‘Juror 83’ Is First Tsarnaev Juror To Speak About Trial Experience, Death Penalty Decision

"BOSTON The judge in the Boston Marathon bombing trial has rejected a motion brought by The Boston Globe and joined by WBUR to publicly release the names of the trial jurors.

In a ruling Monday, the judge said the list would remain under seal while the defense seeks a motion for a new trial. The judge stated that because the defense wants to examine social media activity of trial jurors, releasing the jurors’ names will enable reporters to interview the jurors and muddle the inquiry with “headlines and evening news.” Neither the defense nor the prosecution have opposed the release of the jurors’ names.

As the judge was issuing the decision, Kevan Fagan, “Juror 83” in the trial of Dzhokhar Tsarnaev, sat down for an interview in our studio with WBUR’s Jack Lepiarz and David Boeri, who both covered the trial...

List of jurors in Boston Marathon bombing trial released

"...Names of jurors are typically released shortly after a trial concludes, except in certain high-profile cases – such as this one, said Jeffery Cohen, an adjunct professor of law at Boston University...

U.S. District Court Judge George A. O’Toole Jr. denied a request from The Boston Globe to release the jurors’ names in August, citing “post-trial matters” still pending in the U.S. District Court in Boston. The names were disclosed Friday because the matters have now concluded, according to the Globe.

O’Toole said the list would remain under seal while the defense sought a motion for a new trial. Tsarnaev's lawyers wanted to examine the jurors' social media accounts to look for any signs of a bias, said Karen Pita Loor, a clinical professor of law at Boston University.

"Once the names of the jury became public, the defense felt it would be possible that (the jurors) would shut down their social media sites due to the public attention," said Loor, who specializes in criminal law and trial practice.

A federal judge denied a request for a new trial in January. The request was largely based on the claim that Tsarnaev could not get a fair trial or an unbiased jury in the same city where the bombing occurred because of its severe emotional impact..."

Dzhokhar Tsarnaev defense team steps down

"A new defense team for Boston Marathon bomber Dzhokhar Tsarnaev was requested in a motion filed Wednesday by Miriam Conrad, the former lead defense attorney for the case...

In her motion, Conrad noted the new defense team who will take over as the case moves into the appeals process.

“Mr. Tsarnaev specifically moves the Court to substitute, as counsel on appeal, David Patton and the Federal Defenders of New York, and Gail Johnson, Esq., of Boulder, Colorado, for trial counsel Miriam Conrad and the Federal Public Defender Office for the Districts of Massachusetts, New Hampshire, and Rhode Island, and David Bruck, Esq.,” Conrad wrote in the motion.

According to the motion, this decision is in line with the Guide to Judiciary Policy, which stipulates that at least one attorney representing a death-sentenced federal appellant must be someone who has not previously represented the appellant in trial. Conrad also said this substitution has set a precedent for other similar cases.

“The requested substitution also comports with the practice of other circuits in federal death-penalty appeals, including cases in which Federal Defender Offices were relieved for appeal,” Conrad wrote in the motion. “And, most important, it would provide Mr. Tsarnaev with high-quality, cost-effective representation.”

Conrad also addressed the concern that the new defense team is from outside of the commonwealth..."

Boston bombing survivor killed in Dubai car crash :(

"A woman who survived the Boston Marathon bombing in April 2013 and was seen being carried away from the site by a firefighter in an iconic photograph was killed in a car crash, Northeastern University said in a statement.

Local Boston news website MyFoxBoston said the crash occurred in Dubai.

“Northeastern University has confirmed that two undergraduate students have been tragically killed in a car accident overseas,” the university said. “Our hearts go out to the family and friends of Victoria McGrath and Priscilla Perez Torres in this extremely difficult time.”...

Victoria McGrath was 20 years old when two bombs ripped through a crowd of spectators gathered at the marathon's finish line three years ago, killing three and injuring 264...

Boston bomber passed citizen test months before deadly attack: paper

"The older of the two brothers behind the deadly 2013 Boston Marathon bombing had passed a test to become a U.S. citizen three months before the attack, the Boston Globe reported on Monday, citing federal documents.

Tamerlan Tsarnaev, a 26-year-old ethnic Chechen who had immigrated to the United States from Russia a decade before the attack, had correctly answered questions about American history and demonstrated proficiency in the English. But the U.S. immigration officer who reviewed his test did not immediately approve Tsarnaev's citizenship application, the newspaper reported.

Its report was based on 651 pages of heavy redacted documents released by the Department of Homeland Security..."

"Tamerlan Tsarnaev passed the US citizenship test three months before he and his younger brother detonated two bombs at the Boston Marathon, according to federal immigration records obtained under the Freedom of Information Act.

His test results, with correct answers to questions about slavery, the Constitution, and the Louisiana Purchase, are in 651 pages of previously confidential files on the bomber and his friend Ibragim Todashev. Both men were killed in separate incidents after the April 15, 2013, bombings.

The Department of Homeland Security provided redacted files to The Boston Globe after multiple requests spanning three years. Only 206 pages were released in their entirety, so it remains unclear why the government granted the friends legal residency and put them on the path toward US citizenship..."

Boston bombing movie will not recreate shootout in Watertown

"WATERTOWN, Mass. — If you look closely, you can still see the bullet holes in some houses here on Laurel Street.

This street is where police exchanged a barrage of bullets with Tamerlan and Dzhokhar Tsarnaev, four days after the brothers set off two bombs at the 2013 Boston Marathon. This street is also where filmmakers for Patriot’s Day, a new movie about the marathon bombing, wanted to recreate the shootout — with the gunfire, sirens, cop cars and all.

