Motion Says Caylee's Autopsy Results Will 'Cause Great Anguish To Anthony Family'

ORLANDO, Fla. -- George and Cindy Anthony are asking Thursday that their granddaughter's autopsy results be sealed until the trial of their daughter, Casey.

A spokeswoman at the state attorney's office confirmed to WESH 2 that Caylee's autopsy report is part of 1,000 pages of new evidence it plans to make public Friday.

In a motion filed by their attorney, George and Cindy Anthony argue that "the information contained within in the report will cause great anguish to the Anthony family."

A spokeswoman for state attorney Lawson Lamar said that as of Thursday at noon, they are planning to release the report as part of the normal discovery disclosures required by state law.

A judge intervened and the prosecution decided not to release the autopsy results with the rest of the documents on Friday. It is unknown when the results will be released or if a hearing will be held.

Medical Examiner Dr. Jan Garavaglia said the results contain her "strong opinion" about what happened to Caylee. The toddler's death has already been publicly ruled a homicide, but Garavaglia said it would be impossible to determine how the toddler died.

The release is expected to include everything that has been released to the defense so far, but the exact contents have not been disclosed.

The toxicology results, which could reveal whether Caylee had been exposed to chloroform, could be included in the release. A previous discovery release included Internet searches for chloroform from Casey Anthony's computer.

The defense has also received raw video of private investigator Dominic Casey's search of the woods where Caylee's remains were later found and a 3D animation of the crime scene.

In the case against Casey Anthony, 1,000 documents are expected to be released Friday. However, Judge Stan Strickland ordered a temporary stay on the release of Caylee Anthony's autopsy results, which was included in the documents.

Brad Conway, the attorney for George and Cindy Anthony, filed a motion on Thursday to block the release of the autopsy findings.

Eyewitness News learned that the motion did not give the media enough notice, so a judge delayed the release until all parties can fight it out in court.

The documents contain details gathered during an autopsy of Caylee Anthony's remains that were found on December 11 in a wooded area less than one mile from her family's east Orange County home.

The documents that will be released Friday will contain Caylee's toxicology results and police interviews. WFTV.com will work to post the documents as soon as they become available.

TV reports are saying Caylee Anthony's grandparents, George and Cindy Anthony, are fighting the release of the toddler's autopsy report.

Orange Circuit Court Stan Strickland issued an order late Thursday that will delay the release of the autopsy reports, which were expected to be made public on Friday, until the issue is addressed in court. He wants to hear from the media about the Anthonys' request.

"For reasons unknown to the court the motion was served only upon the State Attorney's Office," Strickland wrote in the order. "The real party in interest in this matter is the various news media."

The State Attorney's Office is releasing the information in response to public records requests. Prosecutors are required by law to release the documents that they provided to the defense. Some information, such as autopsy photos, can be exempt from public record laws.

"This request certainly begs the question: What's in that report that the medical examiner did not make public when she announced back on Dec. 19 that Caylee's death was as the result of a homicide and the decomposition was so advanced that they could not make a definitive determination on how she died," Kealing said.

Anthony PI Dominic Casey says he should not be held in contempt of court

Private investigator Dominic Casey on Thursday answered a call that he should be held in contempt of court for not showing up for a deposition.

"This litigation is a cynical and frivolous exploitation of a family's tragedy," Casey's attorney said in a motion filed for a protective order in the Orange County civil case against Casey Anthony.

Judge Jose Rodriguez has not ruled on the contempt motion.

"How would information from Dominic Casey help the Zenaida Gonzalez defamation case?" attorney Diana M. Tennis asked in her brief to have the contempt motion dispelled. "It wouldn't."

The reason: Judge Stan Strickland wants to hear what the media have to say about George and Cindy Anthony's motion -- filed by their attorney Brad Conway -- to block the autopsy's release.

Strickland issued a temporary stay of autopsy findings late this afternoon.

"The real party in interest in this matter is the various news media," Strickland wrote. "Pending formal notice to the media, including the Orlando Sentinel, this Court will enter a temporary stay of the autopsy reports and findings set to be released. Following a written response to the motion by interested media the Court will either rule on the pleadings or set a hearing as necessary."


But hundreds of other documents will be released tomorrow.

Casey&#8217;s Lawyers File Motion Seeking Investigator&#8217;s Cell Phone Records

Lawyers for Casey Anthony have filed a new motion to get the cell phone records of a private investigator who once worked for them.

They previously tried to get Dominic Casey's cell phone records, but a judge denied their request and told them to file a more specific one.

Anthony's lawyers said they now want Casey's cell phone records dating back to July 2008.

More Anthony documents to be released

Brad Conway filed a motion late Wednesday, asking the judge to stop the final results from Caylee's autopsy from going public. But Conway tells FOX 35 reporter Holly Bristow that the autopsy won't contain any bombshells, like exactly how Caylee died, or when.

According to court documents, along with Caylee's autopsy, there are hundreds of pages of transcripts. Included are detective interviews with bounty hunter Leonard Padilla, who posted Casey Anthony's bail the first time that she was released from the Orange County Jail.

Padilla also had a woman living in the Anthony's house, keeping an eye on Casey for a brief period. Her name is Tracy, and her statements are in there as well.

In addition, we expecting interviews with Padilla's partner, bounty hunter Rob Dick. He drove Casey to and from her attorney's office day after day.
