Anthony Files For Change Of Venue
Baez: Motion Asks Specifically For Trial To Be Moved To South Florida

The defense team member told Local 6 News investigative reporter Tony Pipitone that a change of venue is necessary, saying a fair and impartial trial cannot occur if only Orange County residents are considered as jurors.

Publicity in the Anthony case has been pervasive on cable television and tabloid magazines, but the scrutiny has been even greater in Central Florida, Pipitone reported.

But publicity alone does not require Orange County Circuit Judge Stan Strickland to relocate the trial or decide to select jurors from another part of the state. Prosecutors could also oppose the motion.

Casey Anthony won't get fair trial in Orlando, attorney tells 'Today' show

Attorney Linda Kenney-Baden said people searching online with such phrases as "women who kill children'' will get five to 10 news articles.

"If you put in Casey Anthony, you'll get 7 million hits. But most of it is from the local coverage and reprinting of local coverage stories. Because every single day since I've been in this case, which is Dec. 11th, there has been a story, a story, a story," she said. "Even when there's a non-story, there's a story."

In contrast, the attorney said, the national media "gives us a fair shake."

What about those Casey-goes-clubbing photos? "It is evidence of nothing," Baden said, even as "Today" showed some photos like every other media outlet.

Curry asked about how Anthony is doing. "She is doing as best she can for being told the state wants to take her life," Baden said.

As the interview ended, Baden said, "Thank you, Ann. Thank you for being fair."

If Judge Strickland feels he can not get a fair and impartial jury, the trial will be moved.
Strickland could also order a "random sampling," which is where you try to put a jury together to see if you can find fair and impartial jurers.
According to News 13's Jacqueline Fell, Strickland will most likely consult with other judges and try to choose a county with the least media coverage.

Baez Wants Venue Change For Casey's Trial

Casey Anthony's attorney, Jose Baez, is pushing for a change of venue because of too much local publicity. Prosecutors have never gone on camera for the case, but Baez does it regularly to react to evidence and other developments.

Even Monday, he timed his news conference so that he could do it live at the top of the five o'clock news. Eyewitness News opted not to air it and he was upset about that.

WFTV reporter Kathi Belich had the chance to ask Baez whether he helped cause the publicity problem, but Baez would not answer the question. Casey herself doesn't like the questions Belich has asked her in the past and it's one of the reasons Casey says she wants her murder trial moved out of the Orange County courthouse.

Kissimmee lawyer Jose Baez stated if Anthony 's case remains in Orange County, her right to a fair trial and impartial jury "will undoubtedly be violated."

In the 17-page motion, Baez listed a slew of examples of media reports on the case -- ranging from protesters staged outside the Anthony family home to audio files of law-enforcement interviews. It is the sheer volume of reporting on the case, combined with community reaction to the missing toddler, on which the defense is pinning its hopes for a venue change.

He gives examples of protesters standing outside the Anthonys' home holding signs. One said, "Baby Killer," according to the motion. Another said, "Angel Killer."

Casey Anthony: WKMG asks if she can get fair trial in Florida cities

Reporter Tony Pipitone traveled to Jacksonville, Tampa, Fort Myers, Miami and West Palm Beach. He carried a photo of Anthony and approached people with this question: Could you give her a fair trial?

WKMG will air the report at 11 tonight and Tuesday, news director Steve Hyvonen said. He said the report was timely because attorney Jose Baez is seeking a change of venue for his client.

During the 6:30 p.m. Sunday telecast, Pipitone broke the news that Baez would seek the change of venue.

On Monday afternoon, lead defense attorney Jose Baez filed the motion at the Orange County Courthouse in order to get the high profile case moved out of Central Florida to a venue in South Florida.
The decision now rests with Judge Stan Strickland of the Ninth Circuit Court.

Baez initially intended to keep the location of the trial sealed. "But after extensive research, the defense believed it should not make that request, in good faith," said Baez.
When asked if he expected a different dynamic among possible jurors in South Florida, Baez responded, "We don't believe we can avoid finding people who have not heard about this case."

Baden said there were too many stories and that the local media hadn't given Anthony's defense team a fair shake.
What did local television have to say in response to Baden?

WFTV-Channel 9 news director Bob Jordan said, "I'm a little puzzled that the defense goes out of its way to get media attention, then in the next breath complains about the attention it's getting. That doesn't compute in my mind."

Belich tried to ask if he helped create that publicity problem.
She asked Baez: "How do you explain your complaints about publicity when you're the one holding news conferences all the time and going on national television?"
He said "excuse me" and started using his cell phone.

Belich's take on the situation: "He likes publicity as long as he likes what's being publicized. If he doesn't, not so much."
Belich also noted that Casey Anthony, in an affidavit, faulted WFTV for Belich's questions. One such question: Did Casey kill Caylee?

WFTV anchor Martie Salt said that Baez tomorrow will question a jail guard who was with Anthony when she learned her child's remains had been found.
