HACKENSACK, N.J. (AP) -- The lawyer for a Florida man who claims he's too fat to have killed his former son-in-law told jurors on Wednesday all they have to do is is look at his client to see that he's obese, old, and in no condition to commit such a murder.

Prosecutors also said there was evidence that the killer was hungry: A Burger King hamburger wrapper was found near Duncsak's body, and Duncsak was on his cell phone moments before he was shot asking his girlfriend if she had left the Whopper wrapper there. She said she had not

Edward Ates, better known as the Florida man who claimed he was too obese to kill his former son-in-law in Ramsey, was sentenced Thursday to life plus five years in prison... Ates must serve nearly 68 years in prison before he can see a parole board.

Paul Duncsak, a 40-year-old pharmaceutical expert, was talking on his cell phone with his fiancée, Lori Adamo, as he returned from work on Aug. 23, 2006, and entered his West Crescent Avenue home.

Adamo testified during the trial that she heard Duncsak scream, followed by a thud as if someone fell to the floor. Duncsak was later found dead with multiple gunshot wounds.
