Inmate blames Casey Anthony's lawyer, Jose Baez, for conviction in child's death

TAVARES - A Lake County man, serving a 15-year prison sentence in the death of a toddler, wants his manslaughter and child-abuse convictions overturned, citing judicial and prosecutorial misconduct and the "defectiveness" of his defense lawyer, Jose Baez.

Baez is better known these days as Casey Anthony's lawyer. But last spring and summer he was busy defending Nilton Diaz.

Casey Anthony's defense team will have to wait two more days to interrogate several key players in the murder case.
Jose Baez was going to depose former Anthony family private investigator Jim Hoover and several Orange County Sheriff's Office investigators Tuesday, but those depositions have been delayed until Thursday.

Four jail officers will also be questioned. Two of those jailers witnessed Casey's reaction when she was told about the discovery of Caylee's remains.

The depositions -- questioning under oath -- are not open to the public.
So far, Thursday has three more Corrections officers on the list as well as private investigator Jim Hoover, who volunteered his services to the Anthony family.

Friday has Alex Roberts, who is the supervisor of Orange County meter reader Roy Kronk. Kronk discovered Caylee's remains on Dec. 11.
In the afternoon, Orange County Sheriff's Investigator Awilda McBryde is set to be questioned under oath. She is an investigator with the missing persons unit. McBryde spoke with Zenaida Gonzalez, a 38-year-old Kissimmee mother of six, about whether she knew Casey Anthony.

Jose Baez, Casey Anthony's attorney, filed a motion Tuesday asking Judge Stan Strickland for an exparte hearing.
All along, Baez has said he knows information that will help explain why Casey Anthony didn't report Caylee missing for a month -- and why Casey Anthony didn't kill her daughter.
Baez wants to explain why he is requesting to subpoena certain records that he believes may be critical to Casey Anthony's defense, but he wants to block those records from being made public because he doesn't want to divulge what Casey Anthony's defense will be. Baez said he doesn't want to release to anyone else his so-called theory of defense.

"He wants somebody's records and he does not want to say who. Apparently they won't give it to him if he's tried to through other channels," criminal defense attorney Richard Hornsby said. If prosecutors find out just what records Baez wants, Hornsby said the secrecy strategy could backfire.

He filed a request for an ex-parte hearing before Orange Circuit Court Judge Stan Strickland. That means he wants to meet with the judge without prosecutors or the public present so "sensitive matters which are critical to the defense can be addressed," according to the document filed late Monday.
Strickland or prosecutors have not responded to the request.

Jail Sergeant Questioned In Case Against Casey

Casey Anthony's defense team interrogated a witness late Tuesday afternoon. Jail Sergeant 58-year-old Dennis Moonsammy was questioned by her attorney, Jose Baez.
Moonsammy supervises Casey Anthony at the jail, and told Eyewitness News he did not see Casey's response the day Caylee's remains were found.

Jose Baez said he believes the depositions he has lined up this week are a serious part of this case.
"It's a life changing situation so I think every part of it is," said Baez.

Baez seeks a private meeting with the judge to argue a motion. He wants to subpoena records -- without disclosing what they are -- that he sees as crucial to defending Casey Anthony, WESH-Channel 2's Bob Kealing explained.

Baez on Tuesday started the first of 10 depositions by questioning a corrections official, Sgt. Dennis Moonsammy.
The deposition took an hour and 10 minutes, WKMG-Channel 6's Adam Longo said.

WESH also reported that Amy Huizenga, Casey Anthony's friend and a key witness for the state, has hired a lawyer and won't give a deposition to Baez this week.

For an hour, Sergeant Dennis Moonsammy answered questions asked by Baez.
Sgt. Moonsammy is a witness for the State Attorney's office. His attorney, Eric Trivedi, answered a few quick questions after the depositions on his client's behalf. "He was asked general operating procedure and what would have been documented and what would not have been documented," said Trivedi.

Court documents show that the reaction was recorded. Moonsammy was not working that day.
