GUILTY Australia - Kiesha Weippeart, 6, Mount Druitt, NSW, 18 July 2010 - #2

My theory of why they were pressuring Rob for answers about the deposits is because I believe the bank statements were part of the paperwork that was seized from the unit around the 5th August.
They wanted to hear his explanation, which obviously didn't sit well with the police so they put pressure on him during that interview, and when nothing came of that, they started the forensic audit.

In order to search inside their apartment, Police need to obtain a search warrant, and because income from an undisclosed source is significant in a missing child’s case, Police have a right to seize their bank records and demand answers.
 
I am surprised Robert and Kristi haven't hired a lawyer. Maybe they have but no one knows. They have been running away from their problems and hiding since Kieisha disappeared so I guess they will wait until charges are filed against them before they hire an attorney. JMO

If they are both on welfare, I doubt they'll be able to afford to pay for it themselves, so they'll probably get a taxpayer funded lawyer through legal aid.

Channel 7 news reported it on either 4th or the 5th August because my post about it is listed as the 5th August on this site (so depends on the time difference).

Then the following day there were two separate articles backing up that these items were taken. (p/work, vac, pc, etc)

Seems like they are removing a lot of previously public details from media sites. :waitasec: Don't know if that's because the info was proven to be false , or if they want certain details kept quiet.

Also I'm pretty sure that a house owner can give permission to search and seize by signing the appropriate paperwork (thinking of GA from the Caylee case here), but that even when given permission they will often cover all bases by getting a warrant after the fact.

.... not that I can really imagine K&R saying "Yeah, feel free to search and take whatever ya want. Our daughter is missing!! We want you to do anything and everything you can to find her. Our privacy is insignificant compared to Kiesha being missing".

When would Kristi and Robert be able to get help from Legal Aid? IMO, they needed a lawyer right after Kiesha disappeared since they don't have the experience or ability required to handle the media, public, or law enforcement on their own. They are under a great deal of pressure and suspicion due to the cash that was deposited into their account prior to Kiesha’s disappearance, so why don’t they have a lawyer?

Often when a child is missing, a sympathetic lawyer will step in and work pro bono, but AFAWK, no one has reached out to help them. Most of Kristi's and Robert’s comments and their inconsistent statements make me suspect they are involved in covering up a crime against Kiesha, and LE have named them as suspects. Although Police have not pressed charges against them, they are likely pending. Until then, Robert & Kristi have the right to remain silent, which could explain why Robert isn't talking about the cash deposits.

It does not look good for these two and they have two very young children to consider so they need a lawyer now because it looks like it is just a matter of time before Police arrest them for committing a crime against Kiesha.

It is odd that the family hasn't announced where those who wish to can donate money to aid them, especially since Robert is no longer employed and they have two young children. Normally families of missing children have T-shirts and badges made with their child's face on it to aid in the search for their child and that hasn't happened either.

I wanted to see this video again because I'm sure that K is actually smiling at the camera while she is sitting with R and the kids! She does nudge little B to get her to look at the camera. Of all the things I've seen and read about this case I find this video the most disturbing. Why, if your daughter had been abducted would you allow your other children to be filmed? Surely the thought that either B or L could also be abducted must have crossed the minds of K AND R? Obviously not! :banghead:

In regards to your comment about K&R, "Our privacy is insignificant compared to Kiesha being missing" I agree. If this was how they felt, Robert would have told Police where the cash came from IMO.

Thank you, butwhatif. And thanks to those who organized and attended Kiesha's vigil. What a beautiful and generous outpouring of love and support for Kiesha. It brought tears to my eyes when I viewed the pics.

Robert and Kristi make themselves look guilty for their daughter's disappearance by not attending her vigil. If they went, they would have been emotionally enriched and they could have taken their children. Yet they chose not to go and embrace the love, comfort, and support that was available to them so it would be blasphemous for them to later make a public statement through the media thanking everyone who organized and attended the vigil for their own daughter. Did Chris and Liz Weippart attend?

Kristi is lacking discretion and maternal instincts and it makes matters worse that her partner Robert Smith isn't helping her grow so the two of them should not be having and raising children together. They are a lethal couple. A man should work to protect his family and he stands by and doesn't object when his own children's safety and well-being are being compromised by their own mother. Robert is docile and that is not the type of man Kristi needs. There is no accountability between them so perhaps they should separate but don't or want because of their children. Kristi may not want to separate from Rob because she wouldn't be able to support herself. IMO.

Police don't always need a search warrant. In certain situations, they can search people and premises and seize items without a warrant. (There are legislative provisons in the Crimes Act 1900, the Summary Offences Act 1988 that allow it under certain circumstances.) I'm not saying that's what happened, I'm sure the police did get a warrant, but I just thought I'd mention that.

They can also get Aboriginal legal services representation which is the same as legal aid, but only for aboriginals and TSI's, so they're pretty well covered.

IMO ,they'd have to be pretty stupid not to have an atty at this point, especially when they can get it for free. Even the phone call is free.

I think once someone is charged they are then given lawyer through legal aid for formal interviews and and trials, but it is unlikely they would have prior to being charged.

And just like the private rental through housing commission, when you are assigned a legal aid atty, if they are overburdened, you can be assigned a private atty that is paid for by legal aid.

My friend went through about 4 legal aid attys before they gave him a private atty that didn't cost him a cent.
 
Were Kristi and Robert present when their apartment was searched by Police and their bank records seized? I remember they left and stayed in a hotel. Therefore I am wondering if they were there, they would have hidden the records. TIA

I know there was a video or still shot of K&R with police inside the unit in the early days....just can't find it now to figure out exactly when it was.

Some good news....it seems that not everybody who was in close contact with Kiesha is letting her down.

A person by the name of Alison Anderson has been posting on the PKA FB page, and people are saying how great it is that she is finally standing up for keisha....someone also mentioned something about her being at the vigil.

Since I posted the last lot of pics from the kiesha vigil, more have been put up.
And it looks to me like this is the same Alison Andersan who staunchly defended K & R in the beginning. The same one that Mrs G believed had a different demeaner in her last presser. (which I missed myself).

Does what was written in this article confirm Police questioned Robert about the cash deposits during an interview at the police station and not at their house? There is no indication how Police obtained his bank records.
 
This is the only information I found on Kristi and Robert's relationship which was given by Liz Weippart: Aidxx's death occurred in 2002 and Kiesha was born on April 22, 2004.
It sounds like Kristi moved in with Robert shortly after Kiesha was born which means Robert has known Kiesha most of her life and K&R have lived together for about 5 or 6 years.

It was three weeks yesterday since she was first reported missing from her home near Mount Druitt by her mother Kristi Abrahams and stepfather Robert Smith.

She [Kristi] didn't feel like a mother and didn't feel like it was her child because she had a caesarean section and she didn't want to walk up the two flights of stairs [at their unit]. "Three days after they moved out, Chris came running in and said, &#8216;Mum, Axxxx blue.'
"I went running up the street with Chris. Axxxx was deceased three days after leaving my house."

That happened before the couple's relationship broke down and Kristi moved in with Mr Smith, taking Kiesha with her.
