More Evidence To Be Released Wednesday

The Orange County Clerk of Courts has declared Casey indigent. This means taxpayers' money will now be used to pay for her defense. The declaration still needs final approval from a judge.

The ruling means under state laws, her attorneys will receive $15,000 of taxpayer money for the case. It also means attorneys can also request as much as $100 an hour extra for "extraordinary efforts." Should her legal counsel want to bring in forensic experts, the state will pay an average of $150 per hour. Those costs are for the defense and do not reflect the average capitol murder case costs that taxpayers shuck out, which is more than $1 million to prosecute.

Also, on Wednesday, it's expected the State Attorney's office will release new documents in the case. WESH 2 News is being told the documents include DNA charts among other evidence in the case. The state has released 12,000 pages of discovery, so far.

More new evidence has been released against Casey Anthony, but good luck figuring out what it all means. Florida prosecutors released nine new DVDs loaded with new information Wednesday.

News 13 was not immediately able to access all the files, but the ones we could view were all related to DNA test results. The files included charts showing measurements on a chromatograph, a laboratory technique for separating mixtures. The problem: There was no explanation to go along with the charts. So unless you&#8217;re an expert, the graphs appeared to have no context.

The state Attorney&#8217;s Office reportedly had similar problems accessing all the files.

Ten discs containing information that could be used in Casey Anthony's trial were released Wednesday morning. All of the files require proprietary software and only some of the files would open for WFTV. Sources told WFTV that the State Attorney's Office and the defense had similar problems actually accessing the files.

The files that did open are charts that would require an expert to decipher.
In addition to problems with the files, the files that did open lack any labeling that would explain who the charts relate to, for instance Casey or Lee.

WFTV is working to make more sense of the evidence that was released and will report new details throughout the day.

Casey Anthony says she is broke and can no longer afford to pay to defend herself against the murder charges she is facing. Late Tuesday night, the Orange County Clerk of Courts agreed and declared her indigent. However, criminal defense attorney Chris Smith says that should be the least of anyone's worries. &#8220;The real concern is they did this case and it wasn't prepared properly and has to be tried all over again. I think that's where everybody's real concern should be,&#8221; said Chris Smith, criminal defense attorney.

Smith says taxpayers should not worry about that too much, because every dollar spent on indigent defendants is closely monitored by the Justice Administrative Commission in Tallahassee. &#8220;You have to go through a very intense process to get every cost approved prior. You&#8217;re going to have to go and get it authorized to get paid subsequent. So they get two hearings,&#8221; explained Smith. &#8220;The justice administrative commission doesn't give up its money very easily. They&#8217;re going to file a lot of motions [and] fight for every dime.&#8221;

Before their client was declared indigent, Casey&#8217;s attorneys were not required to disclose how much money was being spent. Now, everything becomes public record.

Casey Anthony will be back in court next week to discuss how much the state will pay to assist in her defense.

A hearing is scheduled for March 18 at 11 a.m. before Orange Circuit Court Judge Stan Strickland.

Nine CDs of evidence in the first-degree murder case against Casey Anthony that were released by the state this morning contained no bombshells.

In fact, the dozens of files included in the nine CDs &#8212; all related to DNA test results &#8212; are incomprehensible. There is no context to the charts and graphs that are among the files. A DNA lab report or case file is needed to understand what the samples are being compared to and where they come from. Among the items are DNA tests results and measurements from electropherograms, which shows DNA sequencing.

Mitchell M. Holland, the director of the forensic science program at Penn State University, said he hasn't seen the information but not much could be gained by looking at the charts alone. He could see if DNA was actually detected but he would have no context. He would need the lab's report or case file to determine if the state's findings are consistent with the data.

The Orange County Clerk of Courts has declared Casey Anthony indigent. The determination, which was made on Tuesday, means that taxpayers will likely pay for her defense costs going forward.

Meanwhile, new prosecutors are preparing to release new evidence in Casey's murder case. She's accused of killing her 2-year-old daughter, Caylee Anthony, in 2008.

Casey has already paid her two lead attorneys roughly $110,000.

ABC Action News.com will have details about the new evidence later today.

A hearing has been scheduled to decide whether Casey Anthony is indigent.

If Judge Stan Strickland grants Anthony's defense's motion, taxpayers will foot the bill for the defense's cost to defend her in her death penalty murder case.

Strickland will hold the hearing at 11 a.m. on March 18.

The Orlando Sentinel reported that the Orange County clerk of courts has ruled that Anthony meets the guidelines to be considered indigent.

Meanwhile, dozens of DNA test results were released by the state attorney's office in the murder case, although the items contain no new information.

