Documents: Mother Wanted Medication When Told Caylee's Body Found
Casey Anthony Charged With Murder In Daughter's Death
POSTED: Wednesday, February 18, 2009

ORLANDO, Fla. -- New documents released by the state attorney's office show that Casey Anthony hyperventilated and asked for medication when she was notified that her daughter's body had been found in December.

Along with a skull and bones, investigators found a stained Winnie the Pooh blanket, pink-and-white-striped shorts and a shirt that said "BIG TROUBLE Comes Small" in the woods at the crime scene. The skull had duct tape over the mouth similar to duct tape found at the Anthony house and the remains were found in a laundry bag and plastic bag that also were similar to ones found at the home, according to the documents.
Marti Mackenzie, a spokeswoman for Casey Anthony's attorney, Jose Baez, said in an e-mail that the detectives' reports were "biased and speculative."
In a statement, Baez and defense co-counsel Linda Kenney Baden said that the brand of duct tape was the most widely sold in the United States and that it was significant that no fingerprints were found on the duct tape.

Baez responds to discovery

Released February 18, 2009
Regarding discovery released by the State of Florida (State of Fl v. Casey Anthony) . . .
According to defense lawyers for Casey Anthony, the States forensic report on duct tape, plastic bags and other items is a one-sided law enforcement-generated report and is biased and speculative. It uses junk science, the kind of flawed comparative analysis that the two-year study by National Academy of Sciences released today.
This study--"Strengthening Forensic Science in the United States: A Path Forward by its Committee on Identifying the Needs of the Forensic Science Community, released today and the subject of a public briefing scheduled for 1:00 p.m. EST.
The New York Times, CBS 60 Minutes and the Washington Post have all recently weighed in on flawed forensics evidence (see below).

Defense co-counsel Linda Kenney Baden says:
Were looking closely at the NAS report. Comparative forensic analyses like those in this discovery are conducted by law enforcement agencies with no independent oversight. Our defense experts will make sure there is an objective analysis of this biased discovery. The Anthony case may be one to set a precedent in exposing the flaws in evidence that only law enforcement has tested.

Baden addressed the duct tape evidence detailed in the legal documents: "Not only is this brand of tape the most widely sold in the United States, the State is relying on comparative analysis just like comparisons exposed as flawed in the study of bullet lead in 2004. These chemical studies have put hundreds of innocent people in jail."

Caylee files reveal details about duct tape, Pooh blanket, car trunk
February 18, 2009

<snipped>
(CNN) -- Police believe 2-year-old Caylee Anthony was slain within days of the time she was last seen in June, and that her body was in the trunk of her mother's car for "a period of time," according to documents released Wednesday.
A supplemental report contained in those documents says that police believe Caylee was killed between June 16, the day the toddler was last seen, and June 27, based on evidence found in the car as well as evidence found with the child's body. Evidence also suggests "the body of Caylee Anthony was in the trunk ... for a period of time but removed prior to June 27, 2008," the report says.

"Evidence on the body suggests that the child's death was not accidental but an intentional act," Orange County Sheriff's Detective Yuri Melich wrote on a Feb. 5 report included among the documents. "As of this writing, there is nothing to suggest that anyone but Casey Anthony is responsible for the death and disposal of Caylee Anthony."

One friend told investigators that 22-year-old Anthony complained about having a bad relationship with her father, George Anthony. And her parents had considered getting custody of Caylee, the report said.
Anthony once caught her mother, Cindy Anthony, sending e-mails under her daughter's name. The two argued about it, but Cindy Anthony told her daughter, "if this can find us Caylee, then you know I'm going to do whatever I can."

Anthony Investigator Searched Site Where Remains Were Found

ORLANDO -- A judge ruled an interview between deputies and a private investigator for the Anthony family could be released Thursday. This transcript was kept out of the public spotlight until Judge Stan Strickland ruled the release would have little impact on the case.
More than 500 pages of forensic reports were released Wednesday in the case against Casey Anthony.
The reports from the Federal Bureau of Investigation and the Orange County Sheriff’s Office document evidence collected at the crime scene and at the Anthony home.
Among some of the biggest finds; investigators said the duct tape found wrapped around the skull of Caylee Anthony matched Henkel brand duct tape stuck on a gas canister at the Anthony’s home.

