Nearly three years after the death of a woman who left messages implicating her husband if she died, her spouse's homicide trial is expected to start in York County court.

Attorneys on Wednesday said the trial of Joseph Bernard Fitzpatrick III, 41, of 2288 Old Forge Road, will take at least a week and probably longer because of the extensive evidence and testimony to be presented...

Among the likely evidence are messages Annemarie Fitzpatrick left to be found in the event of her death, including an email she sent to herself the day she died. With the subject line, "if something happens to me," the body of that email states: "Joe and I are having marital problems. Last night we almost had an accident where a huge log fell on me. Joe was on the pile with the log and had me untying a tarp directly below," charging documents state.

The jury delivered a verdict of guilty for the man accused of killing his wife and trying to make it look like an accident. Joe Fitzpatrick was on trial for killing his wife. AnneMarie Fitzpatrick drowned on June 6th, 2012 in a creek on the property she shared with her husband in Chanceford Township, York County.

The jury convicted Joe of First Degree Murder for AnnMarie’s death and immediately after a judge sentenced him to life in prison.

Husband headed back to prison after Pa. court reinstates conviction for wife's murder

Nearly two years after a York County judge freed him, a husband is heading back to prison to serve a life sentence for murdering his wife.

A state Superior Court panel on Wednesday agreed with the county district attorney's office that there was ample evidence to support Joseph B. Fitzpatrick III's first-degree murder conviction for drowning his 44-year-old wife, Annemarie, in a creek in June 2012.

In an opinion by Judge Jacqueline O. Shogan, the state court sent Fitzpatrick's case back to county court with orders to reinstate his life prison sentence.

The Superior Court might not have the last word on the case since Fitzpatrick, now 44, could file an appeal with the state Supreme Court.

Wife's family speaks out after husband's murder conviction upheld

The York County District Attorney's Office today released the following statement from Annemarie Fitzpatrick's family:

"It has been almost five years since the death of our beloved Annemarie. During that time, our family has felt loss, anger and frustration as the legal process has played out. Three sources of strength have been our strong faith in God, our loving family and our dear friends that have carried us through the difficult times as we sought to rebuild our lives.

"Another source of strength has been the members of the Pennsylvania State Police and the District Attorney's office who have been there to answer our questions while relentlessly dedicating themselves to the pursuit of justice. Our gratitude to all of them cannot be adequately expressed in words.

"While our lives will never the same, we are grateful to put this part of our story behind us."

A York County judge has, at the direction of the Pennsylvania Superior Court, reinstated the first-degree murder conviction of a Felton-area man who drowned his wife in a creek in 2012 and claimed it happened during an ATV accident.

Joseph Fitzpatrick III, 44, then had his life sentence reinstated by presiding Common Pleas Judge Richard K. Renn during the hearing Wednesday, Dec. 6.

Emily told Renn that she had to consider the possibility that her father was "the monster" others had made him out to be. After her own careful review, she said, she now believes her father killed her mother.

But her younger sister, 14-year-old Rachel Fitzpatrick, has a different opinion. Crying and struggling to control herself, Rachel's statement was brief:

"I love you very much Daddy, and I don't believe you did it," she said. "I will always have faith in you."

A York County man in prison for the murder of his wife successfully appealed his conviction to the state's highest court.

On Friday, the Pennsylvania Supreme Court ruled that Joseph Bernard Fitzpatrick III, 48, of Chanceford Township, must receive a new trial. The justices found that prosecutors presented prejudicial evidence at his 2015 trial for the drowning death of his wife, 43-year-old Annemarie Fitzpatrick, in 2012.

Authorities alleged that Fitzpatrick wanted out of his marriage, was emotionally involved with another woman, and had a $1.7 million life insurance policy on his wife. Hours before her death, prosecutors said, Annemarie Fitzpatrick wrote, dated, and signed a note in her day planner at work saying “If anything happens to me — Joe.” She also wrote an email to herself titled “if something happens to me” saying the couple had marital problems and a huge log had almost fallen on her the night before.

The trial judge, in a rare move, set aside the jury verdict, saying prosecutors had not presented enough evidence to support a conviction. An appeals court reinstated the conviction, saying the note was allowed as evidence to show the victim’s state of mind, an exception to the hearsay rule. The court said the email wasn’t admissible but ruled that its admission was harmless “in light of the overwhelming evidence against Fitzpatrick.”
