Drew Peterson's murder trial won't be going ahead next month as planned, after he waived his right to a speedy trial today.

During a hearing at the Joliet courthouse, Peterson attorney Joel Brodsky told Judge Stephen White that the defense team needs more time to review some 40,000 pages of evidence.

I hope this gives LE more time to find Stacey and level even more charges against smug Mr Peterson.

In the article posted above, it says that the next hearing is on Aug 14 and the defense is going to ask for the trial to be moved and challenge the constitutionality of a hearsay law passed last year that allows Savio to testify "from beyond the grave.

GRRRRRRRR!

Brodsky said the case could end up in the U.S. Supreme Court. If Circuit Judge Stephen White agrees with the defense, the trial could be delayed for a long time, Brodsky said.

Peterson's attorney Joel Brodsky told Judge Stephen White Tuesday that the defense team needs more time to review some 40,000 pages of evidence in the murder of Petersen's former wife Kathleen Savio, and that late August was too soon to get through it all, the Tribune reports

Hoping to thwart prosecutors, Drew Peterson's lawyers said Tuesday they will challenge a new "beyond the grave" hearsay law nicknamed after the former Bolingbrook police sergeant.

The move is expected to delay the start of Peterson's trial on charges he murdered his third wife, Kathleen Savio, 40, who mysteriously drowned in her dry bathtub in March 2004

I believe if the hearsay law is found unconstitutional the state will have to stop the prosecution in its tracks and take an appeal of that decision... it's that essential to their case," said Joel Brodsky, Peterson's attorney

Why do I feel another demand for bond reduction coming up? :behindbar

So, Drew needs to sell his vehicles, motorcycle and plane to fund his defense. Brings me to tears. I wonder how much of Kathleen's estate helped him buy these items?

JB must have found someone to advise him on what to do about the case. Those motions actually make sense in a defense perspective. The challenge to the hearsay law is expected. It is a concern, but some versions of it have been used in other states for several years. He seems optimistic, but well the way I see it there is a slightly better chance that the Supreme Court will allow it. The motion that is expected to be filed to move the trial to another county is common. I just hope that the judge will take into consideration how much of that media attention DrewP either instigated or participated in. And that the case is well known enough that moving it to another county wouldn't significantly change how well the jurors knew the story.

As long as DP remains imprisoned in his 9x12 cell, the delays aren't as troublesome. We expected motions to start filing in, no surprises there. Let's hope the Judge doesn't cave in or a higher court sympathize and reduce his bond. He's right where he belonged in the first place.

I'm not surprised that the trial has been delayed. I thought it was too soon, and thought late this fall or early next year would be more likely.

On JB's challenge to the hearsay law, I think it's more likely his challenge will be defeated. California was one of the first states to have the hearsay law. It was challenged and re-written and has withstood other challenges. Illinois wrote their law based on the re-written California law. Several other states also have the hearsay law.

I guess JB is working all angles.

LOL I agree! As long as he is in jail...I don't care if they ever have a trial. :behindbar Let them keep putting it off until they find Stacy!

His trial was set to begin in late August, but Will County Judge Stephen White is canceling that trial date.

No new starting date is on the books.

Peterson only spoke once during the latest hearing.

He agreed to push back the trial so his defense team can review evidence handed over by prosecutors.

A state police detective asked murder defendant Drew Peterson's young girlfriend out on a date, Peterson's lawyer said after a Tuesday court appearance

Peterson trial postponed; venue and constitutional questions abound

DP is in jail and losing everything that murder money bought!
He's away in jail with no fun..........what he deserves.
Away from mind twisting his children........great.
ITA, who cares about a trial right now as long as he is behind bars forever!

According to the 2nd link that Painter posted, a state police detective asked her out on a date. And Brodsky is using that to try to muddy the investigative water. Some posters on there are theorizing that this is a DrewP plot to get his name in the papers again. Like maybe he had Chrissie say that.

LOL, if it wasn't a DrewP plot, can you imagine what DrewP is going through? LOL, he can't get to her cell phone GPS to keep tabs on where she is going. He can't follow her around. He can't smack her around to keep her in line. Bet he is burning up over this. After all, his women aren't allowed to leave him and move on. He however is allowed to do as he pleases.

ETA so Gloria Allred is representing Chrissie now. And Allred is denying that this ever happened? Did I get that right? So maybe this is a DrewP plot to get his name in the paper again.

Ahhh, it seems that Derek Armstrong is somehow involved in this. His press release is dated July 13.

Posters here seem to believe that it was hot chocolate and a diet coke while they discussed her testimony. They believe it is a DrewP plot, filtered out through Derek A..

Sounds to me like getting her out of the house and away from the kids for a discussion about the case, but what do I know?

And somehow Derek A. gets this info and it is a date (one that Chrissie's attorney denies). Hmmm

OMG, Drewp is probably going berserk in there, not being able to check up on her! I'm actually surprised she's still going to see him, maybe son Steve gives her an 'allowance' from Drewp to make sure she visits him, lol.

I wonder if Chrissie told DrewP that police took her out to interview her and DrewP's insane jealousy turned it into a "date"... then drewp had Chrissie run to Armstrong with the ‘story’ and Brodsky naturally twisted it into a problem for the prosecution. Or perhaps Chrissie actually thought the interviewer was hitting on her, lol. But the state is denying this story and I tend to believe the state over anything camp drewp says, lol...

Charles B. Pelkie, the spokesman for the state's attorney's office, said there was no truth to Brodsky's claim.

"This is an absolutely ridiculous assertion," Pelkie said. "You have two officers who have had multiple professional contacts with Christina Raines. They told her they would leave the door open to talk to her at any point, whether it was during business hours, whether it was after business hours, whether it was over coffee, lunch, dinner, whatever made her comfortable," he said, stressing that two investigators were always present with Christina Raines and calling their offer to meet with her "good detective work."

Aww, poor baby. Well, maybe he could have saved a few bucks if he had filed for a speedy trial. I sure hope Brodsky is a slow reader...

Well it sounds like there could be another option that I hadn't thought of yesterday. It could be that Chrissie needed money. What better way to get it than to hit DrewP up for it. And he wasn't forthcoming, to then hint about getting closer to the investigators. And of course DrewP being DrewP would take that to mean she went out with the investigator. And since he couldn't get to her personally, he thought of another way to do it. Through Armstrong. And from there, JB gets to complain about the investigation. Win win for DrewP all the way around. If that is what happened, I hope it ticked Chrissie off.

State's attorney: Cops did not hit on Drew Peterson's fiancee

The Los Angeles attorney representing Drew Peterson's young love shot down a claim from the accused wife-killer's lawyer that a state cop hit on her client.

"Chrissie has not had dinner with or gone to the movies with any police officer other than Drew Peterson and she has no interest in doing so," the attorney, Gloria Allred, said in a written statement. "She does not feel that she was 'hit on' by any police officer. We do not think there is a basis for filing a complaint against any police officer and we have no plans to file such a complaint."
