece Brooke Bennett before her death, said during a 2004 court hearing that abuse he suffered as a boy led him to sexually assault girls and young women.

“It had been an issue in my life for quite a long time, since I was probably about seven years old, actually,” Jacques, who is now 42, said during an October 2004 hearing in which he requested to be released from probation, according to a transcript obtained by the Valley News yesterday. “I was abused when I was seven until I was ten years old and that's when I, that's when I really started having issues.”

“When I make comments about successes in sex offender treatment, I have three names of which Michael Jacques is one,” Kearney said.

“At this point in time, Mr. Jacques has met all the requirements that the Court has imposed upon him,” Kearney said. “He's done that -- just hasn't met them, he’s far exceeded them.

Republican Gov. Jim Douglas called the recommendation a mistake.

Denise Jacques said she was aware of her husband's rape conviction, but when prosecutor Bob DiBartolo pressed her, she said she was unfamiliar with many of the violent details of the rape.

That offense would be at least the third separate sex offense that Jacques had been charged with, not including the Bennett allegations[b/], according to court documents.

Brother's Support

Jacques' younger brother, who had launched a successful career as an attorney in Kansas, was impressed. In a letter to the court supporting Jacques' release from probation, Brian Jacques said his brother had attained an “internal sense of peace.”

MONTPELIER, Vt.—When Michael Jacques came up for early release from probation, a prosecutor didn't think it was a good idea, telling a judge that as a twice-convicted sex offender, Jacques shouldn't go without supervision.


In the 2004 court proceeding, Deputy Orange County State's Attorney Robert DiBartolo told Judge Amy Davenport that Jacques' actions in a 1992 kidnapping and aggravated sexual assault were too brutal to allow him unbridled freedom.

For Immediate Release: June 29, 2008

On the afternoon of Sunday, June 29th, 2008, the Vermont State Police arrested Michael Jacques, age 42, of Randolph, Vermont for Aggravated Sexual Assault against a minor. This arrest is a result of the on-going investigation into the disappearance of Brooke Bennett.

Brooke Bennett is still considered missing at this time.

The arrest of Jacques for Aggravated Sexual Assault is not a result of Jacques sexually assaulting Brooke Bennett. Jacques was placed under arrest for sexual assault he committed against another minor in the Randolph area. The details that lead to Jacques’ arrest were uncovered by investigators assigned to investigate the disappearance of Brooke Bennett.

In order to stay focused on locating Brooke Bennett, personnel from the Chittenden Unit for Special Investigations (CUSI) have been called to further investigate the sexual assault for which Jacques was arrested.

Jacques was lodged at the Southern State Correctional Facility in Springfield, Vermont. Jacques is scheduled to appear in Orange County District Court in Chelsea, Vermont on Monday, June 30th, 2008 at 1:00 pm to answer to the charges of Aggravated Sexual Assault on a minor, a violation of Title 13 V.S.A. 3253.

The crime of Aggravated Sexual Assault carries a sentence of ten years-to-life in prison and a fine of $50,000

Convicted rapist assaulted first victim 31 years ago

Court documents from 1985 reveal that Jacques was 11 years old when he sexually assaulted his first victim.

Death penalty experts join Jacques' defense

MONTPELIER, Vt. (AP) - Two New Jersey lawyers have joined the defense team of Michael Jacques in anticipation that federal prosecutors will seek the death penalty against the convicted sex offender accused of kidnapping 12-year-old Brooke Bennett.

At the request of public defender Michael Desautels, U.S. District Judge William Sessions III on Monday appointed David Ruhnke and Jean deSales Barrett to help Desautels.
