    Charges against a Vermont man accused in the kidnapping and death of his niece move forward.

    In early July, Michael Jacques's niece -- 12-year-old Brooke Bennett's body was found suffocated, strangled and sexually assaulted in a shallow grave near his home. Today Jacques chose not to appear in federal court but his lawyers entered not guilty pleas for him.

    Some Brooke Bennett's family and friends held signs in front of the courthouse reading "Brooke's justice begins today."

    The idea was Bennett's step-mother's. Janet Bennett said, "we showed up for Brooke to see that justice starts for her today."

    SAN ANTONIO — The former stepfather of a slain 12-year-old Vermont girl has been sentenced to more than 16 years in prison on child pornography charges.

    U.S. District Judge Xavier Rodriguez sentenced Raymond Gagnon (GAN'-yuhn) in San Antonio on Friday to 16 years and eight months in federal prison. Gagnon expressed grief and remorse in accepting the sentence.

    Attorneys for Michael Jacques of Randolph have signaled they want to move his case out of federal court, where a potential death penalty awaits him if he's found guilty of drugging, raping and killing his 12-year-old niece, Brooke Bennett of Braintree, last year.

    According to papers filed Tuesday at U.S. District Court in Burlington, Jacques' attorneys said they plan to file a motion asking Chief Judge William Sessions III to dismiss the indictment against Jacques on grounds that the federal court does not have jurisdiction in the case.

    The defense strategy was referenced in a request to Sessions to extend the deadline for filing pretrial motions in the case another two weeks, to Jan. 8 instead of Dec. 25. Federal prosecutors do not oppose the deadline extension, according to court papers, and Sessions is likely to approve the delay.

    But when I clicked on it, the article is archived. So basically we have to go by the headline, the def TRIED to withdraw his plea deal, but the judge said, "No!"

    On February 22, 2009, NewsChannel 5 posted a headline on its website, wptz.com, that read, “Uncle Convicted of Raping, Killing Girl.” The “uncle” the article referred to was none other than Michael Jacques, Vermont’s most notorious defendant, who stands accused of brutally raping and murdering his 12-year-old niece, Brooke Bennett, in the summer of 2008.

    There was just one problem: Michael Jacques hadn’t yet been tried for murder, much less convicted of it.

    The lawyers defending Jacques are using that goofed headline to support the argument that their client cannot get a fair trial in Vermont, saying he has already been convicted in the media, in the state legislature and in the court of public opinion. Because he’s up on federal charges, Jacques’ lawyers have asked the court to move his trial to Connecticut or New York — Albany and Brooklyn have been named as possible venues — claiming that two years of nonstop news coverage has tainted the pool of potential jurors in Vermont.

    Keeping the trial in state could increase the likelihood that the verdict — which could come with a death sentence