Meanwhile, lawyers for Casey Anthony released this statement Wednesday. “The State’s forensic report on duct tape, plastic bags and other items is a one-sided law enforcement-generated report and is biased and speculative. Transcript: Psychic Tip Prompted Caylee Search
Interview With Former Casey Anthony PI Released

A court on Thursday ordered the release of detectives' interview with Casey Anthony's former private investigator, who searched an area near where Caylee Anthony's remains were later found.
In his order, Circuit Court Judge Stan Strickland released one of the two interviews that Dominic Casey had with investigators.

Casey searched an area on Suburban Drive in Orange County a month before Caylee's remains were uncovered in December 2008.
Casey said he was in the area because of a tip and not because of any information he received from Casey Anthony or her family. Casey also confirms he spoke with a psychic that day, who said she felt Caylee's presence in the neighborhood where the Anthony family lived and where Caylee's remains eventually were found.

UPDATED: Judge releases transcript of interview with Caylee investigator

An ABC producer paid for George and Cindy Anthony to stay at one of Central Florida's most expensive hotels for three days in December after their missing granddaughter's remains were found, according to newly released testimony. The couple stayed at the Ritz-Carlton Orlando Grande Lakes from Dec. 11 to Dec. 14 after Caylee's remains were found near their home. The company that footed the bill is owned by Disney. The producer, a woman named Kaitlyn Folmer, made arrangements with then-Anthony spokeswoman Michelle Bart to put up the couple and two of their investigators at the hotel. Rooms at the hotel can cost between $249 and $739 per night, depending on the level of luxury.

Included in the transcript were details of the Anthony family's activities the hours and days following the discovery of Caylee's remains. Casey was interviewed by Orange County sheriff's Sgt. John Allen and FBI Agent Nick Savage on Jan. 7 at attorney Brad Conway's Orlando office. Conway represents George and Cindy Anthony. Strickland reviewed a second interview, also taken on Jan. 7, but hasn't determined whether it should be released.

Anthony P.I. Gave Conflicting Statements To Investigators
Thursday, February 19, 2009 – updated: 1:04 pm EST February 19, 2009

ORANGE COUNTY, Fla. -- The Anthony family's private eye, Dominic Casey, gave conflicting statements to investigators under oath about what he was doing at the scene a month before Caylee Anthony's remains were found there and he was being represented at the time by the Anthony family's attorney.
The Anthonys' private eye also told investigators, under oath, that he did not know he was being videotaped by another private investigator, Jim Hoover, although at times it looks as though he's being videotaped from close up. Mr. Casey called Hoover a "sneaky devil."
The statement was the first Dominic Casey gave to investigators. There's a second one that the judge hasn't decided whether to release yet.

Casey Anthony Remains Jailed In Death Of Daughter

Casey also admitted to investigators -- as did Brad Conway, the attorney for George and Cindy Anthony, who was present during the interview -- that a producer with ABC-TV was with George and Cindy Anthony the night Caylee's remains were found, the transcript said. Caylee's grandparents returned to Orlando from Los Angeles after appearing on "Larry King Live" on CNN and stayed at the Ritz Carlton, which was paid for by ABC-TV, according to the transcript.

Speculation suggests that a diary entry saying "Every Day Is A Brand New Beginning" and Casey Anthony having no regrets and being happy were written shortly after Caylee was last seen alive.
Records show that on June 21, 2008, the Saturday after Caylee disappeared, Casey Anthony's cell phone did not ping any cell towers near the Anthony home. All pings were from Winter Park, where her then-boyfriend lived. Also, Cindy Anthony told investigators that she was home that day and Casey Anthony was not, saying she was in Tampa.
Phone records show Casey Anthony made or received six phone calls that day but was not near the home, meaning the entry was likely not made there.

