Hi everyone. I have been reading here for weeks and just now finally got registered. Like you all, I am fascinated by this case and my heart breaks for poor Caylee.
I have a question regarding evidence and discovery. Sorry if this is a stupid newbie question!
If all evidence/interviews etc have to be released to JB, and everything that gets released to him is made public, then why/how are other things not released? Certain interviews, the JCP purchase, etc. Is there really more evidence to be seen at trial?

I really think they have much more. They know the media has grabbed this like a dog with a bone. Juries work off evidence & common sense. I think the evidence is there & it defies logic to wait 31 days & be out dancing. I can not see any reason they will buy for her behavior. I could change my mind after hearing all the evidence, but right now, yeah, I think there is more.

I feel strongly that there is more information we are not privy to. The state (if it is this the same in FL?) only has to give JB 72 hours to review evidence. They may be holding on to it until the 11th hour. There are too many holes, too many missing interviews, and YES, the JCP receipts...I think there is a good bit more evidence we haven't seen yet.

I take the opposite stance. I do not believe they have MORE. I think we have heard about most of the evidence. What we don't have or haven't seen is the EXPERTS. There will be expert reports on what this evidence means. I think some things like the stain in the trunk will end up being nothing (altho I hope not). But I think the case will be put together better by expert reports or at least expert testimony.

Well, we know there are interviews (AD, MH) that haven't been released...and the JCP receipts. Do you think they won't have any bearing on the state's case? I assumed the interviews (especially AD's) must have been damning since they haven't been released yet, and that maybe there was something incriminating bought at JCP (duffel bag, suitcase??)...what do you think? :waitasec:
 
I also believe there is a LOT of evidence we haven't heard yet....

I'm SURE they must have interviewed all kinds of people that we haven't even heard of.... neighbors, teachers, employers, co-workers, people from Fusian who were NOT necessarily in her group.... the list goes on & on.

Plus.... we do NOT know what the FBI has heard in THEIR interviews.

This is where I am at as well. I don't think there is a huge smoking gun, unless it is Annie's statements. Nothing will be released to the public that would put a witness under undo pressure, so even without a gag order we won't see that until trial.

But if there were a ton of other forensics, ie maggots, I think we would have seen or heard more about them, and we would see Baez securing a specialist in that area. I don't think the stain will be anything other than chemical at this point since they are using the DNA from a single piece of hair to hang identity and death on.

The chloroform is the piece of evidence I think we would have seen withheld if they were holding back some shocker for the courtroom since it may go to premeditation.

I think this will be a trial very heavy with forensic arguements on both sides, cast against Casey's unexplainable behaviour, and a lack of nanny or live child. Even if the jury gets confused about a specific forensic element, I think they will convict based on the totality of the forensics + Casey's behavior.

I also believe there is still more evidence that will come out at trial or perhaps before hand (not very familiar with the legal/court system here in FL or anywhere for that matter). I am very interested to see what else they have. I also believe LE has enough evidence to prosecute w/o the body.
 
With Florida's sunshine law are we going to see all the evidence/discovery before trial?

My understanding is prosecution has 10 days from the filing of charges to turn over all discovery, and then anything new that arises they have to provide that in a timely manner as well.

The JCP purchase I have never really understood its significance, if she bought a suitcase and Caylee is found in it then I would get it, but with no discovery made I don't understand the value of a receipt for a bag in and of itself? And that is assuming that is what the purchase was for.

I just talked to a friend who knows about such things...I THINK the 72 hours is for new evidence once he trial starts...? I'm going to do more research about this...now, I'm confused. :crazy:

She would only be bones...yuck makes my skin crawl. Since she was so little it wouldn't have taken her long. Plus you have the alligator and hog factor.
 
Yes, this is what I meant. No big smoking gun. There may be a few interviews but they will be released before trial because JB has to get them. I do not believe KC told anyone what she did however and I don't think there is a huge smoking gun in these interviews either. I don't know if this Annie might say something in court about drugs she has given KC. That could be something. But there is no proof or evidence that we know of that KC ever gave Caylee drugs unless one of these friends saw her do it. That could be big news I suppose. The maggots will probably tell something too.

Receipts? Oh, the one from the checks? Or did I miss something?

When the prosecution files reports with the county Clerk of Courts, it then becomes public record and anyone may access it. I believe that they do not have to file everything with the clerk until it becomes necessary.
This is why doc are missing and not public info and why JB has to request discovery docs that are not part of public record. Someone correct me if I'm wrong (I heard all this on NG) but the prosecution does not have to file every bit of evidence with the Clerk of Courts until absolutely necessary. That's what NG and her attorney-guests said, anyway.

I bet there is lots more, just based on some missing things/info I myself noticed with some doc dumps. But golly, guess we won't really know until the trial.
