Baez' "other" murder trial...who and what were results?

I was watching a YouTube video where Baez was having an impromptu discussion with news people. He stated that he has handled a murder trial before. He said that it involved a child. What murder was it and what was the outcome...do you know?

The victim was Noeris Vasquez. The defendant was Nilton Diaz.

On Feb 11, 2006 ND ran with the child to a next door neighbor's because NV was not breathing...he was alone with the child for only a few minutes when he walked into the room where she was watching TV and found her on the floor. He described her as shaking and stiff. The mother, Samaris Bobe Silva, had just left to go to the store.

The fact is that ND was in the bathroom shaving and preparing to take a shower when the mother told him that she was going to the store. That was after they left the child in the room where they both said she was fine when they walked out.

ND was found guilty of Manslaughter 2....he had been charged with Murder 2. He was sentenced to 20 years.

I have spoken extensively with the family and their reps. Right from the very beginning of this case I was shaking my head. And after reading the files I'm not convinced ND is guilty. I'm just not sure. JB did not do so many things that he should have done during this case in my opinion. It really does amaze me. I will not be surprised if ND gets a new trial on appeal.

What was never brought up was the fact that the mother had been reported to child services in Puerto Rico prior to even knowing ND. The child had been seen with bruises before the mother met ND. The mother admitted to perjury on the stand (after she testified) and immediately went back to PR. Less than 2 weeks after her daughter died the mother was out at clubs partying. She wrote to ND in jail and told him she knew he didn't hurt her daughter.

IMO....there really does need to be another trial with ALL the facts

I have read very little on this case, but just the fact that ND received only 15 years for killing a two year old is astonishing. I know he was convicted of Manslaughter, but that sort of time isn't justice !

Let us pray that one thing they do not have in common is that sentence. Life for Casey Anthony because of the life she took from Caylee Anthony! A life for life!

Can someone with a better knowledge of the ins-and-outs of criminal law explain the notations about appointing a public defender for an appeal? I see Baez filed some of the papers for that. Is it likely because Diaz was unable to pay? Did Diaz and Baez part ways for another reason?

Or does the trial lawyer generally not handle the resulting appeals?

Now I find myself needing to read the docs for that case. It sure sounds hinky.

Baez wanted a friend of his, Walsh, to handle the appeal.

ND and his parents didn't want Baez anymore or anybody associated with him. They decided on a public defender for the appeal because they had mortgaged their home to pay Baez and still owed him money. Once he took on KC he was difficult to reach....not returning calls, canceling appointments, etc.

The parents didn't like the way Baez was handling their son's case right from the beginning. ND was not kept up to date on what was happening in the case and he was told by JB that he didn't need to be present at the hearings which they believe was a huge mistake. Baez didn't make enough effort, according to them, to take depositions, dig into the mother's history of abuse, or bring up prior injury to the child the night before this all happened.

After having read the documents and watched the interview with ND and the mother, I question the handling of the case and the jury's decision. I do think ND will get a new trial and I think he deserves it.....jmo

Well, it does seem JB keeps it consistent, doesn't like taking depositions, doesn't like to expend too much effort (at getting his own information), and doesn't like for his clients to be present at pre trial hearings...hummm. No wonder Strickland ordered Casey to attend the hearings. I wonder what Baez did tell his client, as far as his chances at trial. I wonder if he tried to negotiate a plea...

Well, he was supposed to be in court for the sentencing of his client, ND. JB was LATE because he was there with KC instead. If I was the client, I too would be upset with this lawyer that forgot all about his previous commitments once he found his cash cow. I am going to try to link the news story on this (it's towards the bottom of the story in the section CASEY'S ATTORNEY MAY HAVE BOTCHED LEGAL REQUEST). Hope it works, I'm new at this. :innocent:

That same day, Baez shoved a reporter. He also kept the Lake County judge, the victim's family and witnesses waiting. When he arrived, he made no apology.

Baez also requested a special hearing the day before that, asking for a delay in Diaz's sentencing, telling the judge he expected the media to follow him to Lake County after Anthony's release and that it would be prejudicial to Anthony.

Lake County Circuit Judge Mark Nacke denied Baez's request for that delay. Baez ended up taking Casey back to her house the day she was released from jail before he headed to Lake County. No reporters followed him to Lake County that day.

For Pete's sake! I just had a flashback to the Scott P trial and Mark G's untimely absence. (minus the damsel in distress, of course)

I do hope for this trial, JB is a little more professional.

I think it's shameful he was late to this guy's sentencing and didn't even apologize to the court. He didn't have to be there to escort KC out of jail, and yet he thought it was a perfectly reasonable excuse for being late to ND being sentenced. Unbelievable. He is as clueless as KC about how his actions affect others.

I agree, and it just shows how bad JB has it for KC, to miss (ie.be late for). a sentencing of his other client. This was the day that KC leaned into JB and ran her hand up the front of him, and whispered in his ear. Pu-leeze! :rolleyes:

This is obviously just a case of a bitter, scorned man....after repeated attempts, JB refused to eat licorice with him like he allegedly did with Casey.
