Authorities said they found the body of Bobby Joe Grubbs wrapped in a blue tarp in a mulch pile, according to a search warrant.

The mulch pile was on the property of the man who is accused of killing him.

The body of Grubbs, 31, was found on Saturday, the same day police arrested Joseph Kutter, 78, who sits in the Preble County Jail pending a formal filing of a murder charge.

According to a search warrant obtained by News Center 7, police found an AK 47 rifle in an upstairs bedroom, a bullet in a garden on the southwest side of the house, plastic blue tarp in a mulch pile west of the house, and the body of Grubbs inside the blue tarp. Police also found maggots on the body, roofing shingle on the body and two small bones on a path behind the house, according to the warrant.

The warrant was signed on Saturday.

Preble county has a horrible meth problem, I wonder if poor Bobby was in the wrong place at the wrong time, and stumbled across meth dealers. His poor family, this is so sad.
 
So Kutter claims he shot Grubbs in self defense and then doesn't call LE to report it. Instead moving the body several times in the week that follows.

I don't think Kutter has much chance of getting found not guilty.

Ginseng case jury deadlocks on murder charge

The Preble County Common Pleas jury deadlocked on a count of murder, but found Joseph Kutter guilty of tampering with evidence and gross abuse of a corpse in the death of Bobby Joe Grubbs, 31.

Joseph Kutter is to plead guilty to one count of voluntary manslaughter, which the prosecutor’s office reduced from the original charge of murder...

At trial, prosecutors said Grubbs intended to collect the ginseng, which he knew to be growing on Kutter’s property. Ginseng is a valuable herb that can sell for hundreds of dollars per pound when properly dried and prepared.

Kutter told the Preble County Sheriff’s Office he saw a man walking in his yard at 7905 W. U.S. 40. He told them that when he asked the trespasser what he was doing, the man charged at him. Kutter said he then shot the trespasser in the torso using what prosecutors believe was an AK 47... Kutter told them he put the body in a creek bed and moved it several times during before he told authorities it was in a mulch pile.

Joseph Kutter got the minimum three-year voluntary manslaughter sentence for the death of Bobby Jo Grubbs. He is scheduled to be released from prison in June 2016.