DNA test results were released by the state in an electronic format on Wednesday. Anthony's defense team has already received DNA test results in written form. With the electronic format, Anthony's defense attorneys can now make their own judgments on the information.

Nine discs of new evidence were released in the case against Casey Anthony Wednesday morning. The CDs feature DNA charts and graphs with no explanation, and no new photos or documents.

One defense attorney said the discs contain some kind of DNA standards requested by the Anthony defense team. The data on the discs requires special software to view.

The mess began to unravel July 15, 2008 when the family's matriarch, Cindy Anthony, called 911(#1) and reported Caylee missing. A frantic Cindy told dispatchers that she wanted to press charges against her daughter, Casey, for stealing her car and money. Cindy Anthony said in the calls that Casey admitted that Caylee had been missing a month.

In yet another call to 911(#2),the grandmother and ex-nurse told authorities that Casey's car smelled like there was a dead body inside. "There's something wrong," Cindy Anthony told the dispatcher. "I found my daughter's car today, and it smells like there's been a dead body in the damn car."

FOX 35 is getting new discovery in the case against Casey Anthony . We&#8217;re expected to learn several new developments this week. Sources say a lot of the information will be DNA related.

Anthony&#8217;s defense team has been deposing witnesses this week, including some Orange County Sheriff's detectives.

Also, the ball is rolling to declare Casey Anthony indigent. That means the state would pick up the tab for her defense. The clerk's office already signed off on the first step, but being officially declared indigent typically requires a hearing.

Based on an affidavit that Anthony filled out, Orange County's Clerk of Court Lydia Gardner late Monday declared Anthony indigent.

Judge Stan Strickland must now give the declaration his approval. Anthony's defense would then be able to apply to the state to help recoup costs.

Also added to the court file on Wednesday was a letter from a citizen in Fernandina Beach encouraging Strickland to decline Anthony's request and appoint a public defender to her case.

Defense attorney Jose Baez said Anthony has given full financial disclosure. She also signed a form detailing how she has no money to mount a defense. Gardner made the indigency declaration based on the form.

"It's the most vague and superficial affidavit you can possible have," Attorney Richard Hornsby said.

Before Anthony qualifies for public funding, Hornsby said Strickland needs to probe much deeper than the one-page form.

"I've got to think that Judge Strickland is going to make Casey Anthony and Jose Baez make a full disclosure of how much he was paid, who brokered the deal, who managed the funds, where the funds have been sitting since Casey Anthony has been in jail," Hornsby said.

The state&#8217;s release of DNA results today in the Casey Anthony case wasn&#8217;t that big a deal, TV reporters seemed to agree on noon newscasts. That development undoubtedly was a letdown for anyone following the case closely.

&#8220;We&#8217;ve already reported on the FBI lab&#8217;s take on this DNA evidence, which does not show Casey&#8217;s DNA on any of the evidence recovered from the scene where her daughter body&#8217;s was dumped and later found in December 2008,&#8221; WKMG-Channel 6&#8217;s Tony Pipitone said.

But WKMG&#8217;s Pipitone provided some clarity.

WESH reporter Bob Kealing said the released discs were a hodgepodge of information with little supportive information. An attorney Kealing consulted said the discs seemed to to be DNA testing results. &#8220;But there&#8217;s really nothing to tell us more than that,&#8221; Kealing added.

WFTV legal analyst Bill Sheaffer predicted the defense will have trouble trying to keep Cindy Anthony&#8217;s 911 call out of the murder trial. It&#8217;s the call in which Cindy, Casey&#8217;s mother, said it smelled like a dead body was in Casey&#8217;s car. Sheaffer said the call could come into evidence if Cindy testifies that the car smelled like rotting pizza.

Sheaffer also predicted that photos of Casey Anthony partying after Caylee&#8217;s disappearance will prbably be part of the trial. &#8220;It shows her [Casey's] state of mind,&#8221; he said.

A hearing next Thursday will determine if Anthony is indigent, WFTV reported.

WESH&#8217;s Kealing said the issue will be how much Judge Stan Strickland will make Anthony reveal about her finances beyond an affidavit she signed saying she had no money. She signed that affidavit after spending more than $100,000 &#8212; from a mystery source &#8212; on her attorneys.

&#8220;It&#8217;s the most vague and superficial affidavit you could possibly have,&#8221; said Orlando attorney Richard Hornsby, who does analysis for WESH. &#8220;I&#8217;ve gotta think that Judge Strickland&#8217;s gonna make Casey Anthony and [defense attorney] Jose Baez make a full disclosure of how much she was paid, who brokered the deal, who managed the funds, where the funds have been sitting while Casey Anthony&#8217;s been in jail.&#8221;
