Judge sets trial date for Casey Anthony

It's OK to let the public see images from Casey Anthony's online picture-sharing account, but they may have to wait to view the video of her reacting to news of a child's remains found less than a mile from her home, a judge ruled Monday.
Circuit Judge Stan Strickland also set a tentative date of Oct.12 for Anthony's first-degree murder trial, which could last more than a month.
Anthony's parents, George and Cindy Anthony, watched as lawyers argued about whether the latest photo and video evidence in the case should be released as public records. It was the first time the couple had seen their daughter in months.

Judge Won't Block Racy Casey Photos

ORLANDO, Fla. -- A circuit court judge dealt a serious blow to Casey Anthony's defense, late Monday night, ruling that photographs of Casey can be made public.
The judge gave her attorneys a chance to see the video, but Monday he denied the request to seal the compromising pictures, from her photobucket.com account.
Many of the racy photos have already been posted around the Internet, but the defense claims there are a lot more. The defense says there are worse photographs the public hasn't seen that were taken long before Caylee's murder.
Also, Casey has another new lawyer. Todd Macaluso, an attorney from San Diego who specializes in plane and car crashes, has joined her defense team.
"We are confident that we will prove she is innocent of the charges brought against her. She did not murder Caylee," said Macaluso.

During the 7:30am segment They did a live interview with Judge Napolitano, the Fox legal commentator, to address the issue of the effects of the release of the photos per yesterday's motions ruling. To paraphrase the Judge,

He feels the major result of this new and cumulatively damning evidence is that it almost guarantees that the trial will have to be moved away from the Orlando area.

Caylee Anthony saga to feature in book

- Diane Fanning is writing her tenth true crime book on the Caylee Anthony saga, beginning with the report of the toddler reported missing in late June. The book will also cover the life of Caylee before she disappeared.
Fanning said she is scheduled to turn in a manuscript of the book on May 1.

Controversial Tape Of Anthony In Jail Released To Defense

ORLANDO, Fla. -- Now that an October trial date has been set in the case against Casey Anthony, prosecutors said they are not reconsidering the death penalty.
On Tuesday morning, the state attorney's spokesman Randy Means told WESH 2 News, "We are preparing for trial as charged."

Casey Anthony is facing the possibility of life in prison if convicted of first-degree murder in the death of her daughter, Caylee. Prosecutors said they expect the trial to last about four weeks.
Meanwhile, in accordance with a court ruling made Monday, Anthony's defense attorney received a copy of a controversial videotape Tuesday.
Judge Stan Strickland ruled that the prosecution must release the tape to defense attorney Jose Baez.
Baez has 15 days to decide if he wants to object to the release of the tape. If he chooses not to, the tape will be made public. Also a result of Monday's hearing, Strickland denied Baez's motion to prevent potentially embarrassing photos of his client from being released.


Brad Conway Files Motion To Block Release Of Information About George Anthony
The attorney for George and Cindy Anthony filed a motion Tuesday to block the release of information about George Anthony's attempted suicide.
In the motion, attorney Brad Conway said a copy of George Anthony's suicide note was handed over to police, who gave a copy to the State Attorney's Office.
Conway said the letter has no bearing on the criminal case against Casey Anthony and should not be released.

ORLANDO, Fla. -- Casey Anthony has refused to answer a questionnaire related to a defamation lawsuit filed by Zenaida Gonzalez, choosing to invoke her Fifth Amendment right.
The judge in the civil lawsuit recently ruled that Anthony could answer the questions, but she refused at the advice of her civil attorney who said the questions could affect her criminal case, which is tentatively scheduled to being in mid-October.

Anthony's civil attorney, Jonathan Kasen, said he expects Gonzalez's attorneys to request a hearing about his client's refusal to answer the questions. It's likley the judge will grant a hearing and determine which questions, if any, Anthony has to answer, Local 6 News reported.

New Lawyer Joins Casey Anthony Defense Team

ORANGE COUNTY, Fla. -- Eyewitness News has learned the name of the newest member of Casey Anthony defense team.
Todd Macaluso has been a trial lawyer for more than 20 years. His practice is based in San Diego, California.
Macaluso says he joined Casey's team, because he believes she's innocent and wants to prove that in a court of law.
"I believe that Casey Anthony is innocent. I'm going to fight alongside Jose Baez and Linda Kenney Baden, as hard as I can to prove that in a court of law," Macaluso said through a statement released Tuesday.

Is George Anthony's suicide note a public record?
Bob Kealing of WESH-Channel 2 laid out the legal fight Tuesday night. The state says yes and that the Anthonys will have to explain to a judge why the note shouldn't be released.
The attorney for George Anthony says no and that the note has nothing to do with the Casey Anthony murder case. Casey, George's daughter, is charged with the first-degree murder of her daughter, Caylee.
"There is nothing in the note that would indicate that Casey has done anything wrong," Brad Conway, George's attorney, told WESH. "This is all personal information that was directed at Caylee, Lee, Cindy and Casey."

In other developments:
*WKMG-Channel 6 got the list of questions that Zenaida Gonzalez's lawyers had for Casey Anthony in a defamation suit against the mother of Caylee. There were about 30 questions in all, but Anthony invoked her Fifth Amendment right and didn't answer any except her name, Louis Bolden explained. Her attorney in the civil suit said he wouldn't allow her to answer because the answers might affect her criminal case, Bolden added.
The last questions were: Do you know who killed Caylee? Were you involved in the death of Caylee?


*WESH reported that bounty hunter Leonard Padilla will testify in the defamation suit on March 24.

*WOFL-Channel 35 talked to the author of "Mommy's Little Girl," a book about slain toddler Caylee. What about criticism that writer Diane Fanning is trying to profit off the case? Fanning said she was doing her job as a journalist and trying to share lessons that could help save other children. The book should be out this fall.

State could still seek death penalty against Casey

- According to a spokesperson with the State Attorneys Office the state could still decide to seek the death penalty before the murder trial of Casey Anthony begins in October.
On December fifth last year the state said in a press release that &#8220;it is not in the best interest of the people of the state of Florida" to pursue the death penalty against 22-year-old Casey Anthony.
Published reports this week said the State would not reconsider the death penalty and that Anthony would face life in prison.
But Tuesday night spokesperson Randy Means said that &#8220;They are preparing the case before them and nothing has changed.&#8221; And the penalty they are seeking has not changed but this is "not a predictor of the future"
