A source with Casey Anthony's defense team said it will be two weeks before a key deposition is completed in the case.

Jose Baez and two other defense attorneys spent more than three hours questioning Deputy Richard Cain.

Because of scheduling conflicts, the source said it will likely take until the end of the month before questioning of Cain is completed.

Cain was reassigned to the Orange County Sheriff's Office evidence section, and an internal investigation is being completed to determine why the remains weren't located earlier.

The attorney for Lee Anthony filed new documents on Monday, saying his client's opinion about specific questions in Casey Anthony's civil lawsuit were not relevant to a fact-finding deposition.

Thomas Luka said Lee Anthony should not have to answer two questions in the civil case regarding his client's sister, Casey Anthony, who is being sued for defamation by a woman named Zenaida Gonzalez.
Luka said his client should not have to answer questions pertaining to Lee Anthony's opinions on who Caylee's father is or whether he's had thoughts that his sister was responsible for Caylee's death.

Luka said that Gonzalez's attorney have shown no need for that information, except to embarass or annoy the Anthony family. Luka argued that the father's identity is irrelevant to the civil lawsuit.


Gonzalez's attorneys are seeking a judge's order to force Lee Anthony to answer the questions, saying it is necessary to help show that their client did not kidnap Caylee. It's unclear when the judge will decide whether Lee Anthony will be compelled to answer.

A hearing is scheduled for Wednesday as Gonzalez's attorneys attempt to re-schedule a deposition with Casey Anthony's parents, George and Cindy Anthony.

In a recent court motion filed by Anthony's lead attorney, Jose Beaz, he cites the name Lt. Tammy Uncer, who he claims discussed Anthony's medical details with prosecutors.
Local 6 News has confirmed that Uncer was the corrections employee who escorted Anthony from her cell and observed her reaction to the news, which she watched on TV in the common area. Anthony also asked for a sedative to calm her down, Local 6 News has learned.

Anthony's reaction was captured on jail surveillance cameras, and Baez is trying to keep thee recordings from becoming public through the discovery process.
He's also trying to keep a videotaped statement that Uncer gave to prosecutors from becoming public. Baez alleges that Uncer discusses his client's medical history, including what she observed that day.

Prominent local defense attorney Mark NeJame, who once represented Anthony's parents, said Uncer's statement to prosecutors could be a violation of Anthony's rights. NeJame also said Baez's argument could go either way, specifically in reference to what Uncer may have told prosecutors about Anthony's reaction to the breaking news.
"Can the state question a corrections officer about their observations? Yes. However, if the corrections officer was acting as an arm of law enforcement or the state attorney's office and it was done secretly, there's some real trouble with that," NeJame said.

The state maintains that there has never been any conspiracy or misconduct.
It's not known when a hearing will be held on the issue.

Casey Anthony's brother, Lee Anthony, doesn't want a judge to force him to answer two remaining questions in his sister’s civil case.
Last week, lawyers for Zenaida Gonzalez -- the Kissimmee woman suing Anthony for defamation -- asked Orange Circuit Court Judge Jose R. Rodriguez to make Lee Anthony address two questions he didn't answer during an interview under oath last month.

Lee Anthony's lawyer, Thomas Luka, wrote in his legal response today that the questions only serve to embarrass and annoy the Anthony family.
And, Gonzalez's legal team, Luka wrote, didn't cite any legal reason why identifying Caylee's father is relevant.

No hearing has been set yet.

Thomas Luka, attorney for Lee Anthony, objected to Zenaida Gonzalez's attorneys asking Lee Anthony if he knew the identity of Caylee Marie Anthony's father and if he thought his sister could be responsible for Caylee's disappearance. Luka advised Lee to not answer those questions, stating that they were not relevant to the civil lawsuit.

In a newly filed motion, Luka pointed out that his client spent more than three hours in Morgan and Morgan's law offices on February 26 and was cooperative in answering more that one hundred questions. Luka argued that neither of the questions which Morgan and Morgan are taking to a judge have anything to do with the civil defamation suit and are merely a publicity stunt.


Judge Jose Rodriguez will hear this argument on May 21.

The attorney for Cindy and George Anthony, parents of Casey, will also appear in court that same on behalf of his clients. Brad Conway is scheduled for a hearing before that Judge Roriguez on Wednesday. Gonzalez's lawyers were set to question Casey's parents the day before Lee back in February. Their depositions were put on hold because the two said they were not mentally or emotionally prepared to undergo questioning.

On Monday, Conway told FOX 35 that he will be talking to attorneys at Morgan and Morgan on Tuesday to see if they can agree on a level of professionalism and standard of conduct during the depositions. He said if they can work something out on their own, Wednesday's hearing might not be necessary.
