Swingle said the length of Clay Waller's sentence is unknown at this time, though it is not unreasonable to assume he will receive a sentence to which would be in a federal correctional facility outside the State of Missouri. Upon his eventual release from federal prison, if Clay Waller were to be charged with the murder of his wife, the time could span years.

I took it to mean that if he is charged with the murder of his wife, his release from federal prison would be years away.

Her cards were found along Hwy 177 which runs east from the exit (#105)near where her vehicle was found along I-55 (at the 104.8 north-bound). The cards were found about 6-8 miles from there. They finished searching along I-55 today, stating they found several items they believe belonged to Jacque.

In a very tragic side-note, there was a terrible traffic accident just north of the search area today. Two tractor-trailers collided, probably due to the traffic near the search site, and one of the truck drivers was killed.
 
Too pooped to google map the locations. Is HWY 177 rural Tbeldon, as in not many people travel it? Since you're local, what do these things say to you about his route? Is there any pattern to where the car and cards were found? I think you and I have discussed this before, but I can't remember what you told me.

Yes the cards were found in a rural area. Hwy 177 runs east from I-55 and ends at the Mississippi River about 3-4 miles past where the cards were found. Most people believe he was leaving a false trail with the cards. If he's the one that left the cards, it's like he was trying to point the focus toward the river.

Her purse was found during the search mentioned above. There was also another search headed up by CUE today in three different areas that LE had asked them to search. According to the article, nothing was found in these areas today.

Also in the news today Waller's attorney has again (for the 3rd time) asked for a change of judge to decide the issue of video-recording Waller's father's deposition.

BBM - Especially considering he was former LE - I too believe clues could like be a ruse.
 
It's a shame they couldn't have found Jacque's purse and camera sooner, but I understand about heavy weeds, briars and undergrowth, but my question is, why wouldn't the authorities have requested the state, or whoever does the mowing 4 times a year, to mow the area back in June when Jacque's vehicle was discovered? Why not go in with industrial weedeaters or whatever it took, to search that area?

One other thing....I don't think CW will voluntarily give up information on where Jacque is...if he doesn't then he would feel like he had the upper hand and that he had won. It would be his final revenge.

I pray they find Jacque so she can be laid to rest and her family can have closure. Praying for them!!!

My thoughts exactly! Even if the state wouldn't do it, there are lots of farmers around with equipment that would have done it, if someone had asked them!
 
Thanks tbeldon! I can't like your comment because I wish that there would be a video deposition, but I appreciate you following up and letting us know!! When will there be justice for Jacque?
 
If a wrongful death suit was filed, would the testimony be needed for that? Could they take a depo to preserve his testimony for a wrongful death case? Because that way the right to confront the accuser would still be there...

Or would that only apply in criminal cases?

Just wondering if that might be a way around this...

I have to go back and re-read a few stories, but if IIRC; the prosecuting attorney feels he either needs a body, or a certain amount of time needs to pass in order to file a murder charge against Waller.

He discussed other no body murder cases and the challenges of prosecuting them in another article. Jacque went missing 31 May. The length of time a person has been missing means something to a jury when you are asking them to convict a man of murder. The lingering doubt that she may have packed up and moved to the tropics somewhere with a hot guy, kinda thing.

IMO, they have enough to convict now. Jacque loved the trips, waited so long to have them, they were her world. She would never leave them voluntarily. The volume of blood found in that cut out piece of carpet and the splatter. The way he hid it and his explanation for how it got there, Jacque's journals and his threats towards her, the divorce filing, his confession to his Father and on and on. But would eleven other people agree with me?

I like MF idea of a civil case to use (preserve) Daddy Waller's testimony. Can someone expound on how that would work, given his upcoming Federal sentence in December?

"An initial sentencing report suggests six to 10 months in prison. Waller's attorney is asking for six months, minus the four-and-a-half months he's already served."

Hopefully if he isn't sentenced to anything longer than this, Jacque's body will be found and/or he will be charged with her death.
