<snipped> Casey Anthony's defense team is trying to get some potential evidence thrown out in in State's capital murder case against their client.
Remember the frantic 911 call made by Casey's mom Cindy back in July 2008? "There's something wrong. I found my daughter's car today and it smells like there's been a dead body in the damn car," Cindy Anthony told a 911 dispatch operator. Casey's lawyers are asking the judge to throw it out so, so a jury could never hear it. The defense's argument, that there was not an emergency at the time the call was made. The defense argues that 2 year old Caylee had already been missing for 31 days. Therefore, they argue the call is neither spontaneous or reliable.
That's not all the defense doesn't want a jury to see. Remember the photos of Casey partying. The defense says only the pictures captured of Casey wearing a blue dress were snapped during the time that Caylee was missing. According to the photographer, pictures of Casey partying in that blue dress were taken June 20-21 at Fusion night club. That was less than a week after Caylee was last seen alive.
The defense also asks the judge to throw out all "hear say" statements between Casey's friends and family. The defense categories those into hearsay that would categorize Casey Anthony as a thief, a liar or a bad mother.
The defense has asked that the state respond to these motions within one month. *More at link!

<snipped> The defense team claims many of the the pictures were taken before Caylee disappeared and have no relevance to the case.
Anthony's attorneys said the images of Anthony as a so-called "party girl" only serve to "vilify" her to the public. They also want Cindy Anthony's 911 call thrown out, in which she claimed her daughter's car smelled "like a dead body" had been inside it.
Strickland has not yet ruled on the motions.
Also on Tuesday, Casey Anthony's legal team finished deposing three investigators who have worked on the case.

<snipped> Casey Anthony’s defense attorneys want pictures showing their client partying thrown out of the case. Attorneys say a jury should not see the photos of Casey, because they claim the pictures were taken before her daughter, Caylee, disappeared.
The defense also filed two other motions.
One involves a 911 call made by Casey's mother, Cindy Anthony. In the call, Cindy told a dispatcher her granddaughter was missing and it smelled like there had been a dead body in Casey's car.
The third request involves testimony about Casey's character after several witnesses said she could not tell the truth. WFTV.com is working to obtain the motions and will post them as soon as we can.
Casey Anthony is considered to be indigent Clerk of Courts finds she meets the guidelines.

<snipped> Casey Anthony is considered to be indigent by the Orange County Clerk of Courts, according to documents filed this afternoon. This is the first step needed for Casey Anthony to get state financial help to pay for her defense. Her indigent status allows her access to certain costs, such as hiring expert witnesses and investigators. However, Orange Circuit Court Judge Stan Stickland will have to approve these costs.
Casey Anthony filed documents last week, saying two of her attorneys have run up a $112,000 bill for their work. In the motion, Casey Anthony claims she doesn't have enough money to pay for her defense. She has no income, no savings and no assets. Experts say this is not an uncommon request in complicated death penalty cases.

<snipped> Kealing also explained the state’s position: “The photos taken while Caylee was missing, investigators have argued, show that Casey was not looking for her missing child and not overly concerned about [Caylee's] welfare or whereabouts.”
The defense also wants Cindy Anthony’s911 call kept out of the murder trial as part of “a motion to exclude hearsay evidence, gossip and innuendo,” Kealing said.
WFTV’s Salt said a defense motion seeks “to keep testimony about Casey’s character out of the case.”
