Speaking of the good Judge (and contempt of court)...does anyone know if the defense filed their witness list?

Well, I am not sure that this is going to go over well, but I will give it a shot. To my own horror, I find myself defending - up to a point- the defense. I know, I know, they have been idiots in a number of ways. However, having said that; their witnesses could not do their work or finish their work or even start their work until they KNEW what they were going to be working on. I will be the first to admit that I do not remember when the first scientific evidence started being released to the public. Let's take the autopsy report as an example. When was the final report released? Until that report was released the defense did not know EXACTLY what kind of experts they would need - aside from the obvious second opinion on the autopsy itself - until they knew what the report contained. Their plant specialist, trace evidence specialist, etc. Am I making myself understood enough here? Their experts could not get started until the State turned over evidence for them to examine and report on.

Do I think the defense delayed on purpose? Yes, I do, but we have to give their experts a little slack because their work only began when the State released the evidence and reports to them.

Good point Macushla, and I agree with you - about the experts.

But there are PLENTY of other non-expert people that they could have been interviewing and/or deposing in the meantime. Ones whose interviews were released long, long ago.

Like this latest request today, where they're asking for 8 transcripts, on the taxpayers dime. I don't have the doc yet so I don't know who they're asking for, but if it's a non-expert, I'm gonna be PO'd again. :furious:

I'm probably going to be getting PO'd lots of times over the next year. Might as well get used to it. heh

Well color me so surprised...KC's family members and friends remain undeposed by the defense. Like that was too hard for them to do whilst wasting all of that moolah in the meantime and filing misspelled boilerplate pulled straight off of the internet motions. Shocker.

I really want them to be in contempt of court so I can see Baez skulk away to jail with his toothbrush.

And transcripts DON'T come cheap. The cost will depend on who requested to take the depo. If it's a deposition the defense requested then they will have to pay for the transcription service in addition to the copy of the transcripts. Just a Copy (no transcription service) can be anywhere from $500-$1000 PER DEPOSITION!

If I was a tax payer I'd be pissed if this was a deposition taken a long time ago and wasn't bought until the tax payers had to foot the bill.

I think you're gonna be PO'd - so many depositions scheduled now that could have been done a loooong time ago . . .
 
I just do not understand how or why the defense continiually can getaway with breaking the rules here. According to the response the defense is WAY, WAY past the allotted 15 days allowed for reciprocating in discovery. In fact we looking back at January 2009. I do realize that the experts have yet to finish their work but how much longer do you suppose HHJP will give them before blowing his stack? According to Baez they were at least at 50-60% through their work and that was his reason for requiring out of state experts.

Knowing that HHJP has zero tolerance for foolishness and has the utmost repect for judicial expediency I am wondering how long before he will set a date for the SA's request for a hearing on this matter? It also seems like it is going to definitely be time for Baez et al to put up or shut up. Oh and lest we not forget about MN also wanting a hearing...gotta find the right thread for this topic! LOL

When you consider that the court ordered the prosecution to provide the list of aggrivators within ten days of the court's ruling...and within half of that time the list that the defense so whined and opined about was produced...and yet the defense can't be bothered to do anything until the very last minute and certainly can't be bothered to depose her own family members or close friends...which they have had over a year and a half to do...now they want transcripts of depos...it is just mind boggling. I would call it lazy since they seem to believe that the state should do all of the defense's work for them...including I guess...just open the gate to KC's cell and set her free...cuz, it was just one little girl...she wasn't even three...not much to really worry or be concerned about. Now KC, there's an upstanding citizen with a proven track record of contributing in a positive way to society.

It just boggles my mind...40 witnesses...a list that took them a few days to compile and naturally, not one of them has even been deposed by the defense. While as many have mentioned, the witnesses the defense holds so dear...people who allegedly fake TES reports and relatives of Kronk who for whatever reason can't seem to be deposed under oath/penalty of perjury.

The only thing I can say as at least they made it by the 5:00 deadline. Which is really not a compliment. It was a court order.

Clearly, the taxpayers need an accounting of what they spent that $163,000 on. Because it SURE doesn't look like it was on this case.

Can the tax payers of FL file a motion to see exactly how that money was spent?

I've been wondering the same thing myself! I think that we have a right to know, ESPECIALLY in light of what the defense has NOT done.

Hornsby said last night on Steph Watt's blogtalk show that he was surprised none of the media have asked for that to be unsealed.

It's high time someone did. We need a local pro-bono lawyer to write this up for us. :)
 
Should we start a new thread to dicuss the actual Defense's Deposition Schedule or just use this one?
 
Didn't defense already take R. Cain and R. Kronk's depositions?
 
I am sitting here in a state of shock! Are the defense saying they have not yet deposed people such as Tony Lazzaro and Richard Morales, Jesse Grund, Roy Kronk, Rick and Shirley Plesea????

Have NOT deposed them in two years? WTF!:banghead:

Gee in TWO years a lot can happen..

People can move.
People can die.
People can suffer severe health complications, drug addictions, or accidents which affect their memory.
People can simply FORGET small details that may not have been a big deal to them, but a HUGE deal in the impact of this case.


KC should be infuriated with her defense. But she's in lala land.

And that my dear is what the defense is banking and hoping for .... Why do you think Judge Perry is pushing to get this show on the road. The defense will repeatedly bring up on cross that the events they are testifying about happened years ago and they could be "mistaken" about their testimony.
