leaves his grandparents home and promptly kidnaps and rapes a woman. Mr. French was released on probation from a sentence he received in the aggravated rape of a woman in 2002. This week, Mr. French tested positive for drugs and was ordered to wear the GPS because he had violated the terms of his probation.

Lets recap-instead of being returned to prison, he was ordered to wear a GPS. Which he cut off two days later and he preyed on another woman. Aggravated rape, kidnapping, assault and battery...quite a list of charges. The police had him by 2:50AM but it was too late for his next victim.

The judge has impounded the police record pending further review and Mr. French is going to have a dangerousness hearing.

I wonder what the outcome will be. :banghead:

omg......why wasnt his parole violated instantly when he tested for drugs?

and now they need a dangerous hearing?

They'll probably slap another bracelet on him and send him back into the world.

I don't think he was on parole, kbl....He was convicted in January 2002 & served his 8yr sentence....I'm speculating that because he was a sex offender, he was put on probation (probably 10 yrs).

True TM-BUT, dude was level 3 which in MA means "going to reoffend." These are the worst of the worst. French proved that. He is not going to listen to anyone but himself.

My point is that when he violated his probation with an illegal substance, it would have been nice to be slightly more stern with him....

What struck me was the information on the swing from Probation being a humanitarian effort to Probation being a risk management issue.

I wonder if it would violate any constitutional issues to force Level 3 violent offenders like this guy to serve out his sentence with no chance at probation? You know, truth in sentencing. Just a thought...because no matter how this is explained to his last/current victim, she has to live with the fact that this dude was walking the streets simply because he wanted to and was not going to take no for an answer.

They released him in June 2009, so he received some time off. the probation officer can arrest the violator, and then they have the hearing. In French's case, the judge decided on the bracelet for the period of probation...10 years IIRC.,

Guess French decided he would rather be in prison than sporting the bracelet.

When will the courts learn what citizens already know? Sexual deviants can not be rehabilitated and they NEVER stop reoffending.
 
Middlesex district attorney spokeswoman Jessica Venezia said French was convicted of aggravated rape, assault and battery and breaking and entering in January 2002. He was sentenced in Middlesex Superior Court to eight to nine years in prison and was recently released after serving eight years. He is registered as a Level 3 sex offender.

He was placed on a GPS ankle bracelet on Feb. 16 for one year after authorities alleged he violated his probation. As part of his release, he was supposed to remain alcohol and drug free.

I think the big problem here is that no Level 3 sex offender s/b on the street...if it's not days, weeks or months before they re-offend, it will happen again sooner or later.

French was on probation & violated it by failing a drug test (non-violent offense)....had he violated probation with a violent offense or sex offense (like indecent exposure, etc), perhaps they'd have put him back in prison.

My point to kbl was that he wasn't on parole (because he served his time & was not released early on parole), but probation....their violations aren't handled the same.

Level 3 offenders for the most part are perpetrating their crimes on women & children...if male lawmakers & judges were being raped, IMO, stiffer penalties would be enacted & applied by law, and Level 3 offenders would be kept locked up.

ETA: I also can't verify that Framingham has any residence restrictions for Level 2/3 offenders....I'll have to find the link again, but apparently he did live close to the high school that can be seen via google maps close to his mom's/stepdad's home.....that's just wrong too that dangerous pervs don't have restrictions for that.

French is registered as a level three sex offender, and the home is just yards away from a school. Now French is under arrest again, according to prosecutors, for cutting off that GPS and then raping another woman. According to a gentleman who said he was French's stepfather, French had been living in the Framingham home and working temporary labor jobs.

Oscar Goudey/Suspect's Stepfather: "I have known him since he was four years old. I guess he blew off the handle when they decided to put one of those leg bands on him and he couldn't handle it anymore."

That young woman, speaking in Middlesex Superior Court on Tuesday after French pleaded guilty to the rapes, said those attacks changed her forever.

Judge Diane Kottmyer sentenced French to 25 to 30 years in prison...

French has continued his criminal ways. In 2011, he kidnapped a Worcester County jail employee and tried to rape her. He also committed assault and battery on a jail guard. He pleaded guilty to those charges in Worcester Superior Court and is serving 10 to 15 years in prison.
