So, McQueary is on his way to San Antonio to find his son, Baby Gabriel, who was last seen in S.A. on December 26.

Search for missing Mesa baby comes to Tucson

No one has seen Gabriel Johnson since Christmas but it's thought that he came through the Tucson area with his mother, Elizabeth Johnson, at some point around then..

Tuesday the baby's dad, Logan McQueary, came to Tucson to retrace the mother's footsteps.

McQueary is stopping at hotels and convenience stores, from here to San Antonio, where he knows the mom and baby ended up at one point.

McQueary is especially optimistic after today's arrest of Scottsdale resident Tammi Smith.

"Maybe she's going to sit in jail and think about exactly what's going on. Maybe she'll come clean with everything that she knows. Maybe it will lead to finding Gabriel. That's what I'm hoping for," he says.

Tammi Smith, 37, was interviewed at Tempe police headquarters and later booked into the Maricopa County Jail on charges of custodial interference, conspiracy to commit custodial interference and forgery.

Lt. Mike Horn said the charges stem from Smith's repeated and apparently desperate attempts to adopt 8-month-old Gabriel Johnson, not from the boy's Dec. 26 disappearance in San Antonio, Texas.

"The only thing I can surmise here is that the authorities think she knows something that she hasn't told them," Tammi Smith's lawyer, Michael Kimerer, told reporters.

In a Tuesday court document detailing the charges against Tammi Smith, police describe for the first time the lengths to which she went to adopt Gabriel.

Before Johnson left Arizona with Gabriel, those efforts included repeated phone calls and text messages to his father, Logan McQueary, pressuring him to relinquish his parental rights to the Smiths, according to the probable-cause statement.

Tammy Smith's husband Jack picked her up at 4th Avenue Jail on Wednesday morning. Her attorney was not present.

She was charged with custodial interference and forgery. "It doesn't mean those charges are gonna stick. It doesn't mean those charges are true. But nevertheless, they were able to do that 'cause they're the guys with the guns," says Tammy Smith.

"You know, those are charges that Tempe Police Department is trying to create a case."


"I felt like she was being completely taken advantage of by the father and the grandfather."

When asked if she knows where the missing boy is, she says "absolutely not."

As she was leaving jail, Smith told reporters the Tempe Police Department is trying to create a case. Smith it doesn't mean those charges leveled against her "are going to stick. Doesn't mean those charges are true."

According to a statement from the Tempe Police Department, Smith was charged with conspiracy to commit custodial interference, custodial interference and forgery.

She was arraigned late Tuesday night and released early Wednesday morning.

"We all knew this would happen," Smith said as she walked into the Fourth Avenue Jail. "I am innocent. God is with me."

Jack Smith maintains his wife's innocence.

"We have been harassed," he said. "We have been bullied, and we know nothing."

He also said he trusts his wife.

"I've known every single thing -- everything all along the way," he said.

"She [Elizabeth Johnson] refused to put his [Logan McQueary's] name down because of the fact ... I can't say why," Smith said after her release from jail early Wednesday morning. "I'm not going to say why on TV, but the courts will know why when I go to court."

Smith, who posted $15,000 bond, said Johnson was going to list a fake name.

"I didn't want her to put a fake name. It's not right to do that, to hurt somebody else's family. In the process, I ended up hurting my family and myself because I didn't want her to make up a phony name have have somebody get a knock at their door one day."

While Smith says police arrested her so they could interrogate her in an effort to get more information, investigators said that's not the case.

The couple vows to continue looking for the baby. "Yes, I love this baby. I will look for this baby until he is found," Smith said outside Fourth Avenue Jail. "I will look for this baby the rest of my life until he's found. Even though it means bringing him back to Logan. Oh well. I'm still going to look for this baby."

Baby Gabriel investigation zeroes in on San Antonio

The Scottsdale woman who went from person of interest to suspect in the case of Baby Gabriel posted bond and walked out of jail this Wednesday morning, less than 24 hours after her arrest.

"All of the information we had led us to this arrest," said Sgt. Steven Carbajal of the Tempe Police Department.

Using tips from the Internet and even psychics, the family plotted points on a map where they thought Johnson might have stopped, including the Mountain View Motel in Tucson.

"We got several tips &#8230; talking about a Mountain View or Mountain Inn Hotel," McQueary said. "This is the only one we could find and track down. We decided &#8230; it's worth checking out along the way."

The motel led to a women's shelter, then to a bowling alley, then to another women's shelter.

On Wednesday, McQueary planned to meet with a private investigator who offered to look into the case for free before the family headed to San Antonio, where the search is now centered.

Less than 24 hours after Tempe police arrested her in connection with the disappearance of Baby Gabriel, Tammi Smith walked out of jail, continuing to maintain her innocence.

The focus of the investigation now shifts to San Antonio, where authorities are actively looking for Gabriel Johnson.
