GUILTY KS - Alicia DeBolt, 14, Great Bend, 21 August 2010 - #4

Ive never heard of people being able to call someone in Jail before???

Aug. 23: A Great Bend police detective got a call from Alicia's sister-in-law, who mentioned that Longoria drove a vehicle similar to the one that witnesses saw Alicia get into the night she disappeared.
While still on the phone with the sister-in-law, who was at Alicia's home, the detective heard Longoria's voice. Longoria had gone to Alicia's home, and the detective could hear him trying to organize a search party.

Can you believe this? He's an animal.....and she is one sick puppy. She KNEW he was chasing a 14 yr old girl....and did nothing..except tell him "to take care of the problem". Just what did that mean? And she has a little girl of her own!!!!! How stoopid and neglectful is that???

I'm furious. How desparate.....for both of them. Oh my word!!!

Its been a year since this horrible MONSTER took Alicia away from her family. May they find peace and closier soon, and may he be sentenced in a manner which will never give him the chance to hurt anyone ever again. RIP SWEET ALICIA!!!

SNIPPED FROM ARTICLE BBM

GREAT BEND - Attorneys for the man charged with capital murder in the death of a 14-year-old Great Bend girl want the case dismissed, arguing the prosecution released information combined with conjecture that could influence the jury pool.
In a motion filed Friday afternoon, the Kansas Death Penalty Defense Unit attorneys for 36-year-old Adam Joseph Longoria question why the Kansas Attorney General's Office opted to make public Longoria's stint as an informant for Great Bend police and the Kansas Bureau of Investigation - information the prosecution previously wanted sealed.

The defense motion argues the state unnecessarily released information on June 30 - including the state's analysis on the case and details of Longoria's alleged "fixation" with 14-year-old Alicia DeBolt - demonstrating "more than a desire to turn up the heat on the pressure cooker of Great Bend, Kansas, to insure that prospective jurors know clearly the state's theory of the case and to inflame their passion."

The state, in its June 30 motions, also released numerous text messages from Longoria's and DeBolt's cellphones between July 18, 2010, and Aug. 21, 2010, when Longoria is accused of luring the girl into his vehicle, taking her to an isolated area and attempting to rape her before killing her.

I didn't recall about the charges being changed, so I went back and found the article. Interesting find on the sodomy allegations and why they were dropped. ?? So do they think there was another male involved...? She had been shopping all day with her family before she met up with AL..right? So when was she with the unknown male? :waitasec:

Fri, Jul. 22, 2011--- Adam Longoria gets new hearing as prosecutors revise charges

Initially, Longoria had been accused of killing DeBolt after sodomizing her. But DNA recovered from DeBolt's body later was determined to belong to an unknown male, Longoria's public defender Jeff Wicks told the judge.
Now, the state has replaced criminal sodomy in the capital murder charge with attempted rape.

Adam Longoria faces trial, but not death penalty in case of slain Great Bend teen

Instead of death, he would face life without parole if convicted, said Ron Keefover, spokesman for the state's Office of Judicial Administration.
DeBolt's family read a brief statement outside the Barton County Courthouse saying they support prosecutors' decision not to seek the death penalty. The family declined to answer questions.

Kevin O'Connor, a special assistant attorney general, told Judge Hannelore Kitts that the state's decision not to seek the death penalty was based on careful deliberation of the facts, the conservative application of the death penalty law, and how appellate courts might view the case.

Now I am confused....I thought they dropped the sodomy charges?

When the case goes to trial, a jury will decide whether Longoria is guilty of capital murder and whether the underlying crime involved is criminal sodomy, aggravated criminal sodomy or attempted rape. Prosecutors are presenting each of those three crimes as alternative theories of how DeBolt was killed after she disappeared in August 2010.

The state laid out its case during a two-day preliminary hearing.

Text messages detail Adam Longoria's relationship with Great Bend teen before her death

Convenience store clerk Jenna Pitchford testifies in Barton County District Court in Great Bend, Kan.,

Stephanie Smith, an intelligence specialist with the Kansas Bureau of Investigation, analyzed messages taken off DeBolt's phone after her death, comparing it to data from Nex-Tech — the phone carrier she and Longoria used. Smith presented a series of text messages between DeBolt and Longoria, beginning on July 18, 2010, and ending the night she disappeared from her home four weeks later.

Texts between Longoria and DeBolt ceased, but the teen continued to send and receive texts, records show. Records also showed that both phones were communicating with towers in the general vicinity of the asphalt plant.

No Death Penalty at Longoria Trial
Judge Hannalore Kitts agreed with the prosecution that a jury should decide whether Longoria killed the young girl during the commission of a criminal sodomy, an aggravated criminal sodomy, or an attempted rape.

Only logical senarios would be there was another male there, or she had sex with someone since she had showered. JMO

(WICHITA, Kan.)—
Minutes after his motion hearing ended Thursday, accused killer Adam Longoria called Fact Finder 12 to talk about his case. Longoria is charged with capital murder in the death of 14 year-old Alicia DeBolt.

He maintains his innocence and says the unknown DNA found inside DeBolt's mouth is a crucial part of his defense.

God bless Alicia :(

Attorneys for Adam Longoria, the man accused of a 14-year-old Alisha Debolt of Great Bend last summer have asked the court to bar the teen’s family from showing emotion in the courtroom during his
trial.

The motion filed last week in the capital murder case of Adam Longoria also asks Judge Hannelore Kitts to keep the girl’s family and friends from sitting directly before the jury.

in her mouth...I know this is so inappropriate, but the crime was inappropriate, so I have to ask....I thought sodomy was the other end of the body?

This is really sad. I sometimes grow very broken hearted keeping up with the threads that have touched me the most, this one being one of them.

:(

Hey Lady, so good to see you. :seeya: I know what you mean regarding the frustrations of lady justice sometimes...and I should also borrow your Molly Maid apron at times and not be here at WS too much. :innocent:

It can be either....I wasn't sure and had to look it up.

I think a few have pondered that Flossie. TBH, since this last "bombshell" of the other DNA being found, I had wondered if it could have been EB's ...as a part of the rape scenario as well; but it was said to be other male DNA. I don't know that much about DNA, but curious if it is that easy to determine....and if so, I hope LE can find out just whose!!! It's important.

We have heard AD was texting others after being picked up by AL, but not who and what was being said. They have held that back for now, but I'm certainly curious about it.

On another note of contemplation: AL was ask to be an informant and then it was signed off on just a few days before AD's murder. Don't they do a "sorta background check" or "know" just who he is associating with before they do that? I would think!!!:waitasec::maddening:
