The judge is allowing Gonzalez's attorney's to seek punitive damages.

The motion to dismiss the civil suit wasn't discussed at length because Gonzalez's attorney's plan to amend the suit with the punitive damages.

Another hearing on dismissing the civil suit could be set for a later date.

Cindy Anthony is expected in court Thursday. Gonzalez's legal team wants a judge to force her to answer questions and to pay for their costs. The attorneys want to know if Casey ever used Cindy's credit cards without permission. Cindy refused to answer that question during her first deposition.

A judge ruled to allow Zenaida Gonzalez's legal team to file for punitive damages against Casey Anthony.

Attorneys for Anthony asked a judge on Tuesday to dismiss the lawsuit brought by Gonzalez, who claims Anthony defamed her when she told police that her daughter, Caylee, had been kidnapped by a nanny named Zenaida Gonzalez. The motion to dismiss was tabled for a later hearing.

The judge approved Gonzalez's lawyer's motion to amend the complaint and assert their right to punitive damages.

Gonzalez is seeking $15,000 in damages.

A hearing will be held this morning in the civil case filed by Zenaida Fernandez-Gonzales against Casey Anthony.

Anthony’s attorney Jose Baez wants the lawsuit thrown out. Baez claims that Gonzales' attorney, John Morgan, is milking the lawsuit for free publicity.

Zenaida Gonzalez is suing Casey Anthony in civil court. She has the same name as the babysitter Casey Anthony claims took her daughter Caylee. Gonzalez says it has ruined her.

Instead of dismissing the case, the judge granted her attorney's motion to amend the original complaint and ask for punitive damages.

Once that new complaint is filed, Anthony's attorney, Jonathan Kasen, said he will refile his motion to have the lawsuit dismissed – or at least delayed until after Anthony's criminal trial.

A judge has decided that attorneys for Zenaida Fernandez Gonzalez can pursue punitive damages against Casey Anthony in a civil suit.

Attorneys with Morgan and Morgan were scheduled to question bounty hunter Leonard Padilla at 1 p.m. Tuesday afternoon in the defamation suit against Casey Anthony, but News 13 has learned that meeting was cancelled.

Deputy Richard Cain announced his resignation Monday, just a day before he was expected to find out whether he would be fired.

A Professional Standards Investigation determined Cain violated two of the agency’s standards of conduct: Unsatisfactory performance and truthfulness.

Gonzalez's attorneys have amended their complaint by accusing Cindy Anthony, Casey's mother, of spreading the defamation on television, DeForest added. Kasen has 20 days to respond to the amended complaint, DeForest said.

WFTV-Channel 9's Mark Boyle noted that George and Cindy Anthony, Casey's parents, had attended the hearing this morning. "They came and left without saying a single word," Boyle said.

DeForest said more fireworks were expected Thursday in the civil suit. Gonzalez's attorneys will ask the judge to force the Anthonys -- George, Cindy and Casey's brother Lee -- to answer questions they sidestepped in videotaped depositions.

Gonzalez attorney Keith Mitnik today scoffed at Anthony's refusal to clear his client Gonzalez of kidnapping Caylee Anthony.

"Her lawyers, her parents, everybody in the world on her behalf says it," Mitnik told reporters. "It's troubling that she's resisting answering that question."

WFTV-Channel 9's Kathi Belich asked why Anthony was resisting. "I don't know whether she's wanting to keep her options open," Mitnik said.

Could Anthony use this Zenaida Gonzalez as a defense? Belich asked. Jonathan Kasen, Anthony's civil attorney, dismissed the question as speculative.
