FL - DNA clears him, but Wilton Dedge is still imprisoned

Wilton Dedge, a man who has spent 22 years in prison for a rape that DNA testing proves he didn't commit. On April 27, Dedge took a big step toward becoming a free man. --->>

The Fifth Circuit Court of Appeals in Daytona Beach ruled in Dedge's favor, saying the DNA test that proves his innocence is admissible in court. --->>

He is represented by the Innocence Project, co-founded by Barry Scheck. Innocence Project attorney Nina Morrison is requesting a hearing in the 18th Circuit Court in Brevard County. Armed with the DNA test results, Morrison says she plans to ask for a new trial. "We are cautiously optimistic about the outcome for Wilton Dedge."

One possible outcome: Dedge's conviction could be overturned and the judge could order that he be released. The state could also challenge the validity of his DNA tests, though that has never happened before in Florida.

Judge orders retest of rape-case evidence

VIERA -- Convicted rapist Wilton Dedge's future hinges on a 22-year-old fracture of a sperm cell preserved on a slide.

In a decision that further delays Dedge's motion for a retrial or release -- based on favorable DNA evidence, Judge Preston Silvernail ordered a new, sophisticated test be done on a tiny sliver of evidence. Standard DNA testing of the 1980s yielded no conclusive results.

Dedge has served 22 years in prison for the 1981 rape of a Canaveral Groves teenager. Tried twice, he has continuously maintained his innocence. DNA testing done on pubic hair found in the rape victim's bed prove it does not belong to Dedge, as prosecutors contended during Dedge's two trials.

Earlier this week, defense witness Sudhir Sinha, president and lab director of Reliagene Technologies, stunned a crowded and hushed courtroom by announcing that new Y-chromosome testing has become available and could be used on the fracture of a semen cell taken from an anal swab of the victim.

Assistant State Attorney Wayne Holmes called Sinha's disclosure a "Perry Mason moment."

The DA was wrong. It wasn't "too late" and Wilton Dedge was freed from prison after serving 22 years for a rape he didn't commit. The state of Florida offers him little more than a wish of good luck.

PORT ST. JOHN -- When Wilton Dedge was freed after 22 years in prison for a crime he didn't commit, the state of Florida simply opened the door and sent him home.

He didn't get the $100 a day for every day served, which California gives those it wrongly convicts. He didn't get the free college tuition Montana provides exonerated inmates.

He wasn't even handed the $100 bill that Florida gives its most vicious ex-cons when he walked out of the Brevard County Jail on Aug. 12 with all his possessions in a plastic bag.

He didn't receive the counseling or job referrals or temporary housing the state offers paroled murderers, rapists and thieves.

Dedge didn't even get a bus ticket home.

There was no compensation for the 22 years of unfairness that started when a 17-year-old rape victim mistakenly said, "That's him."

Dedge, 42, was cleared of the 1981 rape last month when DNA testing on a semen sample, previously thought to be too degraded for testing, proved the state had punished the wrong man.

But because he was released from a county jail, where he was awaiting the outcome of the test, and not a state prison, Dedge was not entitled to the benefits bestowed on parolees, said Debbie Buchanan, a spokeswoman for the Department of Corrections.

And because Florida has no wrongful-conviction compensation law, Dedge will have to sue the state or persuade a state legislator to sponsor a private-claims bill if he hopes to gain any monetary satisfaction.--->>