Report: Tape Shows Anthony's Consciousness of Guilt

ORLANDO, Fla. -- Investigators arranged to videotape Casey Anthony's reaction in jail when she learned that a child's remains were found near her family's home, a source told WESH 2 News exclusively on Thursday. Anthony doubled over twice and appeared to hyperventilate, according to the source who has seen the tape. The remains, which were later identified as Caylee's body, were found by a meter reader in a wooded area off of Suburban Drive near the Anthony family home.

WESH 2 News reporter Bob Kealing reported Thursday that Casey Anthony was purposefully taken to a jail nurse's station in December and seated where she could see breaking news coverage on TV about the child's remains. A video camera documented her reaction, a source said.

Casey's Reaction Videotaped When Told Remains Were Found
Thursday, February 19, 2009 – updated: 6:03 am EST February 20, 2009

<snipped>
We found out on Thursday that her reaction had been videotaped. Investigators apparently asked that her reaction be documented. There is no information on when the video is expected to be released. New documents released in the case raised new questions over why Casey’s private investigator went to that scene the month before.

He also revealed that as of September, he had also been working for Casey Anthony, but he denied getting any inside information from her that would lead him to that scene in November.
Dominic Casey sometimes dodged questions and contradicted himself. He told detectives he did not call them to conduct the search because if Caylee was in the area, she should be found in a "respectful manner.” That’s even though during his search, he repeatedly thrust a metal rod into the ground. The statement was the first Dominic Casey gave to investigators. There's a second one that the judge hasn't decided whether to release yet.

Casey Anthony case: WESH says tape shows she doubled over, hyperventilated when remains were found
posted by halboedeker on Feb 19, 2009 6:49:38 PM

The Casey Anthony case was raining bombshells Thursday.
Dominic Casey, a private investigator for the Anthonys, was the focus of other reports. Three times the private eye had visited the spot where Caylee's remains would be found a month later.
Dominic Casey "flat out denied that he found Caylee's remains here in November," Belich said. "Someone told him not to call 911 if he ever found Caylee's body. Secretly, he told investigators who that was. Publicly, on the record, he said it was not anyone from the Anthonys' home or anyone working for the Anthonys. Another mystery," Belich said with more sarcasm.

In other news:
WFTV's Salt said that today Casey Anthony had her first visit by her defense team in 10 days. WFTV also reported that another thousand pages of evidence will be released next week.

WESH asked who is Annie Downing? WESH's Amanda Ober said Downing could be a major witness against former friend Casey Anthony. Downing went online today and described her mood as "triumphant," Ober said.

ABC producer treats Anthony family to Ritz-Carlton stay

The couple stayed at the Ritz-Carlton Orlando at Grande Lakes from Dec. 11 to Dec. 14 after Caylee's remains were found near their home, and Disney-owned ABC footed the bill, the Anthony family's private investigator, Dominic Casey, told investigators.
Dominic Casey offered those new behind-the-scene details during an interview Jan. 7 with Orange County sheriff's Sgt. John Allen and FBI Agent Nick Savage.
A Good Morning America producer, Kaitlyn Folmer, made arrangements with the Anthonys' then-spokeswoman Michelle Bart to put up the couple and two of their investigators at the hotel, where rooms can cost between $249 and $739 per night.
Folmer allegedly told the Anthonys and the private investigators that she was not there to get a story.
"She never talked about money. She never talked about pictures, videos. She did make the point to say . . . 'You know there's no ulterior motive here. We're, we're just doing this,' " Dominic Casey said. "I'm like, 'Yeah, right. I can believe that one.' "

This afternoon, Marti Mackenzie, spokeswoman for Anthony's attorney Jose Baez, released a statement via email.
"It is outrageous and cruel that they were standing by to record her emotions," Mackenzie said. "Let's call this the latest in a 'tape and release' strategy that the Sheriff's Office seems to have used since Casey was first arrested. Even if it's not their primary motive, the release of this kind of information has to have an influence on viewers and readers. Just look at the blogs."

