Anthony Grigoroff could be headed for a retrial for the alleged 2008 killing of a 49-year-old Garrison father of three after an appeals court took issue with the evidence presented at his trial nearly five years ago.

The state Supreme Court's appellate division, second department, ordered on Wednesday that Grigoroff be retried. He was 19 when he was sentenced to 25 years to life after being convicted of killing John Marcinak during a botched break-in on New Year's Eve.
