The parents of jailed Casey Anthony -- and grandparents of murdered Caylee -- will talk to Winfrey during May.
That's an important sweeps ratings period, although the Winfrey people didn't give an exact date for the interview.

Casey's Defense Team Files Motion To Obtain Phone Records

Casey Anthony's defense team is asking a judge to help them get very detailed phone records from 12 prosecution witnesses in the case, including Casey's own family members.

Casey Anthony's attorneys want records of calls, texts and even cell tower pings from Casey's parents and her brother, as well as from the family's private investigators, Casey's friends and ex-lovers, and meter reader Roy Kronk.

Casey's lawyers say the information is "material" to her defense.

In a change of heart, the state attorney's office has filed a letter of intent Monday to seek the dealth penalty for Casey Anthony.

A spokeswoman for Jose Baez, Casey Anthony's attorney, has confirmed that the defense has been notified. Baez is not qualified to defend a client in a death penalty case because he does not have the required amount of experience by the Florida Bar.

The court has also been notified of the state's intention.
The state attorney's office is citing "sufficient aggarvating circumstances" as the reason for Monday's decision.

Orange Circuit Court Judge Stan Strickland has to grant him permission on the request Baez filed on Friday. So far, no decision has been made.
The defense wants records, including phone calls, text messages, cell tower pings and Internet usage. Baez can't get this information from investigative documents turned over by prosecutors, Baez wrote in the motion.

Kealing, citing a source was in the clerk's office, said the state's position was that "sufficient aggravating circumstances now exist" for the death penalty.

Anthony's defense team has filed a motion to subpoena cell phone records from George, Cindy and Lee Anthony, Kealing also reported. Defense attorney Jose Baez also wants the phone records of meter reader Roy Kronk, who found Caylee's remains.

WESH's legal analyst Richard Hornsby, a criminal defense attorney, says the motion signals that Baez's defense stragety will be to raise reasonable doubt.

"Based upon additional information that has become available since the waiver of intent to seek the penalty of death filed on December 5, 2008, sufficient aggravating circumstances exist to justify the imposition of the Death Penalty," the filed letter states.
The legal aggravating circumstances that would apply in this case would be that the murder was cruel and atrocious and cold, calculated and premeditated.

Prosecutors might also argue financial reasons were behind the murder, so Casey would not have to support Caylee. There is evidence showing Casey's mother was planning to kick her out of the house.
And, just last year, two new and relevant aggravators were added to the law. The victim is younger than 12 and the victim was particularly vulnerable because Casey had authority over Caylee.

In the court filing, the state attorney's office said, "Based upon additional information that has become available since the waiver of the intent to seek the death penalty sufficient aggravating circumstances exist to justify imposition of the death penalty."

It is not known if new evidence has been revealed to initiate this filing.

"This is not a death penalty case. We will do whatever is necessary to defend Casey Anthony from the State trying to take her life. We already have death-qualified defense lawyers on our team and are prepared for a vigorous defense," Mackenzie said.

Mackenzie had did not respond when asked who the qualified attorney's are.

Marti Mackenzie, spokeswoman for Anthony's defense lawyer, just told the Orlando Sentinel: "This is not a death penalty case. We will do whatever is necessary to defend Casey Anthony from the state trying to take her life. We already have death qualified defense lawyers on our team and are prepared for a vigorous defense."

In addition, it's unclear whether Lenamon will rejoin the defense team. He said he spoke with Baez today, and Baez is reviewing a list of death-penalty-qualified attorneys.

Baez will have to add such a co-counsel if he wishes to continue as lead attorney, should the case indeed becomes a death penalty case.

"To be a lead counsel in a death penalty case in Florida, you have to have tried nine serious and complex cases to completion -- and been trial counsel or co-counsel on two death penalty cases," WKMG-Channel 6's Tony Pipitone said.
Baez did not meet the second standard "as far as we know," Pipitone added. The upshot: Baez cannot be lead counsel, although he can remain on the case, Pipitone said.


The Anthony defense team released a statement: "This is not a death penalty case. We will do whatever is necessary to defend Casey Anthony from the state trying to take her life. We already have death-qualified defense lawyers on our team and are prepared for a vigorous defense."

The state says the death penalty should be an option in the case against Casey Anthony.
Now new information is putting back on the table. This is, of course, if Casey Anthony is found guilty of first-degree murder.

We expect to hear later this week why they feel this should be a death penalty case.
