UPDATED: Casey Anthony case: Judge says jail can keep recording
Orange Circuit Court Judge Stan Strickland ruled Thursday that he can't force the jail to stop videotaping Casey Anthony.

A judge won't stop Orange County Jail officials from recording visits between Casey Anthony and her attorneys.

However, he does have concerns about content of any videotape that might be released and has seen at least one that would impact Anthony's right to a fair trial, Strickland wrote.

It's unclear which video the judge is referring to in his motion. Several months ago, Strickland did stop the release of a video that showed Anthony's reaction when she learned about her daughter's remains.

Strickland ordered that he must view &#8212; behind closed doors &#8212; any video of visits with her attorney before it's released to the public.

Anthony's lawyers filed a motion to prohibit the procedure, but Judge Stan Strickland said he'll allow their release, but not before he signs off on it.

He said state law favors public access.

Strickland also said he'll prohibit their release if he believes it will be prejudicial to her case.

WFTV legal analyst Bill Sheaffer he's not surprised that argument did not hold water with the judge.

&#8220;That's like the defendant saying to a judge, &#8216;Please show mercy on me, because I&#8217;m an orphan.&#8217; When, in fact, the defendant is charged with murdering their parents,&#8221; Sheaffer said.

&#8220;It's because the quality of the evidence is greater in murder cases than, perhaps, than the evidence in other cases,&#8221; Sheaffer said.

Casey Anthony could face three separate trials in 2010.

If the two sides cannot reach a financial settlement soon, a trial date has been set for June 7.

Anthony is just weeks away from her first trial of 2010. On Jan. 25 she will face a jury for allegedly stealing checks from her former best friend, Amy Huizenga.

Meanwhile, the judge in Anthony's murder case ruled on Friday that the state can continue to seek the death penalty.

Orange County Circuit Judge Stan Strickland said the state was not acting in bad faith or depriving Anthony of her constitutional rights by seeking the death penalty.

The denial is the latest of many by the judge in the case. Earlier this week, Strickland denied defense motions that the Orange County Jail stop videotaping Casey Anthony in jail. He also denied a motion to dismiss charges of check fraud.

In his ruling, Judge Stan Strickland said while the motion has merits, it should be left up to a jury to make that decision.

Strickland also said the prosecution has the discretion to seek the death penalty, and while he does have some authority to restrict that right, he was choosing not to do so in this case.

Now, of course, the defense argued there was bad faith. They say the state just wants to go for the death penalty so that it can get a jury that is more conviction-prone.&#8221;

Judge Stan Strickland has denied a request to take the death penalty off the table in the prosecution of Casey Anthony charged with killing her 2-year-old daughter Caylee.

The judge ruled Friday that prosecutors can ask a jury to consider the death penalty during Casey Anthony's trial next year.

WESH&#8217;s Bob Kealing highlighted Strickland&#8217;s view that the prosecution&#8217;s brief recitation last week of why it sought the death penalty was &#8220;compelling&#8221; and &#8220;therefore sufficient.&#8221;

But Kealing added, &#8220;That does not mean Strickland will just automatically sentence Casey to death if she is convicted and even if a jury recommends it.&#8221;

The defamation trial has been set for June, WKMG&#8217;s Mike DeForest reported. Zenaida Gonzalez is suing Anthony for defamation for linking her to the disappearance of Caylee Anthony. Casey Anthony is charged with first-degree murder in the death of her daughter, Caylee.

About the defamation suit, DeForest said, &#8220;If the two sides cannot reach a financial settlement by the end of May, a jury will hear this case in early June.&#8221;

Anthony&#8217;s check-fraud trial starts Jan. 25. Her murder trial will probably start this summer.

&#8220;So it appears 2010 is shaping up to be a very busy year with lots of distractions for Anthony&#8217;s defense team,&#8221; DeForest said.

Even through Cindy and George Anthony’s words on The Today Show say that they believe their daughter Casey is innocent, their body language clearly says something different. Their body language says they know their daughter is guilty of killing their granddaughter Caylee.
