By Tuesday January 5th, Baez will be getting more information from the state. A spokeswoman for the state attorney's office says they will meet a judge's deadline to turn over photographs and X-rays of Caylee's remains.

So even if, despite their legal missteps in the Zenaida Gonzalez lawsuit, Casey wins the right to take the fifth and not answer questions, she loses.

"Who among us, the minute you hear someone has asserted a Fifth Amendment privilege, doesn't think they have something to hide," Sheaffer said.

....During Tuesday morning's brief meeting, the judge refused to hear the request and scolded Jose Baez's team for personal attacks against Morgan and Morgan, the law firm representing Gonzalez, and said Baez was taking the profession to a new low.

"It doesn't add up," Gonzalez's attorney, Keith Mitnik, said. "We want to get to the bottom of it. That's why we need to put (Casey Anthony) under oath -- with a court reporter (present) -- and have our opportunity to get to the bottom of the truth, so we can ultimately clear Zenaida Gonzalez's name after all."

"Miss Anthony does have her Fifth Amendment right to remain silent, even though it is a civil matter. If it can incriminate her in a criminal procedure, we feel that she should not have to testify under oath," said attorney Jose Garcia, who represents Casey Anthony.

Casey Anthony connects to outside world the old-fashioned way

The Web and TV is a buzz with the latest news about Casey Anthony.
But the most high-profile inmate at the Orange County Jail gets most of her news the old-fashioned way -- on a small transistor radio from inside her 7-by-12 foot cell in the county's female detention center.

For the time being, Anthony's limited connection to the outside is mainly dependent on her radio and the snippets she overhears from other inmates.
"She may not be in contact with other inmates, but she can hear what they are saying outside her cell," Moore said.

Which brings up another argument that Judge Rodriguez will have to settle. &#8220;She filed a counter claim back against our client against Ms. Gonzalez. She can't under oath do that and use the 5th amendment. It&#8217;s called sword and shield. You cannot use shield of the 5th amendment and use the sword in civil litigation when you're bringing an action yourself,&#8221; said Mitnik.

Judge Rodriguez will hear from Zenaida Fernandez Gonzalez's attorney and Casey Anthony's in his courtroom at 11:00 a.m. Thursday.

As things stand now Casey Anthony is scheduled for depositions with Gonzalez's attorney Monday at 10 a.m.

ORLANDO, Fla. -- Prosecutors are withholding three discs showing Caylee Anthony&#8217;s remains from the defense team, WESH 2 News confirmed on Tuesday.


In this motion, the state argues that substantial licensing fees have been paid for pictures and video of Caylee taken while she was alive.

Baez's spokesman Todd Black said Baez is planning to file a response.

"We will deal with the issue in court," he said.

On Dec. 31, Drane Burdick spoke to Baez about the issue. He agreed he not share the images with any "unrelated parties" but wanted to send them to defense experts who are outside Orange and Osceola counties.
