MN - Rapist kidnapper who said would kill victim when freed may be released

Well, it appears court did reconvene, but I don't know what the result was.

The hearing was originally scheduled for three days, but it's expected to continue into next week.

This case was profiled by the new ABC Primetime program Mind Games.
The full episode can be viewed online here.

Also a status update on the Civil Commitment hearing:

The final briefs are due July 1 and then the judge has 90 days to make a final determination whether Shiue should be indefinitely detained as a sexually psychopathic offender or could become eligible for parole.

Apparently his proposed plan for release involves living with his very elderly mother. She currently resides in a nursing home but Shiue proposed that she could be removed from the facility and they could share an apartment. He planned to support himself by securing Federal grant money so that he could pursue his mathematical research.

That plan is insane. This man has served his time but he has not paid his price to society. They discounted his liability in a plea deal. He should never be allowed to be free again.

I will be stunned if any judge, no matter how liberal, let's him go. The SJC cleared the way for civil committment indefinitely as a means to society protecting itself from predators. Seems to fit to a t here.

The victim in this case is an extra ordinary person....

I am really puzzled as to why he got so little time in the first place, considering what he had done.
Just strange he didn't get at least the life in prison with no possibility of parole.

Read the comments for the links in the first post-someone posted as if they were related to Jason, the 6 year old murder victim. They indicated he was never charged additionally for the rapes, the attack in the courtroom of Mary and was given a plea deal for the second degree murder charge.

So, he received 40 years for the kidnapping of Mary and Beth, and the killing of that poor little man.

gosh, what a scary thing to have to deal with

Why wasn't he ever charged? Boggles the mind.

That is the question, right? I mean the guy made a shiv and attacked his victim yet again at the murder trial screaming he just wanted to be with her one more time. She is not safe-regardless of how she and her daughter have forgiven him, she is not safe.

How could this guy get a plea deal that could soon let him back out into the society? Is it because of the insanity defense? I am absolutely fed up with insanity defenses. If someone is deemed legally insane, they should be locked up in the hospital for the criminally insane, and if they are ever judged sane enough, send to prison to serve the rest of their sentence instead of being let out on un-suspecting society.
