    OR - Malcolm Gerlach for kidnapping, rape of 10yo girl, Eugene, 2009

    "The jury that convicted Malcolm Michael Gerlach in November of kidnapping and raping a 10-year-old Eugene girl last year returned to a Lane County courtroom on Tuesday to determine if he is a “dangerous offender” under Oregon law.

    The panel of eight women and four men took less than 20 minutes to decide that he was. They also found that Gerlach was on probation for a previous crime when he used a stolen vehicle to knock the girl off her bike, snatched her off a street near her Santa Clara home, drove her to a remote location and assaulted her."

    EUGENE, Ore. -- The man accused of pulling a 10-year-old girl off a Eugene, Ore., neighborhood street and into a stolen car by her hair was released from jail in Coos County on Sunday.

    Malcolm Michael Gerlach was arraigned at the Lane County Jail this afternoon. The sheriff arrested him after a 20-minute pursuit near Fern Ridge Reservoir Tuesday evening.

    The sheriff believes Gerlach was cruising a neighborhood in the Santa Clara area of Eugene, Ore., Tuesday in a stolen car. Witnesses told investigators and KVAL News that the car struck the girl, knocking her off her bicycle. Witnesses said a man got out of the car and drug the girl into the vehicle by her hair before speeding away."



    Three days!!!!! He'd been out three days before he abducted this child.

    This case bears a lot of similarities to the recent Amber Alert and remarkable arrest of Larry Ladwig in Phoenix. A little girl snatched, raped, and driven around by a horrible pervert. An alert sheriff/LEO spotted the guy and was not going to let him get away.

    Thank God for observant and determined LE. Just like in the Phoenix case, everyone did the right thing and we got a child back. We're not going to get second chances with guys like this, though.

    An Amber Alert was prepared but never issued for the Oregon child as she was located. Some other local articles:

    He hears voices.

    This poor, poor little girl. I can't find anything on this guy save for these crimes. I can only find a person by that name and they lived only in CA. I matched that up with associated names and it seems he must be that person in CA.

    That said I highly doubt these are the first crimes this guy commited. This little girl had to testify and said she prayed on the "Jesus Star" that a bunch of cops would come and save her. Heartbreaking.

    I don't recall ever reading where he lived in California or what brought him to Oregon. He was in Coos County (Oregon coast) jail for theft. I guess he sat there planning the abduction as he pulled it off within three days of being released. I'll do some checking.

    "Authorities said they quickly arrested the driver, whom they later identified as 25-year-old Malcom Gerlach, and safely removed the girl from the car.

    The girl was taken to a hospital to be treated for non-life-threatening injuries.

    Deputies said 58 minutes elapsed between the time the incident was reported and the time the girl was rescued.

    The sheriff's office and district attorney's office are investigating and anticipate formal charges against Gerlach. According to sheriff's deputies, Gerlach is a transient last known to have lived in southern Oregon."


    A couple of things. First, I really like the way this reporter described the child's condition. Remember, we were debating that after the Christmas Day Amber Alert in Phoenix. A bunch of us took issue with the phrase, "found unharmed", when it is known that a child has been raped. Other reporters and editors, take note. This works.

    Second, "a transient last known to have lived in Southern Oregon"--Yikes, that's our town. There's really only one place to hang out on the streets of Southern Oregon and that's Ashland. I've been sitting here all day trying to figure out a few things. For some reason I couldn't remember this crime until I looked back and realized that I was very ill last January (letting things slip). Lastly, something about this guy rings a bell. If he actually was in Ashland, I'll find out. This is really bothering me. And I think I just figured it out........be back later.

    I am not surprised in the least. Lane County has rec'd so many budget cuts that most of the time there are only two officers on each shift. My prior employer was in the county and if the alarm went off, they would not respond due to budget cuts. Even the alarm company was shocked. The area is HUGE too.     Hoping it's nothing too bad when you do find out. Also you mentioned not too much goes down in Ashland.

    The only snip I found had to do with a woman with the same last name of this guy being in an accident. I'll go look again. Thanks again for all your pertinent information, Iz.

    Oh, I'm always ill, Filly, that's nothing new. Nothing to worry about. I have Spinocerebellar Ataxia with seizures and sometimes the seizures get bad. Last January was really bad. I just couldn't figure out how I missed a case like this until I checked my journal.

    OK, I did a little checking. Here's why the name jumped out at me. When my daughter left town with a human trafficker (pimp), she left one of her cell phones with me. For about two months, I got a lot of calls from a "Malcolm" over in Coos Bay. This was not the pimp but rather a customer. He was a slimeball and I have to admit that I strung him along a few times while feeding the local LE the transcripts of my calls. That's not a common young guy's name around here and I remembered it. Doing some sleuthing, I found a couple of Gerlachs who've been arrested on meth charges around here and then there's a large family group over on the coast around Brookings (south of Coos Bay) who seem like a truly nice family. Malcolm could have been hanging out at any of these places.

    The reason I mentioned Ashland is that we have a very "understanding" police force and have a large number of street people who hang around downtown due to the Shakepeare festival (we have about 300,000 visitors each year for that). Ashland is a unique and quirky place. It's all probably nothing but for some reason, I think that guy came across my radar somewhere else.

    "A jury didn't buy the insanity plea and found him guilty.

    Friday morning, Judge Debra Vogt sentenced Gerlach to 130 years in prison.

    "I think we need to recognize some monsters don't just exist in fairy tales," Vogt said. "They're out there walking among us."

    Concerning Malcolm Michael Gerlach:

    "These were the final chapters of a life story of crime: abused and neglected by drug-using parents, taught to steal by his mother, convicted of felonies by the time he was a teenager, in and out of foster homes, eventually imprisoned in California -- and at some point in his youth, sexually abused by an adult."


    This paragraph sums up the reason I continue to post on issues of drug exposure, childhood sexual abuse, and dysfunctional parenting. I know that I often sound like a broken record. Yes, adults are responsible for their actions. However, if we cut kids off at the knees, how do we expect them to straighten up and fly right at the magical age of 18?

    Mr. Gerlach is a monster and he will pay for his crime. But, I can't help but ask what we could have done, as a society, to turn him from that path. I don't have the answers. I have ideas and opinions. Those ideas cost lots of money, though, and will require a major shift in society's response to our most vulnerable children.

    My heart is with this young victim and her family. May her healing begin. She was a brave girl to testify. Maybe she'll join us someday.
