Defense plans to rest next week in Casey Anthony trial

ORLANDO -- After the defense rests, the prosecution will have a chance to call more witnesses for rebuttal. Assistant state attorney Linda Burdick told the judge she expected that to take no longer than one to two days.

The judge said he would give an order governing closing arguments later. The defense had requested the possibility of each attorney giving a closing argument.

When I stare at that blank face of Casey Anthony, I peer into something that —if she did it — is as frightening as it is strange: a lack of remorse, an absence of conscience, an inability to understand the stakes.


In case you’ve spent the last month under a rock, Anthony, 25, of Orlando, is charged with the 2008 murder of her 2-year-old daughter, Caylee. That simple summary, however, doesn’t begin to convey the carnival atmosphere surrounding the trial.

The Anthony case has all the ingredients for a prime-time soap: lies, treachery, dysfunctional family ties and the threat of a death sentence. The characters, too, are captivating in their own creepy, middle-class, middle-of-the-road way. The inexpressive Anthony is photogenic, the girl next door scrubbed free of innocence; her murdered daughter was an adorable tot whose smile tugs at the tightest heart strings.

Add to that mix dueling expert witnesses, tongue lashings by an irascible judge, accusations of incest, a love-hate relationship between the defendant and her mother, a defense-team contention that the little girl drowned in the family pool — and, voila, instant blockbuster.

Geraldo: Jose Baez who expressed deep frustration over what he believes to be rulings from the bench that limit his ability to make the abuse argument, however implausible. He also told me he expects to wrap his case by Wednesday, which with the prosecution’s rebuttal case means this will not be over until after the July 4 holiday.

How the sequestered jury is going to react to the blown holiday will be interesting to see.

I also spoke to prosecutor Jeff Ashton, who just told the judge as court was recessing for the day that he needs a full day for closing arguments and that he “thinks he can keep the jury awake.” Stay tuned.

Day 28 of the Casey Anthony murder trial ended with no witness testimony.
Judge Belvin Perry announced around 9:45 a.m. that a legal matter separate from the issues discussed earlier in the morning forced him to recess for the day.

At the beginning of the day, prosecutor Jeff Ashton requested a full Richardson hearing regarding the testimony of defense witness Dr. Kenneth Furton.

As court concluded on Friday, Baez accused Ashton of prosecutorial misconduct and asked for a mistrial.

Baez accused Ashton of calling defense witness Robert Rodriguez's supervisor at the Department of Defense, prompting Rodriguez to be told he would lose his job if he testified. Ashton said Rodriguez's supervisor contacted him, and both sides agreed to let Rodriguez go home.

ORLANDO, Fla. — The Casey Anthony trial is on hold until next week.

Judge Perry announced that court would adjourn until Monday. He said a “legal matter” had come up.


Outside the courthouse, neither side would comment on the reason for the early dismissal. The Orlando Sentinel reports that defense attorney Cheney Mason shouted at the throng of reporters to get out of his way.

Casey Anthony's murder trial was unexpectedly recessed only 45 minutes after it was supposed to start.

Casey and her attorneys gathered in Judge Belvin Perry's chambers. Casey eventually walked back into the courtroom, clearly upset, and began tearing up and dabbing her eyes with a tissue.

After about 45 minutes, Judge Perry walked back into the courtroom and said that due to an unrelated legal matter, court was recessed until 8:30am Monday.

In an online posting Friday, Rivera described having lunch with defense lawyer José Baez, who "expressed deep frustration over what he believes to be rulings from the bench that limit his ability to make the abuse argument, however implausible."


Rivera also shared details about the Baez lunch with Juan Williams on "The O'Reilly Factor" television show.

He observed: "He [Baez] wanted that jury to know that those parents feared Lee Anthony was the father of that child. That's why they didn't want him involved in the baby's birth. That's where he was going. The judge stopped it."
On Friday, when objections were raised, Perry did stop Baez from inquiring about marital problems between Cindy Anthony and husband George. He also stopped a line of questioning about why Lee Anthony had, in Baez's words, "blocked" out his sister's pregnancy. The brother had earlier expressed how hurt he felt about being excluded from what was going on with Casey during that period.

Baez wouldn't get into details about what happened in court so far, but he did say he believes the government has invested a lot in prosecuting Casey Anthony.
He also talked about the perks he's received while handling such a high profile case.

And Baez went on to explain that so much attention detracts from the seriousness of the death penalty case against Casey.

Baez said in Spanish: "This is why we're defending her. I believe in my clients. I trust them, if not, I won't work with them."

"The advantage is that it has attracted several opportunities for publicity and media relations."

Baez gave this interview DURING the Defense case in chief of the murder trial of Casey Anthony.

Whether Casey Anthony testifies or not, legal analysts, trial observers and mental-health experts agree the defense team must try to explain her behavior and her raft of lies in the wake of her daughter's death.


Lori Butts, a forensic psychologist from Davie who also holds a law degree and does criminal-case consultations. Such traits are "what makes a psychopath."

"They get themselves caught up in their lies," Butts said. "She creates her own reality."

She doubts Anthony, 25, is mentally ill, however, because she's too lucid, precise and logical.

Butts noted the difference between "mad and bad" prevaricators. Earlier in her career, Butts worked with women who killed their children. They were psychotic, and their delusional minds caused breaks with reality. They were insane, she said.

Sociopaths, on the other hand, lie "to get over" for their own advantage, Butts said. They're just bad.

"They're lying in order to get what they want, whether it's attention or money," Butts said. "In this instance, it's to hide the fact that her daughter is dead."
