Under Australian law, it only matters where the material was viewed. The jurisdiction is the area that is most likely to result in the greatest harm to the plaintiff. I was thinking more along the lines of ruling out that the cars seen were someone else.
 
Who cares, Gerard's broke a$$ has bigger problems ahead than taking thousands of people to court for expressing their opinions online.

That money would be better spent on his girls, and while he is at it he could man up and confess and save a ton of lawyers fees which he could also put into his daughters future.

How many Prados, Captivas and vehicles that look much like them are there in Brisbane's west and surrounding areas like Ipswich, should keep them busy for a while.IMO this investigation is going nowhere, the lab boys and girls are the one chance of cracking it.

I will be very easy for QPS to run a search on Motor Transport records of white Prados and silver Captivas within the postcodes of that area and start eliminating anybody who does not travel around that area during the specific times. Thank God for computers!

I am shutting this thread down until someone can spend the time to go through it.

I am not at all familiar with Austrailian law, nor do I understand the details of this case.

However, I have an obligation to protect this board, and that is what I shall do.

I can see a defense barrister having a field day with all this car stuff, how many other models of vehicle in the middle of the night could look like a Prado or a Captiva?

How far and wide are the Police going to cast their net?,I mean why just the western suburbs, why not the southside or even Gold Coast for that matter?

How many of the owners of these similar vehicles are going to have a rock solid alibi for there whereabouts on that particular night, how can we be sure none of them are the killer?

They would tear this to shreds.

This issue about defamation in Australia has nothing to do with this topic, which is about the murder of Allison Baden-Clay.

We do not have any verified Australian attorneys on Websleuths. On top of that, internet law is much different than criminal law, so one needs to consult an attorney that is well-versed in that law.

So that in my books is confirmation that a grey captiva has been
spotted on the round-a-bout cameras and possibly on the side of the
road, but they aren't able to positively identify it by number plate
or driver. (my guess is the smaller blue car in question)
Some people have suggested it had prestige personalised number plates
(vanity plates for the US people) which are not that common and should
be visible on a camera even if they letters weren't.

These number plates are probably on less than 1 in 1000+ cars in
Queensland. (maybe more), so they are probably have a list of all grey
captivas registered in Queensland with (whatever colour) prestige
plates attached, and have been working through (starting locally) if
anyone had driven that road on that night.

If I were the police (and I am sure they have already), I would be
requesting the entrance logs and security camera footage from a
certain building in Taringa. Since it is privately owned and a shared
occupancy, they should at the very least have a log of who entered and
exited the carpark.

In an apparent bid to clarify reported sightings and rule out various vehicles in the area, the woman was also asked whether she had recently pulled her car over to the side of Mt Crosby Rd.

And there you have it folks. the silver Captiva in all likelihood is the "smaller blue 4WD" seen on Thursday night/early hours of Friday morning. (19th-20th April) IMO. Seen in the dark, the silver Captiva IMO could look to be a blue colour. I never ever thought that the pranged car was the "blue car." JMO. Things are starting to hot up at last! :woohoo:

Yes, making it clear that they are trying to rule out cars owned by others before they proceed with the certainty that it is Gerard Baden-Clays car which was parked on the side of Mt Crosby Road. It's proof that they believe the relevant car is the Silver Captiva, and now just a case of making sure no one else was parked there. Should be easy enough to verify, as all drivers of those vehicles can be phoned, it's only a matter of time. IMO this is leading to the clear fact that he is the suspect.
 
A media *advertiser censored* your whole life? I've never seen him in the media before.(other than the you tube video and bRel estate blog that has recently come to light) But agree there is no proper way. and most of us thankfully will never have to be in the situation. Opinions on people are natural. But persecutions can get a bit much without yet factual knowledge of crimes comitted.