The Orange County Sheriff's Office refused to release a copy of the videotape to the Sentinel, saying it was evidence in an ongoing criminal investigation, said Deputy Carlos Padilla, a sheriff's spokesman. If the tape is turned over to the State Attorney's Office as part of the prosecution's case, it could then become a public record.

Judge: PI’s interview not privileged

Casey swore to investigators he saw nothing. Detectives asked what he would do if he found Caylee.
"I wouldn't have moved,” Casey told them. “I would have said a prayer. I would have called 911, and I would not move from that spot."
Casey went on to say George and Cindy Anthony agreed, that's what he would do.
The reason the latest documents came out detailing Casey’s interview is because Jose Baez filed a motion asking a judge for a special master of the court to be present for the Dominic Casey interview. Baez wanted to make sure Dominic Casey did not violate PI client privilege, because the Casey once worked for Baez.
The interviews took place on January 7th.
A judge released the transcripts Thursday, because he ruled that Dominic Casey did not violate any client privilege during the interview.

Marti Mackenzie, the spokeswoman for Jose Baez, released a statement that said:
"It is outrageous and cruel that they were standing by to record her emotions. Let's face it, there is nothing 'normal' about anyone's response to losing a child. Everyone handles personal tragedy in an individual way. Let's call this the potentially latest in a 'tape and release' strategy that the Sherriff's (sic) Office seems to have used since Casey was first arrested. Even if it was not their primary motive, the release of this kind of information alone has to have an influence on viewers and readers. Just look at the blogs. In fact, it's also a concern that many so-called experts who publically (sic) evaluate Casey's reactions and often seem to advance the prosecution's theories of guilt."

According to Local 6 News, once detectives realized that the body likely belonged to Caylee, investigators developed a plan to capture Anthony's reaction on videotape. Anthony hyperventilated and requested medication after hearing the news of the discovery, according to documents released by authorities earlier this week. Local 6 has been told that the video of Anthony's reaction could be used to show that she had a consciousness of guilt before anyone knew that the remains were that of her daughter.

UPDATED: Contradictions Abound In Private Eye's Taped Interview
Friday, February 20, 2009 – updated: 6:06 pm EST February 20, 2009

<snipped>
ORANGE COUNTY, Fla. -- In the case against Casey, Friday was the first time the public heard the contradictions and conflicting statements all from a taped interview between detectives and the Anthony family's private eye.
The Anthonys' private eye claimed he didn't expect to find anything based on a psychic's tip, but still searched there at least three times. He said, at the time, he was working for the Anthonys and separately also for Casey Anthony.
The reason the Anthonys' private investigator searched the scene in November, on videotape, where Caylee's remains were later found is not any clearer after listening to what he told detectives under oath.

"What initially could've been a sideshow has become and remains one of the key issues in this case. What was he doing there? Who sent him there?" WFTV legal analyst Bill Sheaffer said Friday.
Even though the physical evidence against Casey Anthony is mounting in the first-degree murder case, Sheaffer said it's still a circumstantial case without any eyewitnesses, so any possible link between Casey Anthony and the crime scene is crucial.

ORLANDO, Fla. -- Casey Anthony's defense attorneys said Friday that it was "outrageous and cruel" for officials to videotape their client's reaction to news that a child's body was found near her home.
"Let's face it, there is nothing 'normal' about anyone's reaction to losing a child," Anthony's defense attorneys said in a statement. "Everyone handles personal tragedy in an individual way."

The reaction comes a day after WESH 2 News reported that investigators brought Casey Anthony to an Orange County Jail nurse's station in December and seated where she could see breaking news coverage on TV about the child's remains. A video camera documented her reaction, a source said.

Videotaping of Casey Anthony's reaction: Weigh in
02/22/09

<snipped>
Orange County Jail officials reportedly videotaped Casey Anthony's reaction to the news that a child's remains had been found near her home. What do you think of their actions?

1.) They were right to record her reaction. It could be useful in her trial.

2.) It was wrong. She's innocent until proven guilty and still has a right to privacy.

3.) I'm not sure if it was right or wrong, but I'm eager to see the tape.

4.) This case is getting too much attention, and I have no interest in seeing the tape.
