Casey Anthony October Trial Date Cancelled
The October 12 date for Casey Anthony's first-degree murder trial has been
cancelled after a Tuesday morning meeting between the defense, prosecution and the judge. Eyewitness News was the only media at the meeting.

Defense team member Andrea Lyon told Judge Stan Strickland her teaching schedule would prevent her from being able to go to trial in three months. Judge Strickland cancelled the October 12 date and scheduled a status hearing on the first-degree murder trial for January 21, with plans toward a trial date next summer.

One reason for the delay is new defense team member Andrea Lyon's teaching schedule, which WFTV legal analyst Bill Sheaffer says wouldn't go over well with a lot of judges.

"You cancel everything. You better be ready for trial. In the state system, we're more flexible and especially in a case like this where it's a capital case and someone's life is on the line," Sheaffer said.

Sheaffer says Judge Stan Strickland does not want to give the defense an argument they could use on appeal saying they weren't ready when they had to go to trial.

Additionally, the judge said that he wants an affidavit from Amy Huizenga showing she wants to invoke her right to a speedy trial in the check fraud case that the prosecution wants to move forward on. Casey is charged with stealing her friend's checkbook and buying personal items with forged checks.

Lyon, the defense's death penalty qualified attorney, also told Judge Strickland that she plans to file several motions after Labor Day, but details of those motions were not given.

The judge in the case against Casey Anthony Tuesday ruled he will allow news organizations to argue against sealing a video made of Anthony in jail.

Local news organizations argue that the video is a public document and should be released along with hundreds of other items of evidence in the case.

Anthony's defense team has argued that the video's release could poison the pool of potential jurors.

In other news in the case, as expected, the Oct. 12 trial date for Anthony has been canceled. A status hearing on when the trial will go forward is scheduled for Jan. 21.

The date set for Casey Anthony's murder trial has been postponed.

Anthony was expected to face trial on charges that she murdered her daughter, Caylee Anthony, in October, but Judge Stan Strickland's office confirmed that the date will be pushed back.

A pretrial hearing has been set for Jan. 21, 2010, at 10 a.m.

Casey Anthony is charged with first-degree murder in Caylee's death. The prosecution said it intends to seek the death penalty against her.

The October trial date for the Casey Anthony murder case has been canceled. No new date was set but a status hearing was scheduled for Jan. 21 at 10:00 a.m.

Andrea Lyon, the latest attorney to join Anthony's defense team, flew from Chicago to attend the meeting. She wanted the judge to know she would be filing motions related to the death penalty in the next several weeks. She requested they be heard before the court in a specific order, said court spokeswoman Karen Levey. She also asked that the hearing dates be scheduled on Thursday or Friday days she doesn't teach class at DePaul University law school.

The prosecutors addressed two other issues: Anthony's tattoo and her fraud case.

The state's request for a photo of Anthony's "Bella Vita" which means "Beautiful Life" - tattoo was moot. She got the tattoo around July 3, which was after she says she last saw her daughter.

The defense didn't oppose a picture so authorities are scheduling one to be taken soon, Levey said.

Prosecutors want to move forward in the check fraud case against Anthony and requested a trial be scheduled in the few months. She's charged with more than a dozen fraud counts, including fraudulent use of personal identification information and forgery of a check.

Strickland requested a sworn affidavit from Huizenga, saying she too is requesting a speedy trial and doesn't want to wait on the murder case.

The defense can respond before Strickland rules on the state's request for a trial.

Judge Strickland did schedule a pretrial hearing on January 21, 2010, at 10:00 a.m., with plans for a trial date sometime next summer.

The scheduling of a definitive date has been mired by dozens of motion hearings to sort out everything from submissible evidence to trial venue. Just last month, a motion to withhold autopsy findings from the public was denied. However, a video which shows Casey Anthony's reactions on the day that she learned her daughter's remains were found will not be released.


Defense attorneys have asked that the trial be moved to South Florida because of the intense media coverage in Orlando. A hearing has not been scheduled yet to determine whether the case will be moved out of Central Florida. Prosecutors say they will seek the death penalty if she is convicted of first-degree murder.

Also yet to be determined is a date for the civil case brought against Anthony by Zenaida Fernandez-Gonzalez. Attorneys for Anthony had asked to dismiss the lawsuit.

In addition to the civil case presented by Fernandez-Gonzalez, prosecutors want to proceed in a check fraud case against Anthony. That trial could be scheduled before the end of the year.

Casey Anthony: Tony Lazzaro Hires Lawyer

WDBO is reporting that Tony Lazzaro has hired attorney William R. Jay to represent him.

From WDBO:

Attorney William R. Jay tells WDBO that he&#8217;s been told by lawyers for Zenaida Gonzales that Lazarro will soon be deposed in Casey&#8217;s civil case &#8211; though nothing had been filed in court as of Monday.

Lazzaro was previously deposed by lawyers for Casey in her criminal case, and Jay said he expects his client to again by questioned in that case &#8220;now that they have a death penalty qualified lawyer&#8221; &#8211; referring to the addition of Dr. Andrea Lyon to the defense team.

Jay said he will represent Lazzaro in both cases.

Sheaffer said he expects "dozens of motions" filed by every member of the defense team. Belich added, "Sheaffer also expects the defense to file a lot of motions against the death penalty for Caylee's killer." Yes, the veteran reporter convicted Anthony. "Accused killer" would be the way to describe Anthony.