The town of Watertown decided Friday that such a vivid re-enactment of a terrible night should not be filmed in the neighborhood.

“Upon further reflection, filming the recreation of the Watertown shootout when police encountered the Boston Marathon bombers at the intersection of Dexter Avenue and Laurel Street is not in the best interest of Watertown,” the city's statement said...

Patriot’s Day is set to star Mark Wahlberg as a central character, and J.K. Simmons recently signed on to play Watertown police sergeant Jeffery Pugliese, who had a key role in the shootout. Dzhokhar Tsarnaev classmates to screen short film ‘Jahar’ at Tribeca

"Boston may be bracing itself for the first feature-length depictions of the 2013 Marathon bombings later this year, but Dzhokhar Tsarnaev will be the subject of another film even sooner. Developed by two of Tsarnaev’s high school classmates, “Jahar,” a short film set in the aftermath of the attack, will premiere this April at the Tribeca Film Festival in New York.

The short is directed by Henry Hayes and written by Hayes and Zolan Kanno-Youngs. Both classmates of Tsarnaev’s at Cambridge Rindge and Latin School, Hayes and Kanno-Youngs based the film on the revelation that Tsarnaev, their friend, had helped carry out the bombings...

911 call that ended Watertown manhunt for Marathon Bomber released
The 911 call that ended the most dramatic manhunt in Boston history was released to WBZ on Friday.

Watertown resident David Henneberry called police after discovering Dzhokhar Tsarnaev hiding in his boat.

The call brought the manhunt to a close four days after the bombings at the Boston Marathon finish line.

The first of Boston Marathon bomber Dzhokhar Tsarnaev’s three college classmates convicted of helping him cover his tracks and buy time to evade capture will be released from prison Thursday.

Azamat Tazhayakov, 22, now at the Ashland Federal Correctional Institution in Kentucky, has been behind bars since shortly after the April 2013 bombings.

U.S. Immigration and Customs Enforcement officials likely will take Tazhayakov into custody while deportation proceedings are pending against the Kazakhstan national. His student visa was invalid at the time of his 2013 arrest.

Al-Qaida leader Ayman al-Zawahiri has warned the US of the “gravest consequences” if Boston marathon bomber Dzhokhar Tsarnaev or any other Muslim prisoner is executed.

Tsarnaev, named in Zawahiri’s online video message, was sentenced to death by lethal injection last year for the 2013 bomb attack that killed three people and injured more than 260 others. Tsarnaev committed the bombing with his older brother, Tamerlan, who was killed in a shootout with police in the manhunt that followed it.

“If the US administration kills our brother the hero Dzhokhar Tsarnaev or any Muslim,” Zawahri said in an online video, “[it] will bring America’s nationals the gravest consequences.”

Boston Marathon bombing survivor to marry firefighter who saved her

"When Roseann Sdoia was laid up with an amputated leg in the wake of the Boston Marathon bombing, love was the last thing on her mind...

On the day of the bombing in April 2013, Sdoia, 48, a long-distance runner, was a spectator near the marathon finish line when the pressure-cooker bombs went off.

Materia, 37, rushed to her aid and comforted her during the ride to Massachusetts General Hospital in a police vehicle.

“I asked him if I was going to die. And he told me that I was going to be OK, that I only had a flesh wound,” she recalled.

Materia visited a couple days later and made a great impression on her mother while Sdoia was recovering in intensive care...

The lovebirds went on their first date in June 2013. A month later, they spent the Fourth of July on Nantucket. Last month, he proposed on a lookout deck at the island’s whaling museum with the help of their pooch, Sal.

The dog was wearing a special engraved dog tag that read, “Mike wants to know . . . If you’ll marry him.”..:

The couple now plans to have a small wedding in October or November...:cake:

In March, they plan to release a book called “Perfect Strangers” about four lives that intersected during the bombing."

The FBI said it had looked at government databases, phone communications and online radical sites, and had interviewed Tsarnaev and his family in 2011 as part of that inspection. The agency said its inspection did not find any terrorism activity and cleared him that summer.

In 2013 after the bombings, several politicians criticized the FBI's handling of the earlier investigation. Sen. Lindsey Graham, for one, said the "ball was dropped" in the investigation.

But details on what agents learned during that interview had not been made public until now..."

I can't help but wonder how DT is holding up in prison. I imagine going from a social pot smoking college student with access to every type of entertainment possible to in isolation in a cell would make him stir crZy.

Dzhokhar Tsarnaev’s college pal Robel Phillipos slated for release today

"One month after the U.S. Supreme Court refused to hear Robel Phillipos’ appeal, the second of three former college students convicted for their roles in the coverup of the 2013 Boston Marathon bombings is being set free.

Phillipos, 24, of Cambridge, was scheduled to be released today from a residential re-entry management program in Philadelphia, after finishing the three-year incarceration portion of his sentence, according to the Federal Bureau of Prisons. Phillipos will remain on supervised release for the next three years....

No known threats, but FBI, police plan to be prepared

"Federal agents and local police are looking at a full range of potential threats from shooters to weaponized vehicles as they plan security for next month’s marathon, Boston FBI chief Harold “Hank” Shaw said yesterday.

Shaw did not indicate that authorities have detected any known threat to the April 16 event — a 26.2-mile race from Hopkinton to the Back Bay. But he said security officials don’t plan on being caught with their guard down.

“We’re consistently looking at how that threat is morphing, whether it be the threat of the potential active shooter, whether it be vehicles used as a device for terrorism,” he said. “And all those things are factored into the greater plan of how we’re going to protect ... whether it be the marathon, whether it be last year’s Sail Boston, whether it be the fireworks on the Esplanade, whether it be the Head of the Charles...."
