In an unusual move Wednesday, homicide suspect Brian Horn filed two handwritten motions attempting to take the death penalty out of consideration if he is convicted in the death of a 12-year-old Stonewall boy.

Horn, 37, of Keachi, filed the motions pro se, meaning he filed them on his own and without the assistance of his court-appointed attorney. Horn wanted the judge to declare the death qualification process a violation of the political and constitutional rights of the potential jurors and to prohibit the death qualification of the capital jury, District Attorney Richard Johnson said.

After gaining only 9 more prospective jurors at day’s end today for a DeSoto Parish capital murder trial, District Judge Robert Burgess will make a decision Monday on whether additional people should be summoned from East Baton Rouge Parish for jury duty.


The 9 bring to 29 the number of people remaining in the jury pool for general questioning in Brian Horn’s first-degree murder trial. A total of 80 people separated into five panels had been questioned as of tonight. Court is recessed for Sunday.Sixty people remaining from the original 300 summoned for jury duty will be told to return to court Monday morning.

Both the prosecution and the defense have rest their case in the capital murder trial of Justin Bloxom. When the defense gave it's closing arguments attorney Daryl Gold said "they (prosecution) proved that Brian Horn killed Justin Bloxom," but he also said that the prosecution did not prove that it was not an accident. The jury will begin deliberations after they eat lunch. https://www.facebook.com/KTBS3

"NEW ORLEANS (AP) — Louisiana's Supreme Court has overturned the first-degree murder conviction and death sentence of a man who prosecutors say lured a 12-year-old boy to his death in 2010 by sending text messages in which he pretended to be a teenage girl.

The court said Friday that Brian Douglas Horn's rights were violated when his lawyer conceded at the 2014 first-degree murder trial that Horn killed Justin Bloxom in DeSoto Parish....

According to the court record, the defense lawyer suggested that jurors find Horn guilty of manslaughter or second-degree murder, neither of which carries a death sentence. Horn objected to this strategy, the court said.


The justices cited a recent U.S. Supreme Court decision in another Louisiana case: a 6-3 ruling in favor of then-death row inmate Robert McCoy, who had repeatedly objected to his lawyer's decision to concede that McCoy killed two people in 2008.

Louisiana Chief Justice Bernette Johnson wrote Friday's unanimous state Supreme Court ruling, noting the McCoy case.

"While conceding guilt in the hope of avoiding a death sentence may be a reasonable strategic decision in some case, the decision to do so belongs to the defendant," she wrote....

Friday's ruling said the defense attorney conceded at trial that Horn killed Bloxom and that he molested or attempted to molest the boy. Horn disagreed with that strategy and made it known to the district judge before and during the trial, the ruling said..."

No trial date set or attorney assigned to convicted child killer in DeSoto Parish

"Convicted child killer Brian Horn has been moved to the No. 3 spot on the state public defender’s list for representation in a capital murder case -- but that doesn’t mean he’s any closer to having an attorney for his retrial.

DeSoto District Judge Amy Burford McCartney said she wasn’t prepared to appoint legal representation for Horn since she didn’t have a complete list of certified capital defense attorneys in front of her at Thursday morning’s hearing. The judge has set another hearing for Jan. 11 to take up the matter.

Until Horn is assigned an attorney a trial date cannot be set, McCartney said...."
