Wow, he's still on the discovery violation with the state and feels as if he was ambushed with the state investigating into CA's work records...how would they know CA was going to change her testimony from her deposition...Baez is truly inept...he can't grasp what was told to him yesterday that this is new information post testimony. LDB told Baez yesterday what the Gentiva people will be testifying to...

There is only one side trying to do a trial of ambush. Nuff said.
 
LDB states there are no references to the terms CA said she searched on the computer records in March.
 
LDB has all computer proof she needs, that ICA made the searches when her mother was at work!

Not a legal type here, but it makes sense to me that the prosec. has to respond to things they learned through the defense case, which by nature can't be dealt with before the trial begins. Who knew what witnesses would say on the stand? Some of this stuff has to be "new" as in after the defense rests.

What 'report?' They are TIME RECORDS, raw data, not a report!

And I thought the defense didn't have a computer expert?
 
i guess JB would have had notice if he had bothered to let the SA know that CA was going to dispute the truth of her timecards sheesh

He answered HHJP yesterday that he knew CA was going to change her testimony. Did he just say he did not?

Sims didn't ask to speak to computer experts until after 5pm yesterday. Baez says he would have liked to have known about this before hand. Upset that there are no reports - this is a complex process and state should have put us on notice.
