Fingerprint Test Apparently Destroyed Evidence Of Heart Sticker On Duct Tape

The claim was based on a fingerprint examiner at the Federal Bureau of Investigation laboratory reporting that she saw the shape or outline of a heart on the duct tape.

But Local 6 has learned no one else will ever see what that examiner saw because all traces of it were destroyed by testing at the FBI lab.

And Pipitone added that the FBI didn't take a photo of the heart-shaped image before the testing, which revealed no fingerprints on the duct tape.

The FBI had refused to comment on the revelation that it didn't take a photo, Pipitone said.

"We don't know if some other agency might have taken a similar picture that shows such an outline," Pipitone said. "But we know that there's no mention of such a photo in the 8,000 pages that have been released so far."

It was another first-rate report from Pipitone. And he promised a follow-up today: an interview with a former prosecutor about the revelation could mean to the case.

Orlando defense attorney Richard Hornsby said he believes prosecutors can still use similarity between the tape found on the child's skull with tape on a gas can from the Anthony home and detectives who saw residue of the sticker on the duct tape could testify it appeared to match stickers found in Casey Anthony's belongings.

"I'm not convinced Baez would be able to get this evidence excluded if it was destroyed in the process of trying to get a fingerprint," he said. "That is excusable conduct on the part of the state."

What could it mean at trial? The sticker development doesn't help the prosecution, which wants the strongest case in a "CSI"-savvy world, former prosecutor Elizabeth Rahter told Pipitone.

Pipitone added, "Now no jury can see it [the outline] and no analyst can compare the shape and size to the heart stickers found in Casey Anthony's arts-and-crafts closet." Casey Anthony is charged with the first-degree murder of her daughter, Caylee.

And yet, Rahter said the information could get into the trail if the lab employee testified about seeing the sticker outline. Pipitone said the loss of the image could allow the Anthony defense team to raise doubts about the FBI lab, which has tested other evidence in the case.
